Existing law makes legislative findings and declarations that set forth the principles for public postsecondary institutions and budgetary control agencies to observe in providing postsecondary programs and services for students with disabilities, including the principle that state-funded activity is directly related to the functional limitations of the verifiable disabilities of the students to be served. Existing law states the intent of the Legislature that, as appropriate for each postsecondary segment, funds for disabled student programs and services be based on 3 categories of costs, including a continuing variable costs category for services that vary in frequency depending on the needs of students, such as, among other services, diagnostic assessment, including both individual and group assessment not otherwise provided by the institution to determine functional, educational, or employment levels or to certify specific disabilities. Existing law requires the Board of Governors of the California Community Colleges to adopt rules and regulations for the administration and funding of educational programs and support services to be provided to disabled students by community college districts. Existing law requires those regulations to provide for the apportionment of funds to each community college district to offset the direct excess cost of providing specialized support services or instruction, or both, to disabled students enrolled in state-supported disabled student services programs or courses. Existing law describes those direct excess costs as those actual fixed, variable, and one-time costs, including those described above, that exceed the combined total of specified costs, revenues, and funds. Existing law establishes the Student Aid Commission as the primary state agency for the administration of state-authorized student financial aid programs available to students attending all segments of postsecondary education. This bill would revise the intent of the Legislature relating to diagnostic assessments by including costs for continuing assessments, required documentation, and individual and group assessments provided by the institution or by an outside entity, as provided. The bill would also expand the purpose of the assessments to include defining specific disabilities of the student and as proof for academic or institutional accommodations. This bill, commencing July 1, 2027, and upon appropriation by the Legislature in the annual Budget Act, would require the Trustees of the California State University, and would request the Regents of the University of California, to cover the costs of diagnostic assessments for learning disabilities as proof for academic accommodations for any student who receives student financial aid or who is eligible for financial assistance from the institution's health or disability center, unless those diagnostic assessments are covered by the student's health insurance plan, as provided. The bill would require state funds to be provided annually for the cost of these services on an actual-cost basis and would require each institution to be responsible for documenting its costs to the Student Aid Commission. The bill would require the commission to oversee reimbursements to institutions for their documented costs. The bill would require each educational institution to post on its internet website that the educational institution will cover the costs of the diagnostic assessments for such students.

Existing law establishes the California Work Opportunity and Responsibility to Kids (CalWORKs) program, under which each county provides cash assistance and other benefits to qualified low-income families and individuals using federal, state, and county funds. Existing law establishes the CalWORKs Recipients Education Program (program) in the California Community Colleges under which community college districts are required to provide educational services and special services to recipients of aid under CalWORKs who are attending a community college, to the extent funding is provided in the annual Budget Act. Existing law authorizes those special services to include workstudy. Existing law prohibits program payments to an employer for workstudy from exceeding 75% of the wage for the workstudy positions and requires an employer to pay at least 25% of the wage for the workstudy positions. Existing law requires subsidized campus childcare to be provided to students participating in the program only if they are engaged in certain activities, through the completion of their initial education and training plan and for up to 3 months after completion or until the end of the academic year, whichever period of time is greater. This bill would expand who can participate in the program to include students who have exceeded the 60-month limit on CalWORKs cash aid and have one or more dependents who are recipients of aid under CalWORKs. The bill would add direct aid designed to meet ongoing basic needs and services, as described, as a special service for which program funds may be used. The bill would authorize programs to waive the requirement that an employer pay at least 25% of the wage for workstudy positions if the number of workstudy positions will not decrease. The bill would delete the limit on the provision of subsidized campus childcare for program participants. By expanding program eligibility and services, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

Existing law establishes the University of California, under the administration of the Regents of the University of California, and the California State University, under the administration of the Trustees of the California State University, as 2 of the segments of public postsecondary education in this state. Existing law requires, on and after January 1, 2023, each student health center on a California State University or University of California campus to offer abortion by medication techniques, as specified. This bill would require a California State University campus, and would request a University of California campus, to provide adoption information to students in each location on campus where contraception and emergency contraception information is available, including when birth control and levonorgestrel are provided to students through the campus's student health center or pharmacy, as specified.

Existing law establishes the California Community Colleges under the administration of the Board of Governors of the California Community Colleges. Existing law establishes community college districts throughout the state, and authorizes these districts to provide instruction at the community college campuses they operate and maintain. Existing law provides for a formula for the calculation of general purpose apportionments of state funds to community colleges. Existing law provides a separate formula for the allocation of apportionments of state funds to community colleges, which uses the numbers of full-time equivalent students as its basis, for use for apportionments for noncredit instruction and instruction in career development and college preparation. Existing law specific the noncredit courses, noncredit classes, and support services that are eligible for state apportionment. This bill would require the board of governors to allocate base funding for designated categorical programs to noncredit colleges, as defined, and noncredit centers, as defined, that meet specified conditions. The bill would specify that the categorical programs eligible for those base funding allocations include, but are not limited to, disabled student programs and services, mental health services, and veteran resource centers. The bill would require the board of governors, in consultation with the office of the Chancellor of the California Community Colleges, to determine the methodology for allocating the base funding.

