Congratulates the staff and administration of Chicago State University for the establishment and ribbon-cutting of the Global Institute of Sustainable Development and for the inauguration of the Institute's Africa Center, microfinance initiative, and Global Africa Partnership Forum.
Creates the Long Term Care Rebalancing Note Act. Provides that every bill, except those bills making a direct appropriation, the purpose or effect of which is (i) to expend any State funds for long term care services or (ii) to expend any State funds for community or home-based alternatives to long term care services, shall have prepared for it prior to second reading in the house of introduction a brief explanatory statement or note which shall include a reliable estimate of the anticipated change in State funding or revenues under its provisions. Provides that for purposes of the Act, revenues include, but are not limited to, changes to revenue received from Federal Medical Assistance Percentage (FMAP). Contains provisions concerning preparation of the note; confidentiality requirements; and other matters. Effective immediately.
Creates the Smoke-Free Campus Act. Sets forth the General Assembly's findings. Provides that beginning on July 1, 2014, smoking is prohibited on each campus of a State-supported institution of higher education. Provides that on or before December 31, 2013, each State-supported institution of higher education shall establish a community task force for the purpose of coordinating with community and campus leaders for the implementation of the Act. Provides that the governing board of each State-supported institution of higher education shall implement the Act and shall promulgate all policies and regulations necessary for this purpose, including, but not limited to, disciplinary action, fines, and an appeals process. Effective immediately.
Amends the Intergovernmental Cooperation Act. Makes changes in the provision concerning joint self-insurance. Provides that any statement of actuarial opinion, as defined in the Code of Professional Conduct of the American Academy of Actuaries (the Academy), must be prepared by an actuary who satisfies the qualification standards set forth by the Academy to issue the opinion in the particular area of actuarial practice. Amends the Illinois Insurance Code. In provisions concerning deposits of securities, deletes certain references to provisions of the Code concerning rated credit instruments. Makes changes in the provisions concerning the kinds of reinsurance agreements that shall not be entered into by any domestic company unless such agreements are approved in writing by the Director of Insurance and the assignability of life insurance. Repeals the Insurance Exchange, Assessment Legal Reserve Life Companies, Mutual Benefit Associations, and Small Employer Group Health Insurance Law Articles of the Code. Repeals provisions concerning the committee to create a uniform small employer group-health status questionnaire and individual health statement and accident and health expense reporting.
Amends the School Code. Replaces provisions concerning State goals and assessment. Requires the State Board of Education to establish the academic standards that are to be applicable to students who are subject to State assessments, with public participation. Provides that (i) beginning no later than the 2014-2015 school year, the State Board shall annually assess all students enrolled in grades 3 through 8 in English language arts and mathematics; (ii) beginning no later than the 2017-2018 school year, the State Board shall annually assess all students in science at one grade in grades 3 through 5, at one grade in grades 6 through 9, and at one grade in grades 10 through 12; and (iii) the State Board shall annually assess schools that operate a secondary education program in English language arts and mathematics. Provides that the State Board shall administer no more than 3 assessments, per student, of English language arts and mathematics for students in a secondary education program and one of these assessments shall include a college and career ready determination. Provides that students who are not assessed for college and career ready determinations may not receive a regular high school diploma unless the student is exempted from taking State assessments. Sets forth provisions concerning students receiving special education services and students determined to have limited English proficiency, results of scores, the National Assessment of Educational Progress, and local assessments. Makes related changes. Effective July 1, 2014.
Amends the Illinois Insurance Code. Makes changes in the Section concerning transactions involving contracts of insurance issued to one or more industrial insureds to apply to transactions involving contracts of insurance independently procured directly from an unauthorized insurer by industrial insureds. Provides that within 90 days after the effective date of each contract of insurance issued under the Section, the insured shall file a report with the Director of Insurance by submitting the report to the Surplus Line Association of Illinois and provide information as designated by the Surplus Line Association of Illinois. Provides that within 30 days after filing the report, the insured shall pay to the Director for the use and benefit of the State a sum equal to the gross premium of the contract of insurance multiplied by the surplus line tax rate and shall pay the fire marshal tax. Includes surplus line producers and industrial insureds in the provisions concerning refunds, penalties, and collection. Sets forth requirements for when more than one insured from a group that is not affiliated are named insureds on a single surplus line insurance contract. Makes changes in the provisions concerning surplus line and examinations of the Association.
Amends the Children's Health Insurance Program Act. Makes a technical change in a Section concerning the legislative intent of the Act.
Amends the Title Insurance Act. With regard to the requirement that every application for registration of a title insurance agent shall include a signed and notarized affidavit of the applicant, affirming that the applicant and every owner, officer, director, principal, member, or manager of the applicant has never been convicted or pled guilty to any felony or misdemeanor involving a crime of theft or dishonesty, provides that, alternatively, the affidavit may accurately disclose any such felony or misdemeanor involving a crime of theft or dishonesty. Provides that no person who has had a conviction or pled guilty to any felony or misdemeanor involving theft or dishonesty may be registered by a title insurance company without a written notification (rather than a separate written notification) to the Secretary of Financial and Professional Regulation disclosing the conviction or plea.
Amends the Premises Liability Act. In a Section concerning off-road riding facilities, exempts owners or operators from civil and criminal liability arising out of or as a consequence of noise or sound emissions resulting from the use (instead of "normal use") of the off-road riding facility.
