Requires community colleges, public universities and Oregon Health and Science University to provide certain rights to students ordered to federal or state active duty for 30 or fewer consecutive days. Declares emergency, effective on passage.
Requires insurers, fraternal benefit societies and certain nonprofit corporations to apply to and obtain from Secretary of State authorization to transact business in this state. Specifies effect of failing to obtain authorization. Requires insurer, fraternal benefit society or nonprofit corporation to maintain registered agent and registered office in this state. ] Permits plaintiff to recover greater of $5,000 or actual damages in cause of action that arises out of business or transaction with insurer, fraternal benefit society or nonprofit corporation that has not obtained authorization to transact business in state. Permits Secretary of State to impose civil penalty of not more than $1,000 for failure to obtain authorization to transact business in this state. ] Imposes public safety assessment on covered entities. Establishes Public Safety Assessment Fund. Transfers revenues to fund. Applies to calendar years beginning on or after January 1, 2019. ] Takes effect on 91st day following adjournment sine die. ] Provides that debt collector engages in unlawful collection practice if debt collector is debt buyer, or is acting on debt buyer's behalf, and collects or attempts to collect purchased debt before providing to debtor, within 30 days after date of debtor's request, certain documents that establish nature and amount of debt.
Provides that person commits crime of strangulation if person knowingly impedes normal breathing or circulation of another person by applying pressure to chest of other person. Increases penalty for crime of strangulation when victim is family or household member. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Directs Oregon Criminal Justice Commission to classify felony strangulation as crime category 5 if committed against family or household member .
Directs Department of Transportation to issue Oregon Wounded Warrior parking permits to qualified applicants. Describes "wounded warrior." Permits person issued Oregon Wounded Warrior parking permit or person transporting person issued parking permit to park motor vehicle in any public parking zone restricted as to length of time permitted therein without incurring overtime penalties and to park motor vehicle in any public parking zone with metered parking without being required to pay any parking meter fee. Provides exceptions. Becomes operative January 1, 2019. Declares emergency, effective on passage.
Allows Health Licensing Office to issue residential care facility administrator license to qualified applicant. Renames Nursing Home Administrators Board as Long Term Care Administrators Board. Prohibits board from carrying out disciplinary action against licensee unless at least one board member who represents type of license held by licensee is present at board meetings related to disciplinary action. Requires individual currently employed as residential care facility administrator in Oregon , or individual seeking employment as residential care facility administrator in Oregon prior to January 1, 2022, to apply for residential care facility administrator license by July 1, 2019. Allows Health Licensing Office to issue provisional residential care facility administrator license to qualified individual. Requires individual who holds provisional residential care facility administrator license to obtain residential care facility administrator license not later than January 1, 2022. Declares emergency, effective on passage.
Requires prescription drug manufacturer to report annually information to Department of Consumer and Business Services regarding prices of prescription drugs and costs associated with developing and marketing prescription drugs. Authorizes department to impose civil penalties on manufacturer for failing to comply with reporting requirements. Requires health insurers that offer prescription drug benefit to report to department specified information about prescription drug prices and impact of prescription drug prices on premium rates. Authorizes department to adopt by rule fees on manufacturers. Requires department to conduct annual public hearing on prescription drug prices and related information reported by manufacturers. Establishes Task Force on the Fair Pricing of Prescription Drugs. Specifies membership and duties. Requires task force to submit report to Legislative Assembly by November 1, 2018. Declares emergency, effective on passage.
Directs Department of Veterans' Affairs to develop written material regarding apprenticeship opportunities and provide material to certain agencies, county veterans' service officers and veterans' organizations for distribution to veterans. Directs department to provide annual training to county veterans' service officers and veterans' organizations regarding apprenticeship programs and federal and state education benefits. Takes effect on 91st day following adjournment sine die.
Prohibits fact finder from determining plaintiff's damages for civil cause of action using calculation for projected future earning potential of plaintiff that takes into account race or ethnicity of plaintiff. ] Makes calculation of projected future earning potential of plaintiff that takes into account race or ethnicity of plaintiff inadmissible in civil action. Directs court to instruct jury in civil action involving claim for projected future earnings that jury may not consider race or ethnicity of plaintiff.
Distributes civil forfeiture proceeds to scholarship program for family members ] children of deceased or disabled public safety officers. Modifies criteria for scholarship program. Applies to applications for scholarships submitted on or after July 1, 2018. Declares emergency, effective on passage.
Modifies definitions, exceptions and affirmative defenses applicable to offense of driving a motor vehicle while using a mobile electronic device. Provides that enhanced classification of offense may only be based on prior conviction occurring on or after July 1, 2018. Creates procedure by which person convicted of enhanced offense based on prior conviction occurring prior to July 1, 2018, may request that court redetermine classification of offense.
