VEH CD-AUTOMATED RED LIGHT ENF

Amends the Illinois Vehicle Code. Provides that an automated traffic law system may not be used to issue violations to persons driving a motor vehicle who enter an intersection against a red signal indication in violation of a provision of the Illinois Vehicle Code or similar local ordinance providing that vehicular traffic facing any steady red signal may cautiously enter the intersection to turn right, or to turn left from a one-way street into a one-way street, after stopping as required by the Code. Effective January 1, 2010.

IL PROF LAND SURVEYOR ACT

Amends the Illinois Professional Land Surveyor Act of 1989. Makes changes to the definition of "practice of land surveying". In a provision concerning the qualifications of a person applying for license as a Professional Land Surveyor, adds the new requirement that the applicant must have a baccalaureate degree in a related science if they do not have a baccalaureate degree in land surveying from an accredited college or university. In a provision concerning the qualifications of a person applying for license as a Licensed Land Surveyor-in-Training, adds the additional requirement that the applicant must have either (1) an Associate of Science degree in surveying or a related science, at least 24 semester hours of land surveying courses from a Board approved curriculum of an accredited institution, and at least 2 years of land surveying experience verified by a professional land surveyor that was in direct supervision and control of his or her activities, or (2) at least 24 semester hours of land surveying courses from a Board approved curriculum of an accredited institution and at least 4 years of land surveying experience verified by a professional land surveyor that was in direct supervision and control of his or her activities. Effective immediately.

PEN CD-IMRF-ERI-ELECTED

Amends the IMRF Article of the Illinois Pension Code. In provisions concerning early retirement incentives, provides that an annuitant who has received an age enhancement or creditable service under those provisions and thereafter accepts employment with or enters into a personal services contract with an employer does not forfeit that age enhancement or creditable service for service in an elective office if the annuitant elects not to participate with respect to service on or after the effective date of the amendatory Act in that office. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

MEDICAL PRACTICE ACT-DELEGATE

Amends the Medical Practice Act of 1987. Provides that nothing in the Act shall be construed to limit the right of persons licensed under the Act to delegate tasks or duties to licensed or unlicensed personnel who have the training or experience to perform the tasks or duties so delegated. Effective immediately.

DFPR-REMOVE PUBLIC RECORD

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that any licensee disciplined under a licensure Act administered by the Division of Professional Regulation for an offense relating to the failure to pay taxes, child support, or student loans or relating to continuing education or advertising may file a petition with the Department on forms provided by the Department, along with the required fee of $200, to have the records of that offense removed from public view on the Department's website if certain conditions are met. Provides that nothing shall prohibit the Department from using a previous discipline for any regulatory purpose or from releasing records of a previous discipline upon request from law enforcement, other governmental body, or the public. Provides that removal of records of a disciplinary offense from the Department's website shall not be considered a vacating or expunging of the offense from the licensee's disciplinary record. Effective immediately.

IL LANDSCAPE ARCHITECTURE ACT

Amends the Illinois Landscape Architecture Act of 1989. Replaces all references to "Director" with "Secretary". Provides that failing to respond and provide information to the Department within 30 days of a written request is grounds for discipline (now, 60 days). Provides that the Department may take disciplinary action against any person that commits certain tax violations. Provides that the Department shall deny a license or renewal to a person that has defaulted on an education loan or scholarship provided or guaranteed by the State. Provides that the Department may suspend or revoke a license, or deny a license or renewal, or take any other disciplinary action against a person who is more than 30 days delinquent in the payment of child support if the Department of Healthcare and Family Services has certified the delinquency to the Department. Provides that fines shall not exceed $10,000 for each violation under the Act (now, $1,000). Defines "address of record". Makes other changes. Effective immediately.

PENCD-CHIC TCHR-PROP TAX

Amends the Chicago Teacher Article of the Illinois Pension Code. Provides that the Board of Education shall demand and direct and the city council of the city shall levy a tax of 0.1% annually upon all taxable property in the city. Provides that revenues derived from the tax shall be paid to the city treasurer of the city as collected and held by him or her for the benefit of the Public School Teachers' Pension and Retirement Fund of Chicago. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

ORTH, PROSTH, & PED PRAC ACT

Amends the Orthotics, Prosthetics, and Pedorthics Practice Act. Makes changes in Sections concerning the powers and duties of the Department, the Board, qualifications for licensure, the renewal or restoration of a license, the grounds for discipline, and the appointment of a hearing officer. In a Section concerning exceptions, provides that the Act shall not be construed to prohibit a licensed advanced practice nurse from engaging in his or her profession (now, physical therapist or occupational therapist). In a Section concerning the limitations on the provision of care and services, provides that a licensed orthotist, prosthetist, or pedorthist may provide care or services if the care or services are provided pursuant to an order from an advanced practice nurse (now, a licensed physician or podiatrist). Creates new Sections concerning returned checks and fines, subpoenas, unlicensed practice and civil penalties. Defines the terms "address of record", "off-the-shelf device", and "Secretary". Repeals Sections concerning the transition period and enforcement. Repeals a Section concerning elective inactive status and reinserts its contents into a Section concerning the renewal or restoration of a license. Makes other changes. Effective immediately.
