UTIL-ISP-CHILD PORN FILTER

Creates the Internet Service Provider Anti-Pornography Law as a new Article in the Public Utilities Act. Provides that the Illinois Commerce Commission shall require that all internet service providers that provide service to customers in the State shall comply with the Law concerning the prevention of transmission of child pornography. Provides that the Commission shall select a nationwide law enforcement agency to serve as a clearinghouse and compile a continuously updated list of files known to contain child pornography. Provides that the selected law enforcement agency shall inspect the files and makes a judgment that the files are illegal in their jurisdiction before adding them to the registry according to their hash value. Provides that the Commission shall require that internet service providers create and implement software that complies with specified provisions. Provides that an internet service provider that makes a good-faith effort to comply with the Law shall be immune from liability. Provides that the Commission may adopt any rules necessary for administration of the Law.

DHFS-MEDICAID ACCOUNTABILITY

Amends the Medical Assistance Article of the Illinois Public Aid Code. In regard to the internet-based Medicaid accountability program, provides that the Department of Healthcare and Family Services (rather than the Director of the Department of Healthcare and Family Services) shall implement (rather than shall be authorized to implement) the program. Substitutes all references to "Director" with "Department". Effective immediately.

INC TX-CREDIT FOR NEW HIRES

Amends the Illinois Income Tax Act. Creates a credit for each business that is newly established in the State or that relocates to the State during the taxable year or the previous taxable year. The taxpayer is entitled to a credit against the tax imposed by subsections (a) and (b) of Section 201 in an amount equal to 10% of the wages paid by the business during the taxable year to full-time employees who are residents of Illinois. Creates a credit for other businesses that increase their total full-time employment head count during the taxable year by at least 10 employees in an amount equal to 10% of the wages paid by the business during the taxable year to each resident of Illinois that is first hired by the business during the taxable year.

MEDICAID-PHOTO ID CARD

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that the permanent or semi-permanent member cards issued to individuals enrolled in the medical assistance program shall include safeguards to limit the unauthorized use of the medical card by an individual other than the member to whom the card has been issued; and that these safeguards shall include, but not be limited to, the member's photograph on the face of the card.

MEDICAID-ALLKIDS-MORATORIUM

Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Medical Assistance Article of the Illinois Public Aid Code. Removes language providing that there shall be a 2-year moratorium on eligibility expansions under the Children's Health Insurance Program, the Covering ALL KIDS Health Insurance program, and the State's medical assistance program and instead provides that the moratorium shall be in effect for either (i) a period of 2 years after January 25, 2011 (the effective date of Public Act 96-1501), or (ii) until the State expands eligibility for legal residents with incomes up to 133% of the federal poverty level as mandated by the provisions of the federal Patient Protection and Affordable Care Act of 2010, whichever is longer. Effective immediately.

DCFS-ABUSE RPTS-APPEALS

Amends the Abused and Neglected Child Reporting Act. Permits a reporting source, whether mandated or not, to appeal a finding by the Child Protective Service Unit that his or her report of abuse or neglect is unfounded. Provides that the Department of Children and Family Services shall establish by rule the appeal process and that if upon appeal a determination is made that there is no credible evidence of abuse or neglect, the reporting source, whether mandated or not, may petition the Attorney General or the appropriate State's Attorney to review his or her report.

PUB AID-HOSPITAL ASSESSMENTS

Amends the Hospital Provider Funding Article of the Illinois Public Aid Code. Extends the imposition of annual assessments on hospital inpatient services through State fiscal year 2016 (rather than State fiscal year 2013). Effective immediately.

VEHICLE LIENS-ENFORCEMENT

Amends the Illinois Vehicle Code. Provides that if an application for a certificate of title for a vehicle refers to a vehicle sold at public auction under the Labor and Storage Lien Act, the Labor and Storage Lien (Small Amount) Act, and the Sale of Unclaimed Property Act and the Secretary of State refuses to issue a certificate of title, the Secretary of State shall provide the applicant with a written explanation for the refusal and any proof supporting the explanation. Provides that if an application for a certificate of title for a vehicle refers to a vehicle sold at public auction under the Labor and Storage Lien Act, the Labor and Storage Lien (Small Amount) Act, or the Sale of Unclaimed Property Act, the Secretary of State shall, within 30 days after receiving the application, either issue the certificate of title or notify the applicant of the refusal to issue a certificate of title. Provides that each edition of the "Rules of the Road" published by the Secretary of State shall contain a statement explaining that a vehicle owner does not have the right to leave the vehicle on the property of another person and that a vehicle left on the property of another person for more than 15 days shall be subject to a lien under the Sale of Unclaimed Property Act that may be enforced by the owner or lessor of the property. Amends the Labor and Storage Lien Act, the Labor and Storage Lien (Small Amount) Act, or the Sale of Unclaimed Property Act. Provides that a lien on a motor vehicle may be enforced on or after the 16th day after the completion of the expenditure of labor, services, skill, or material or furnishing of storage on or after the 16th day after the date agreed upon for redemption.

IDPH-PRESCRIPT DRUG REPOSITORY

Creates the Prescription Drug Repository Program Act. Requires the Department of Public Health to establish a prescription drug repository program, under which a healthcare facility may donate a prescription drug or supplies needed to administer a prescription drug for use by an individual who meets eligibility criteria specified by the Department. Sets forth requirements that prescription drugs or supplies must meet in order to be accepted and dispensed under the program. Provides that no drugs or supplies donated under the prescription drug repository program may be resold. Provides that nothing in the Act requires that a pharmacy or pharmacist participate in the prescription drug repository program. Provides for civil and criminal immunity for drug and supply manufacturers and pharmacists in relation to the donation, acceptance, or dispensing of prescription drugs or supplies under the prescription drug repository program. Amends the Pharmacy Practice Act, the Wholesale Drug Distribution Licensing Act, the Senior Pharmaceutical Assistance Act, the Illinois Food, Drug and Cosmetic Act, the Illinois Controlled Substances Act, and the Cannabis and Controlled Substances Tort Claims Act to provide that persons engaged in donating or accepting, or packaging, repackaging, or labeling, prescription drugs to the extent permitted or required under the Prescription Drug Repository Program Act are exempt from provisions of those other Acts that might prohibit or otherwise regulate such activity.