Existing law gives public school employees the right to form, join, and participate in the activities of employee organizations of their own choosing for the purpose of representation on all matters of employer-employee relations. Existing law establishes the Public Employment Relations Board and gives the board specified powers and duties relating to employer-employee relations. Existing law authorizes the board to conduct studies relating to employer-employee relations, including the collection, analysis, and making available of data relating to wages, benefits, and employment practices in public and private employment, and to recommend legislation. This bill would specifically authorize the board to conduct employer-employee relations studies concerning the impact on public employees of net-zero carbon emissions initiatives, including collecting, analyzing, and making available related data.

Existing law establishes an Aging and Disability Resource Connection (ADRC) program, administered by the California Department of Aging, to provide information to consumers and their families on available long-term services and supports (LTSS) programs and to assist older adults, caregivers, and persons with disabilities in accessing LTSS programs at the local level. Existing law requires ADRC programs to provide specified services, including, among other things, enhanced information and referral services and other assistance at hours that are convenient for the public. This bill would further require ADRC programs to provide disaster and emergency preparedness community education specifically designed with the goals of informing older adults and people with disabilities about emergency preparedness and promoting their safety before, during, and after natural disasters and other emergency events, as specified.

Existing law requires each school district, county superintendent of schools, and charter school to make available a nutritionally adequate breakfast, as defined, and a nutritionally adequate lunch, as defined, free of charge during each schoolday to any pupil who requests a meal, without consideration of the pupil's eligibility for a federally funded free or reduced-price meal, as provided. Existing law defines "schoolday" for these purposes to mean any day that pupils in kindergarten or grades 1 to 12, inclusive, are present at a schoolsite for purposes of instruction or educational activities, including, among other things, pupil attendance at summer school, including incoming kindergarten pupils, as provided. This bill would, contingent upon an appropriation for its purposes and to the extent authorized by federal law, require the State Department of Education to establish a process for state reimbursement, adjusted annually for inflation, for federal summer meal program operators, as defined, for meals served to guardians of eligible pupils receiving a meal pursuant to a summer meal program, as provided. The bill would require the department to develop related guidance, as specified, and, if necessary, to apply for a waiver of federal law to secure federal reimbursement for these meals. The bill would require the department to distribute information about the federal Summer Electronic Benefits Transfer for Children Program to guardians whose children are eligible for specified summer food programs. The bill would require a guardian of an eligible pupil to be present at the summer meal program site in order for the summer meal program operator to receive state-funded reimbursement for that meal, unless noncongregate rules are in place. The bill would require summer meal program operators receiving state-funded reimbursement to report to the department the number of meals served to guardians by meal site no later than 30 days after the end of summer meal site operations.

The California Constitution provides that the University of California constitutes a public trust administered by the Regents of the University of California, a corporation in the form of a board, with full powers of organization and government, subject to legislative control only for specified purposes. Existing law creates the University of California, San Francisco, San Joaquin Valley Regional Campus Medical Education Endowment Fund. Upon an appropriation by the Legislature, existing law requires moneys in the endowment fund to be allocated to the University of California to support the annual operating costs for the development, operation, and maintenance of a branch campus of the University of California, San Francisco, School of Medicine in the San Joaquin Valley, and to generate funding through investment earnings for support of medical education in the San Joaquin Valley, as provided. This bill would request the University of California to submit a report to the Legislature, on or before August 31, 2026, on the financial requirements necessary to expand the current University of California, San Francisco and University of California, Merced medical education collaboration, the San Joaquin Valley PRIME+ program, and to transition the program into a fully independent medical school operated by the University of California, Merced. The bill would request the report to include the projected costs associated with various program components, a list of potential health facilities at which students could conduct residencies, and a timeline and milestones for the completion of an independent school of medicine at the University of California, Merced.

Existing law establishes the California College Promise, under the administration of the Chancellor of the California Community Colleges, to provide funding, upon appropriation by the Legislature, to each community college meeting prescribed requirements. Existing law authorizes a community college to use that funding to waive some or all of the fees for 2 academic years for first-time community college students and returning community college students, as defined, who are enrolled in 12 or more semester units or the equivalent, or less for students certified as "full time," as specified, and who complete and submit either a Free Application for Federal Student Aid or a California Dream Act application, except as provided. This bill would authorize extending the term of eligibility of the California College Promise for an additional 2 academic years for first-time community college students and returning community college students who matriculate into upper division coursework of a community college baccalaureate degree program, as specified.

Existing law establishes the University of California Kern County Medical Education Endowment Fund. Upon appropriation by the Legislature, existing law requires moneys in the endowment fund to be allocated to the University of California to support the annual operating costs for the development, operation, and maintenance of a branch campus of an existing University of California School of Medicine in the County of Kern, and to conduct a feasibility study related to that campus. This bill would require the University of California, upon appropriation by the Legislature, to complete a feasibility study, and reasonably attempt to consult with local stakeholders, to determine the steps necessary to establish a branch campus of an existing University of California medical school in the County of Kern, and to submit the feasibility study, on or before 2 years after the date of the appropriation, including detailed findings, recommendations, and an implementation timeline, to the Governor and Legislature, as provided. The bill would require the feasibility study to include a comprehensive analysis of the requirements, challenges, and opportunities related to establishing a branch campus of an existing University of California medical school in the County of Kern, as provided. This bill would declare that it is to take effect immediately as an urgency statute.
