Rep. Paul Evans

Makes various changes to workers' compensation laws of this state. ] Provides that diagnostic services are compensable under workers' compensation law after industrial accident or occupational disease has been determined to be compensable and if diagnostic services are reasonable and necessary to identify nature or extent of medical condition that may be related to industrial accident or occupational disease. Specifies certain limitations. Provides that employer bears burden of proof in denial of coverage that otherwise compensable condition is no longer major contributing cause of need for treatment and disability of combined condition. Declares emergency, effective on passage.

Removes assistance animals from existing offense of interfering with assistance, search and rescue or therapy animal. Creates crime of interfering with assistance animal in second degree. Punishes by maximum of 364 days' imprisonment, $6,250 fine, or both. Increase penalties to maximum of five years' imprisonment, $125,000 fine, or both, if person has certain previous convictions at time of offense. Adds crime to list of offenses for which instrumentalities of crime may be criminally forfeited. Creates crime of interfering with an assistance animal in first degree. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Increases penalties to maximum of 10 years' imprisonment, $250,000 fine, or both, if person has certain previous convictions at time of offense. Adds crime to list of offenses for which instrumentalities of crime may be criminally forfeited. Identifies costs and expenses included in economic damages for purposes of restitution for conviction of interfering with assistance animal.

Requires health benefit plan , coverage ] other than employer-sponsored plan, that covers cost of pregnancy care and childbirth to cover cost of pregnancy care and childbirth for surrogate mothers ] enrollee who is surrogate. Prohibits plan from requiring enrollee to reimburse plan for plan's costs or to assign to plan right to receive surrogacy payment.

For purposes of taxpayer election of reduced tax rate for certain pass-through income, reduces tax rates, reduces maximum eligible income and modifies employment requirements. Applies to tax years beginning on or after January 1, 2020. Takes effect on 91st day following adjournment sine die.

Authorizes issuance of lottery bonds to finance acquisition and restoration of Willamette Falls navigation canal and locks. Declares emergency, effective July 1, 2019.

Directs Department of Human Services to develop pilot program contracting with Yamhill County for provision of community-based child welfare services. Directs department to report annually to interim committees of Legislative Assembly regarding progress of pilot program. Sunsets January 2, 2025. Declares emergency, effective on passage.

Requires Secretary of State or county clerk, rather than filer, to designate argument filed for publication in voters' pamphlet as either supporting or opposing ballot measure.

Creates income tax credit for employing youth workers. Applies to tax years beginning on or after January 1, 2019, and before January 1, 2025. Takes effect on 91st day following adjournment sine die.

Establishes Open Spaces Task Force on Emergency Preparedness ] Task Force on Disaster Response and Recovery . Directs task force, inter alia, to identify locations suitable for emergency preparedness, response and recovery needs , identify projects to prepare Redmond Municipal Airport and Oregon International Port of Coos Bay for use in emergency, and identify other projects to increase emergency resilience of this state. Requires report to Legislative Assembly by September 15, 2020. Sunsets on December 31, 2020. Declares emergency, effective on passage. ] Takes effect on 91st day following adjournment sine die.

Allows development of parsonage on land where nonresidential place of worship is allowed use.
