California Private Postsecondary Education Act of 2009: exemptions: commercial driving licenses.

The California Private Postsecondary Education Act of 2009 provides, among other things, for student protections and regulatory oversight of private postsecondary institutions in the state. The act is enforced by the Bureau for Private Postsecondary Education within the Department of Consumer Affairs. The act exempts certain institutions from its provisions, including an institution that does not award degrees and that solely provides educational programs for total charges of $2,500 or less, as provided. This bill would provide that the above-described exemption from the California Private Postsecondary Education Act of 2009 for institutions that do not award degrees and that solely provide educational programs for total charges of $2,500 or less does not apply to institutions that provide any training or curriculum for Class A, B, or C commercial driving licenses, except as specified.

California State University: joint degrees.

Existing law sets forth the missions and functions of California's public and independent segments of higher education, and details the ways in which their respective institutions are to be differentiated. Existing law specifies that the California State University (CSU) shall offer undergraduate and graduate instruction through the master's degree in the liberal arts and sciences and professional education. Existing law authorizes the CSU to award undergraduate and graduate degrees jointly with international institutions of higher education. Existing law vests the University of California (UC) with the sole authority in public higher education to award doctoral degrees in all fields of learning, except that the CSU may award doctoral degrees jointly (1) with the UC in selected fields, (2) with independent institutions of higher education if the proposed doctoral program is approved by the California Postsecondary Education Commission, and (3) with international institutions of higher education if, among other things, the doctoral degrees are for professional or applied doctoral degrees that do not duplicate UC doctoral degrees, and the CSU complies with a specified review and approval process, as provided. This bill would authorize the CSU to award doctoral degrees jointly with one or more independent institutions of higher education without approval by the California Postsecondary Education Commission. The bill would also authorize the CSU to award undergraduate and graduate degrees jointly with one or more independent institutions of higher education. The bill would authorize the CSU to jointly award doctoral degrees with accredited international institutions of higher education without (1) limiting it to professional or applied doctoral degrees that do not duplicate UC doctoral degrees, and (2) complying with the specified review and approval process.

International trade and investment: Global Partnership Advisory Body.

Existing law requires the Governor's Office of Business and Economic Development (GO-Biz) to develop and implement an International Trade and Investment Program, which among other things, attracts employment-producing direct foreign investment, and states related findings and declarations of the Legislature. Existing law requires the Director of the Governor's Office of Business and Economic Development to provide to the Legislature, and update every 5 years, a strategy for international trade and investment, as specified. This bill would recast these provisions to, among other things, expand the required program activities. The bill would also require the office to convene the Global Partnership Advisory Body, a statewide business partnership for international trade and investment, that would advise the director, as specified. The bill would require the director to provide to the Legislature a 5-year strategy for the implementation of the international trade and investment program, developed in consultation with the advisory body, which would give input on goals, performance metrics, and implementation tactics. The bill would require the strategy to be reviewed in at least one public hearing, as specified, and would make other conforming changes. Existing law authorizes GO-Biz to establish an international trade and investment office outside the United States if specified conditions are met. This bill would also authorize GO-Biz to establish regional trade assistance hubs within California to facilitate international trade and investment if specified conditions are met through a specified competitive designation process, and would make other conforming changes. Existing law establishes the Economic Development and Trade Promotion Account in the Special Deposit Fund within the State Treasury. Existing law authorizes the director to expend funds in the account, and any other state, federal, or private funds for international trade and investment offices or international trade shows or activities related to promoting international trade and investment events by entering into contracts to support international market development activities, including, but not limited to, trade shows, trade missions, promotional events, and seminars, as well as staffing support for those activities, in an amount not exceeding $200,000, except as specified. Existing law authorizes GO-Biz to accept moneys, including, but not limited to, state, federal, and private sector funds, for the purposes of operating any international trade and investment office or international trade show or activity related to promoting international trade and investment events. This bill would increase the amount that the director can expend from the account as described above to $500,000 and would expand the purposes for which the funds can be spent, thereby making an appropriation. The bill would make other conforming changes relating to funds donated by a private donor for an international trade and investment office.

Community colleges: external resolution services for civil rights compliance: managing entity and civil rights coordinator.

Existing law establishes the California Community Colleges, administered by the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in the state. Existing law establishes community college districts throughout the state under the administration of community college district governing boards. Existing law prohibits a person from being subjected to discrimination on the basis of specified attributes, including, among others, disability, gender, nationality, race or ethnicity, or immigration status, in a program or activity conducted by a postsecondary educational institution that receives, or benefits from, state financial assistance or enrolls students who receive state student financial aid, including, among others, community colleges. This bill would require the board of governors, within one year of appropriation, to enter into a contract with a managing entity, as defined, to administer on behalf of the California Community Colleges external resolution services for civil rights compliance, including, among other services, developing and recommending a nondiscrimination policy, assisting the office of the Chancellor of the California Community Colleges in developing an annual campus discrimination prevention training program for students and employees, and addressing grievances and complaints alleging discrimination, as specified. The bill would also require the board of governors to approve the nondiscrimination policy recommended by the managing entity and require the governing boards of community college districts to adopt the policy, as provided. The bill would further require community college districts, within one year of appropriation, to designate a staff person as a civil rights coordinator tasked with specified duties, including, among others, responding to complaints alleging discrimination and maintaining a record system of files on those complaints, as specified. By imposing new duties on community college districts, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above. This bill, for the 2026–27 fiscal year, would appropriate $100,000,000 from the General Fund to the California Community Colleges to fund external resolution services for civil rights compliance provided by the managing entity, as provided.

Personal Income Tax Law: young child tax credit.

The Personal Income Tax Law allows various credits against the taxes imposed by that law, including a young child tax credit to a qualified taxpayer in a specified amount multiplied by the earned income tax credit adjustment factor, as provided. That law also allows a payment from the continuously appropriated Tax Relief and Refund Account for an amount in excess of tax liability. Existing law defines "qualified taxpayer" for this purpose to include an eligible individual, as defined, who has a qualifying child, defined to be a child younger than 6 years of age as of the last day of the taxable year, and who meets other specified criteria. This bill, for taxable years beginning on or after January 1, 2026, and before January 1, 2038, would instead define a "qualifying child" to mean a child younger than the age limit from the prior taxable year plus one year, as described. The bill, for taxable years beginning on or after January 1, 2038, would define "qualifying child" as being a child younger than 18 years of age, as described. By increasing the payments from the Tax Relief and Refund Account, a continuously appropriated fund, the bill would make an appropriation. Existing law requires any bill authorizing a new tax expenditure to contain, among other things, specific goals that the tax expenditure will achieve, detailed performance indicators, and data collection requirements. This bill would include additional information required for any bill authorizing a new tax expenditure.
