Rep. Paul Evans

Prohibits commercial sale of health information by covered entity, business associate, subcontractor, as defined by Health Insurance Portability and Accountability Act of 1996, or other third party, without authorization of individual whose health information would be included in sale. Makes violation of prohibition unlawful practice. ] Becomes operative January 1, 2021. ] Establishes Task Force on Protecting Health Information. Specifies membership and duties. Requires task force to report to interim committees of Legislative Assembly related to judiciary by December 1, 2019. Declares emergency, effective on passage.

Requires Oregon Health Authority to analyze ground water contaminant data and provide education in areas with ground water contaminant problems. Authorizes authority to make grants and loans for purpose of assisting rental property owners and low-income property owners with installation of treatment systems. Authorizes authority to make grants to local public health authorities and other specified entities for purposes related to ensuring safe ground water. Establishes Safe Well Water Fund and continuously appropriates moneys in fund to authority for purpose of making grants and loans. Appropriates moneys from General Fund for deposit in Safe Well Water Fund. Requires, for each dwelling unit rented by landlord for which source of drinking water is well, landlord to collect and test samples of drinking water from dwelling unit for arsenic, total coliform bacteria ] E. coli and nitrates. Becomes operative March 1, 2020.

Directs State Fire Marshal to enter into grant agreement with Eugene Springfield Fire to enable development of urban search and rescue capabilities. Requires that Eugene Springfield Fire agree to conduct urban search and rescue operations throughout state when requested by State Fire Marshal, subject to certain limitations. Directs State Fire Marshal to study and make recommendations regarding current urban search and rescue capabilities in this state. Requires State Fire Marshal to submit report on findings by September 15, 2020. Appropriates moneys from General Fund to State Fire Marshal. Declares emergency, effective July 1, 2019.

Appropriates moneys from General Fund to Oregon Health Authority for Senior Farm Direct Nutrition Program and Women, Infants and Children Farm Direct Nutrition Program. Directs Oregon Health Authority to include appropriations for programs in biennial agency request budgets. Declares emergency, effective July 1, 2019.

Requires nonprofit corporations that meet certain requirements, including receipt of public funds, to comply with open meetings law and public records law, to post copy of corporation's proposed annual budget to corporation's public website and to submit to and cooperate with audit. Subjects members of corporation's board of directors and officers and employees of corporation to government ethics standards. Becomes operative January 1, 2020. Declares emergency, effective on passage.

Requires businesses receiving more than 20 percent of gross receipts from public contracts to include statement of amount received with tax return filed with Department of Revenue. Applies to tax years beginning on or after January 1, 2022.

Requires Department of Veterans' Affairs, in its biennial agency request budget, to request certain level of funding. Requires Governor's budget to fund department at certain level of funding. Requires Legislative Assembly to fund department at certain level of funding. Provides that requirements do not apply under certain negative economic conditions.

Creates Task Force on Extending the Westside Express Service Commuter Line to Salem. Sunsets December 31, 2020. Takes effect on 91st day following adjournment sine die.

Establishes tax credit against personal income taxes for purchase of qualifying gun safes or locking mechanisms. Applies to tax years beginning on or after January 1, 2020, and before January 1, 2026. Takes effect on 91st day following adjournment sine die.

Requires Higher Education Coordinating Commission and Department of Veterans' Affairs to adopt by rule additional minimum standards regarding source of tuition revenue for licensing of career schools that receive $10 million or more in annual revenue or that are subsidiary with parent company ] and schools authorized to confer degrees . Establishes different criteria for career schools and schools authorized to confer degrees that collect $1 million or more in annual gross tuition revenue. Establishes civil penalty for violation of standards.
