FINANCIAL INSTITUTIONS-FEES

Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.

SENIOR CITIZEN IMPACT STATEMNT

Creates the Senior Citizen Impact Statement Act. Provides that a State agency that provides or arranges for services to senior citizens must prepare and file a Senior Citizen Impact Statement (i) before final action is taken on a bill, an amendment to a bill, or a conference committee report by the Senate or the House of Representatives, (ii) before the expiration of the second notice period in connection with a proposed administrative rule or a proposed amendment to an administrative rule, as provided in subsection (c) of Section 5-40 of the Illinois Administrative Procedure Act, (iii) before a program or fiscal transfer is made from one agency to another agency or from one fund to another fund, or (iv) before a memorandum of understanding, program instruction memorandum, program directive, or any other document that has the force of law or serves to clarify a law can be effectuated. Sets forth the requirements for a senior citizen impact statement, and designates the individuals and entities with whom the statement must be filed. Effective immediately.

ULTRASOUND ADMINISTER ACT

Creates the Ultrasound Administration Act. Requires a person that issues an order or a referral for the administration of an ultrasound upon a pregnant woman to be licensed to practice medicine in all of its branches, licensed as an advanced practice nurse, or licensed as a certified nurse midwife. Provides that an order or referral for the administration of an ultrasound shall not be issued for entertainment purposes or for any other purpose which is not warranted by the condition of the patient as determined by the treating physician, advanced practice nurse, or certified nurse midwife. Provides that any person, except a person authorized to issue an order or a referral pursuant to the Act, who administers an ultrasound upon a pregnant woman without an order or referral, shall be guilty of a Class A misdemeanor.

SECURITY BREACH NOTIFY ACT

Creates the Security Breach Notification Act. Requires any person or business conducting business in the State, and that owns or licenses computerized data that includes personal information, to disclose any breach of the security of the system following discovery or notification of the breach in the security of the data to any person whose unencrypted personal information was, or is reasonably believed to have been acquired by an unauthorized person. Requires any person or business that maintains computerized data that includes personal information that the person or business does not own, to notify the owner or licensee of the information of any breach of the security of the data immediately following discovery of such breach, if the personal information was, or is reasonably believed to have been acquired by an unauthorized person. Provides that notice may be provided to a customer in one of the following ways: (1) written notice; (2) electronic notice; or (3) substitute notice if the person or business demonstrates that the cost of providing notice would exceed $250,000, or the affected class of persons to be notified exceeds 500,000, or the person or business does not have sufficient contact information. Provides a private right of action for a violation of the Act.

USE & OCC TX-MOTOR FUEL RATE

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that the tax under the Acts with respect to motor fuel and gasohol is imposed at a rate that is the lesser of (i) $0.10 per gallon or (ii) 6.25% of the selling price. Amends the State Finance Act to provide for the distribution of the tax of $0.10 per gallon on motor fuel. Effective immediately.

DHS COMMUN WRKR WAGE DISPARITY

Requires the Commission on Government Forecasting and Accountability to issue a request for proposals for an independent contractor to conduct a study to determine whether there is a disparity between (i) the wages and benefits paid to the clinical, programmatic, and direct-care employees of community-based agencies or programs that are funded by the Department of Human Services to serve individuals with developmental disabilities or mental illness, or both, and (ii) the wages and benefits paid to comparable employees in State-operated facilities.

ST FINANCE-TRANSFERS-NOTICE

Amends the State Finance Act. Provides that at least 30 days before the Governor makes certain transfers, he or she must give advance written notice of the transfer to the Commission on Government Forecasting and Accountability, the State Comptroller, and the State Treasurer. Prohibits the State Comptroller and State Treasurer from making any such transfer until 30 days after that notice has been given. Effective immediately.
