MODERATE
The bill was revised to shift focus from stadium concessions to naming rights and broader advertising regulations. It now explicitly exempts stadium concessions from certain state laws while granting the stadium authority the power to lease naming rights. Additionally, the bill significantly expanded the list of permitted outdoor advertising devices and moved the effective date from the year 3000 to 2050.
Scope change
The bill's scope expanded from narrowly targeting stadium concessions to comprehensively regulating naming rights and outdoor advertising, including specific provisions for university and city-owned stadiums.
SCOPE

The exemption from Chapter 102 was changed to apply to all concessions within the stadium facility, removing the previous condition that they must be under the jurisdiction of the stadium authority.

ELIGIBILITY

New language allows the stadium authority to lease naming rights for the stadium facility or any portion of it to public or private entities.

New provisions allow specific advertising on scoreboards and stadium exteriors for the University of Hawaii and the stadium authority, including the name of the entity that leased naming rights.

REQUIREMENT

Revenues from advertising or marketing are now required to be deposited into the stadium development special fund if derived from subsection (b), which covers naming rights.

A new section was added to HRS 445-112 listing 19 specific exceptions where outdoor advertising devices, billboards, and signs are permitted.

TIMELINE

The effective date of the Act was changed from July 1, 3000, to July 1, 2050.

TECHNICAL

The bill title and description were updated to reflect the new focus on naming rights and advertising rather than just concessions.
