HARASS&OBSCENE COMMUNICATIONS

Amends the Harassing and Obscene Communications Act. Increases from a Class 4 felony to a Class 3 felony any violation of the Act if, in the course of the offense, the offender threatened to kill the victim or any member of the victim's family or household.

INC TX-LONG TERM HEALTH CREDIT

Amends the Illinois Income Tax Act. Allows an income tax credit in an amount equal to 15% of the premium costs paid for a qualified long term care insurance contract covering the individual taxpayer or the taxpayer's spouse, parent, or dependent. Provides that the credit may not exceed $200 or the taxpayer's liability, whichever is less. Prohibits the carry forward of an excess tax credit to a succeeding year's tax liability. Exempts the credit from the sunset provisions. Effective January 1, 2012.

INC TX-ESTIMATED TAXES

Amends the Illinois Income Tax Act. In a Section concerning estimated taxes, provides that, if a taxpayer is entitled to a refund after the payment of the fourth installment, then he or she may apply the amount of the refund to the first installment due in the next taxable year.

DHS-AUTISM ADULT DAY PROGRAMS

Amends the Disabled Persons Rehabilitation Act. Provides that subject to appropriations, the Department shall create a pilot program for adult day services for persons on the autism spectrum over the age of 22. Provides that the Department shall make grants to organizations that develop a replicable model for quality day services for adults with autism living in Illinois. Effective immediately.

HOME COMM-BASED SRVICES-ID/DD

Resolves that Illinois shall take action in a caring, comprehensive manner to transition State-operated facilities for persons with intellectual and developmental disabilities and ensure care in the least restrictive environment.

GRP INS-HEALTH SAVINGS ACCOUNT

Amends the State Employees Group Insurance Act of 1971. Requires the program of health benefits offered to State employees to include, by July 1, 2012, an optional health savings account program paired with a qualifying State-sponsored, high-deductible health plan. Requires the Director of Central Management Services, on or before December 31, 2011, to submit potential program designs to the Commission on Government Forecasting and Accountability for review. Specifies requirements for the proposed designs. Prohibits, except in limited circumstances, the non-contributory portion of the program from covering abortion-related expenses. Effective immediately.

MOTOR FUEL SALE-DISABLD ASSIST

Amends the Motor Fuel Sales Act. Provides that gasoline stations and service stations must provide a minimum of 2 calling devices, one on each side of a fueling site that allow the disabled operator of a motor vehicle to request refueling assistance; sets forth minimum specifications for such a calling device. Provides that gasoline stations and service stations also must let patrons know, through signs that designate hours of service, the times that customers with disabilities can obtain refueling assistance by using the calling device (instead of by either honking or otherwise signaling an employee).

LIENS-PUBLICATION NOTICE-VEH

Amends the Labor and Storage Lien (Small Amount) Act, the Sale of Unclaimed Property Act, and the Self-Service Storage Facility Act. Provides that notwithstanding any other provision of law, if a lien is held on a vehicle under one of the amended Acts and the name of the vehicle owner or other responsible party is unknown after reasonable inquiry or if a certified mailing mailed is returned as undeliverable, the lienholder seeking to enforce the lien may hold the sale without complying with notice by publication requirements if the lienholder provides the Secretary of State with a signed statement that: (i) the lienholder has inspected the vehicle and in the lienholder's opinion, the vehicle is a junk vehicle; and (ii) if the lienholder purchases the vehicle at the public sale, the lienholder will apply for a junking certificate for the vehicle. Provides that a person seeking a junking certificate under the new provisions must demonstrate to the satisfaction of the Secretary of State that he or she is otherwise eligible for a junking certificate.

HEALTHCARE - SEX CRIMES

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that when the Secretary of Financial and Professional Regulation receives notification from an Illinois State's Attorney of the filing of criminal charges alleging that a health care worker, as defined in the Health Care Worker Self-Referral Act, committed any offense that (1) involves bodily harm against a patient, including any offense based on sexual conduct or sexual penetration or (2) requires as a part of its criminal sentence to register under the Sex Offender Registration Act, the Secretary shall suspend the license of the health care worker without a hearing for 45 days, simultaneously with the institution of proceedings for a hearing. Adds provisions concerning disciplinary hearings and confidentiality. Provides that the Department shall immediately permanently revoke the license or permit of any health care worker who has been convicted of such a crime and that the Department shall not reinstate or issue a license or permit as a health care worker to any such convicted person unless that person's conviction has been vacated, overturned, or reversed. Provides that these new provisions apply notwithstanding any other provision of law to the contrary. Amends the Counties Code. Adds to the duties of State's Attorney the duty to: (1) notify the Department of the filing of criminal charges alleging that a health care worker committed any offense that (i) involves bodily harm against a patient, including any offense based on sexual conduct or sexual penetration or (ii) requires as a part of its criminal sentence to register under the Sex Offender Registration Act and (2) notify the Department upon the conviction of any health care worker of such a crime. Effective immediately.

AUTISM TRAINING-EMERGENCY SRVC

Amends the Illinois Fire Protection Training Act. Provides that the Office of the State Fire Marshal shall develop, adopt, or approve a training course regarding the risks associated with autism and appropriate autism recognition and response techniques. Provides that every person who is seeking certification in a position of firefighter 1 or 2, whose duties involve fire suppression, firefighting, or fire rescue, must satisfactorily complete an education course in autism recognition and response techniques. Amends the Emergency Medical Services (EMS) Systems Act. Provides that the Department of Public Health shall develop, adopt, or approve a training course and curriculum with the purpose of informing emergency medical technicians of the risks associated with autism and providing instruction in appropriate autism recognition and response techniques. Provides that before being certified by the Department, each emergency medical technician trained in basic life support services must satisfactorily complete the training course. Provides that every person who is serving in a capacity as a certified emergency medical technician must satisfactorily complete a continuing education course in autism recognition and response techniques within 18 months. Effective immediately.
