RELATING TO STATE ENTERPRISE ZONES.

Amends the definition of "eligible business activity" for the purposes of the Enterprise Zone Program to include certain retail sales of tangible personal property; processing of certain value-added agricultural products; research development, sale, or production of all types of medical products and medical and health care services; activities of the Hawaii Food and Product Innovation Network; the provision of certain professional services by health care professionals; aerospace research and development activities; and information technology design and production services. Authorizes the Department of Business, Economic Development, and Tourism to declare up to two census tracts on state land that contain an innovation enterprise to be designated as an enterprise zone, subject to the Governor's approval and notwithstanding certain conditions. Requires DBEDT to conduct a comprehensive review, in consultation with the Department of Taxation, of the State Enterprise Zones Program and to submit a report to the Legislature. For taxable years beginning after 12/31/2026, extends the eligibility period of the state business tax credit for qualified businesses within state enterprise zones. Beginning 1/1/2028, extends the eligibility period of the general excise tax exemption for qualified businesses within state enterprise zones. Applies to qualified businesses who join the Enterprise Zone Program on or after 7/1/2026. (CD1)

RELATING TO DEVELOPMENT.

PART I: Redesignates the Stadium Development District as the Halawa Community Development District (HCDD). Amends the composition of the Hawaii Community Development Authority (HCDA) for purposes of the HCDD. Amends the duties and powers of the HCDA and Stadium Authority as they relate to activities within the HCDD. Clarifies the HCDA's permitting and consultation powers regarding public projects within community development districts. Establishes the HCDD Special Fund. Establishes requirements for the Comptroller to verify that invoices for the capital costs of the HCDD comply with applicable law and the purposes for which public funds were appropriated, allocated, transferred, deposited, or otherwise made available. PART II: Appropriates funds for the establishment of positions. Appropriates funds from the Stadium Development Special Fund for the purposes of the special fund. Conditions the expenditure of the appropriated funds out of the special fund upon compliance with state planning, land use, and financing statutes. PART III: Requires the HCDA, when planning and developing housing, to endeavor to plan for complete communities that include various aspects supporting quality of life. (CD1)

RELATING TO AQUACULTURE.

Authorizes the Division of Animal Industry of the Department of Agriculture and Biosecurity to adopt, amend, and repeal rules to develop an evaluation and authorization process to import and transport aquatic livestock in the State. Requires the Aquaculture Program to develop a biological aquatic risk-based framework and biocontainment standards for the aquatic livestock evaluation and authorization process. (CD1)

RELATING TO THE AGRIBUSINESS DEVELOPMENT CORPORATION.

Authorizes the Agribusiness Development Corporation to acquire by condemnation any real property or interest in real property, except real property owned in a county with a population of more than 125,000 but less than 195,000 and public lands, under certain conditions. (CD2)

RELATING TO AGRICULTURE.

Requires the Department of Agriculture and Biosecurity to convene a Bona Fide Farmer Working Group to develop multi-tiered, matrix-based definitions for the terms "bona fide farmer" and "bona fide agricultural activity". Requires a report to the Legislature. (CD1)

RELATING TO THE UNIVERSITY OF HAWAII.

Appropriates funds to establish a bachelor's degree program in agricultural science at the University of Hawaii-West Oahu; to fund one full-time equivalent (1.0 FTE) position; and for supplies and equipment to support the programs. (CD1)

RELATING TO JURISDICTION.

Amends the factors a family court is required to consider in deciding whether the family court may waive jurisdiction over a minor or adult held for criminal proceedings for acts committed during the person's minority. Preserves the family court's jurisdiction over a minor transferred for criminal proceedings for subsequent acts that would otherwise be within the family court's jurisdiction. Requires the family court to retain jurisdiction over a minor if the court finds by clear and convincing evidence that the minor was trafficked, sexually abused, or raped by the alleged victim in the case before or during the commission of the alleged offense. RELATING TO STATE FACILITIES.

Exempts concessions within the Stadium Facility that are under the jurisdiction of the Stadium Authority from chapter 102, HRS, governing concession on public property. Allows the naming rights of the Stadium Facility to be leased to any public or private entity. Requires any revenues derived from advertising or marketing in or on the Stadium Facility to be deposited into the Stadium Development Special Fund. (CD1)

RELATING TO PUBLIC SCHOOL LAND TRANSFER.

Revises tax map key numbers and the conveyance process by which identified properties are conveyed to the Department of Education pursuant to Act 307, SLH 2022. Directs the conveyance to the County of Kauai of certain lands held by the Department of Education. Directs the conveyance of land on which Kaimuki Middle School is located from the City and County of Honolulu to the Department of Education. Clarifies that land dispositions of school buildings, facilities, and grounds made by the DOE shall not require approval from the Board of Land and Natural Resources when these dispositions are for periods exceeding one year. RELATING TO RESIDENTIAL CONDOMINIUMS.

Clarifies the Ninety-Nine Year Leasehold Program by: (1) allowing the Hawaii Community Development Authority to prohibit renting, advertising for rent, or using for any other purpose other than owner-occupied residential use a residential condominium unit, by rule, rather than statutorily; (2) exempting the design, development, and construction contracts from procurement requirements, subject to prevailing wage requirements for laborers and mechanics; (3) requiring HCDA to adopt rules to implement an initial sales period during which residential condominium units are offered only to eligible buyers for owner-occupied residential use; (4) authorizing the sale of a residential condominium unit that is not subject to an income restriction and was not sold within a certain period to be sold to other buyers, as determined by rule by HCDA, without an owner-occupancy requirement; (5) requiring HCDA to adopt rules that require at least sixty per cent of residential condominium units to be income restricted; and (6) requiring HCDA to establish rules to require buyback pricing similar to other state agencies' existing pricing formulas.
