Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that beginning on the effective date of the amendatory Act, there shall be a 2-year moratorium on the expansion of eligibility under the Children's Health Insurance Program and the Covering ALL KIDS Health Insurance Program. Provides that beginning on the effective date of the amendatory Act, there shall be a 2-year moratorium on the expansion of eligibility or the creation of new programs which would add new categories of eligible individuals under the Medicaid program. Further provides that eligibility under these programs may be expanded only if authorized by a 3/5 vote in both the House and Senate. Effective immediately.

Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to provide a written report to the General Assembly no later than January 1, 2011 detailing the implementation of the Primary Care Case Management Program, including a review of the timeline the program was implemented, the cost savings associated with the program, and any future implementation changes planned by the Department. Effective immediately.
Creates the Health Savings Account Act and amends the Illinois Income Tax Act. Provides that, beginning in taxable year 2010, a resident of Illinois or an employer may deposit contributions, subject to certain limitations, into a health savings account. Provides that the principal contributed to and the interest earned on a health savings account and money reimbursed to an eligible individual or an employee for qualified medical expenses is exempt from the Illinois income tax. Sets forth restriction on the use of funds held in a health savings account. Provides that an eligible individual may withdraw money from his or her health savings account for any purpose, but provides that certain withdrawals are not tax exempt. Repeals the Health Savings Account Act on January 1, 2021. Effective July 1, 2009.
Requests that the Commission on Government Forecasting and Accountability examine the provisions of the federal health care reform law to determine the fiscal impact of the provisions on the budget of the State of Illinois.
Amends the Public Utilities Act. Provides that an electric public utility shall follow the sensible growth vegetation standards as developed by the Illinois Commerce Commission to replant trees removed by utilities along State, county, and municipally owned recreational trails. Effective immediately.
Urges the United States Environmental Protection Agency to continue monitoring the BP refinery in Whiting, Indiana and its effects on neighboring states.
Amends the Emergency Medical Services (EMS) Systems Act. Provides that beginning on the effective date of this amendatory Act, implementation of any amendments, additions, subtractions, or changes to an EMS System's Program Plan shall be delayed for a period of 180 days to allow for a hearing and final approval by the Department of Public Health. Effective immediately.
Amends the Children's Mental Health Act of 2003. Provides that any screening services provided under the Children's Mental Health Plan must be voluntary and conducted with parental consent and in accordance with the Mental Health and Developmental Disabilities Code. Effective immediately.
Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that when a licensed health care worker, as defined in the Health Care Worker Self-Referral Act, (1) has been convicted of any forcible intentional felony or a sexual criminal act that requires registration under the Sex Offender Registration Act against a patient in the course of patient care or treatment; (2) has been convicted of any forcible intentional felony against any natural person; or (3) is required as a part of a criminal sentence to register under the Sex Offender Registration Act, then the Secretary, after consultation with Department's regulatory and prosecutorial staff, may immediately temporarily suspend the license of a health care worker, as defined in the Health Care Worker Self-Referral Act, without a hearing if the Secretary finds that evidence in his or her possession indicates that the health care worker's continuation in practice would constitute an immediate danger to the public. Provides that within 15 business days after receiving notice from the State's Attorney of the filing of criminal charges against the health care worker, the Secretary shall issue an administrative order that the health care worker may only practice with a chaperone during all patient encounters pending the outcome of the criminal proceedings. Provides that in instances in which the Secretary immediately suspends a license, a hearing on the health care worker's license must be convened by the appropriate licensing or disciplinary board within 15 days after the summary suspension and completed without appreciable delay. Adds provisions concerning the confidentiality of certain information and documents. Effective immediately.

Provides that eligibility or benefits under the Children's Health Insurance Program, the Covering ALL KIDS Health Insurance Program, or Medicaid may be expanded only as authorized by law and may not be expanded by any other means, including agency rules or policy changes. Effective immediately.
