FITNESS CENTER BKGRND CHECKS

Creates the Physical Fitness Center Employee Background Check Act. Provides that a physical fitness center employer who makes a conditional offer of employment to an applicant for a position as an employee shall initiate a fingerprint-based criminal history record check on the applicant, if a background check has not been previously conducted. Provides that the Department of State Police shall notify the physical fitness center of any convictions associated with the fingerprints submitted. Provides that the applicant or employee may be required to pay all related application and fingerprinting fees. Provides that the physical fitness center employer shall retain on file, for a period of 5 years, records of criminal records requests for all employees. Provides other requirements for fingerprint-based criminal history records checks and employer's files. Provides that if an employee is suspended from employment based on the results of a criminal background check conducted under this Act, and the results prompting the suspension are subsequently found to be inaccurate, the employee is entitled to recover backpay from his or her physical fitness center employer for the suspension period, provided that the employer is responsible for the inaccuracy. Authorizes the Department of Public Health to exercise the powers and duties prescribed by the Civil Administrative Code of Illinois for administration of licensing acts and shall exercise other powers and duties necessary for effectuating the purpose of the Act. Provides that any person who is found to have violated any provision of the Act is guilty of a petty offense for the first offense and a Class A misdemeanor for the second and any subsequent offense.

PEN CD-FIRE CHIEF TO IMRF

Amends the Downstate Firefighter and Illinois Municipal Retirement Fund (IMRF) Articles of the Illinois Pension Code. Allows the chief of certain municipal fire departments to elect to participate in IMRF rather than in the municipality's firefighter pension fund. Makes related changes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

SCH CD-REFORM-PARENT PETITION

Amends the School Code. Provides that the parents of at least 51% of students in a low-performing school may initiate reform measures at the school through the submission of a parent petition to the school board. Provides for submission of a notice of petition. Provides that the petition shall request that the school board fully intervene in the school and implement one of the following reform measures: (1) reopen the school as a charter school; (2) change the school leadership; (3) close the school and reassign students currently attending the school to another school at the appropriate grade level within the same school district; or (4) adopt a new school governance structure. Upon receiving a copy of a petition signed by the parents of at least 51% of the students in a low-performing school, requires the school board to implement the reform measures requested in the petition.

REGULATION REMOVAL PANEL

Creates the Regulation Removal Panel Act. Creates the Regulation Removal Panel and sets forth appointments. Requires the Panel to create a system to receive public comment regarding various State laws, rules, and other governing instruments to be considered by the Panel for possible repeal. Requires the Panel to meet once a month to review public comment regarding State laws, rules, and other governing instruments to be repealed. Provides that the Panel shall have the ability to keep or remove the State law, rule, or other governing instrument in question by an affirmative vote of all 5 members. Provides that the Panel shall report its proceedings and any changes to State laws, rules, or other governing instruments annually to the President of the Senate, the Senate Minority Leader, the Speaker of the House of Representatives, the House Minority Leader, and the Governor on or before January 1, 2015 and every January 1 thereafter. Amends the Legislative Commission Reorganization Act of 1984 and the Legislative Reference Bureau Act. Requires the staff of the Legislative Reference Bureau and the Legislative Research Unit to cooperate to provide administrative support to the Panel. Authorizes the Board to adopt any rules that are necessary to implement the requirements of the Act.

SCH CD-TRANSPORTATION-DISTANCE

Amends the Transportation Article of the School Code. Provides that a school board shall provide free transportation for pupils residing at a distance of 2 miles (instead of one and one-half miles) or more from school. Makes related changes in provisions concerning non-high school districts, the transportation of pupils less than that distance from school, pupils attending a charter school or nonpublic school, reimbursement by the State for transportation, and reimbursement of a custodian of a qualifying pupil for transportation expenses paid by the custodian. Effective July 1, 2013.

PEN CD--ACTUARY--EVERY 3 YEARS

Amends the Illinois Pension Code. Requires the actuary of each of the 5 State-funded systems to conduct an investigation of the system at least once every 3 (rather than 5) years. Effective immediately.

HEALTH SAVINGS-CONTRIBUTIONS

Amends the State Employee Health Savings Account Law. In the definition of "health savings account program", removes a provision that prohibited the total annual contribution to such a program from exceeding an amount set by the Internal Revenue Service. Changes the amount an employer who makes a health savings account program available to its eligible employees must annually deposit in that account for those employees. Requires the health savings account program to be based on the creation of coverage options so that the average per person employer cost of the programs, including the contributions for the health savings accounts and high-deductible plan, does not exceed the average per person employer cost of the self-insured State employee health benefits program provided under the State Employees Group Insurance Act of 1971 for the same fiscal year. Effective immediately.

PEN CD-GARS-END PARTICIPATION

Amends the General Assembly Article of the Illinois Pension Code. Restricts participation in the General Assembly Retirement System to persons who are receiving annuities from the System on January 1, 2015. Terminates participation by all other persons. Provides that annuities in payment status on January 1, 2015 shall continue to be paid by the System, along with any increases provided by law. Provides that no new or additional benefits may be granted or paid by the System on or after January 1, 2015, including any refund of contributions. Provides that no new transfers of credits into or out of the System shall be made on or after that date. Provides that these provisions control over any other law. Effective January 1, 2015.

PEN CD-FELONY SUSPENSION

Amends the Illinois Pension Code. Provides that if a member or participant of a pension fund or retirement system established under the Code is convicted of, or pleads guilty to, intimidation by a public official, bribery, official misconduct, engaging in kickbacks, fraudulently obtaining public moneys reserved for a disadvantaged business enterprise, or certain theft offenses, then none of the benefits that are provided for under the Code and that are attributable to the service of that person shall be paid. Provides that if a member or participant of a pension fund or retirement system established under the Code is receiving an annuity or pension from a pension fund or retirement system established under the Code and is convicted of, or pleads guilty to, a felony (other than intimidation by a public official, bribery, official misconduct, engaging in kickbacks, fraudulently obtaining public moneys reserved for a disadvantaged business enterprise, certain theft offenses, or any other felony requiring the forfeiture of that annuity or pension under the Code), then the board of trustees of that fund or system shall suspend the payment of that annuity or pension during that individual's incarceration for that offense. Provides that, upon completion of the term of incarceration for that offense, the member or participant may seek reinstatement of his or her annuity or pension by filing a request for reinstatement of benefits with the applicable pension fund or retirement system in the manner prescribed by the applicable fund or system.
