Rep. Paul Holvey

Makes various changes to workers' compensation laws of this state. ] Provides that diagnostic services are compensable under workers' compensation law after industrial accident or occupational disease has been determined to be compensable and if diagnostic services are reasonable and necessary to identify nature or extent of medical condition that may be related to industrial accident or occupational disease. Specifies certain limitations. Provides that employer bears burden of proof in denial of coverage that otherwise compensable condition is no longer major contributing cause of need for treatment and disability of combined condition. Declares emergency, effective on passage.

Requires health benefit plan , coverage ] other than employer-sponsored plan, that covers cost of pregnancy care and childbirth to cover cost of pregnancy care and childbirth for surrogate mothers ] enrollee who is surrogate. Prohibits plan from requiring enrollee to reimburse plan for plan's costs or to assign to plan right to receive surrogacy payment.

Removes exemption for public or livery conveyance from definition of "private passenger motor vehicle" for purposes of determining personal injury protection benefit coverage in insurance policies.

Makes contractor liable for unpaid wages, including other benefit payment or contribution, of employee of subcontractor at any tier. Permits third party owed payment or contribution made as part of employee compensation and joint labor-management cooperation committee to bring action against contractor on behalf of employee for unpaid wages. Requires committee to provide notice of intent to file action to contractor and subcontractor. Requires subcontractor at any tier to provide certain information to contractor upon request. Requires contracts entered into between contractors and first-tier subcontractors or between first-tier subcontractors and subcontractors at any tier to include certain provisions to ensure timely payments of wages to employees. Allows contractor to pay unpaid wages to employee of subcontractor and to withhold payment to subcontractor in amount equal to amount of unpaid wages for subcontractor's failure to meet certain requirements. Applies to contractors who enter into contract with subcontractor on or after January 1, 2020.

Establishes conditions of enforceability for certain employment contracts or agreements. Allows court to award to prevailing plaintiff who is employee reasonable attorney fees in addition to injunctive relief or specific performance.

Establishes salary threshold for employees who are exempt from overtime requirements. Makes conforming amendments.

Requires voter registration cards and electronic voter registration system to include option for person to identify race, ethnicity and preferred language of person. Provides that any identification information provided is public record. Requires each county to identify five most common languages spoken by residents of county. Requires Secretary of State and county to provide elector with voters' pamphlet in elector's preferred language if elector has identified preferred language as part of voter registration and preferred language is one of five languages identified by county. Applies to voters' pamphlets distributed on or after January 1, 2021. Takes effect on 91st day following adjournment sine die.

Establishes Task Force on Campaign Finance Reform. Directs task force to study and make recommendations on reforming campaign finance in this state. ] Sunsets task force on December 31, 2020. ] Takes effect on 91st day following adjournment sine die. ] Establishes limits on campaign contributions that may be accepted by candidates and political committees. Requires political committee to identify as caucus, measure, multicandidate, political party, recall or small donor political committee. Prohibits person from controlling more than one of each committee. Authorizes Secretary of State and Attorney General to require return of contribution excess of limits and impose civil penalty up to 150 percent of total amount of contribution. Repeals Ballot Measure 47 (2006), currently held in abeyance, which establishes limits on political campaign contributions and independent expenditures on candidate races and establishes certain campaign finance disclosure requirements. Becomes operative December 3, 2020.

Establishes that lease-to-own contract concerning dog or cat is void.

Directs Commissioner of Bureau of Labor and Industries to appoint long term care wage board to examine factors that may present challenges to recruiting and retaining long term care employees. Prohibits employers from retaliating against long term care employees who participate in board activities. Permits commissioner to assess civil penalty against employers that retaliate against employees. Requires moneys collected as penalties to be used to reimburse board in carrying out board's duties. Requires board to adopt recommended compensation schedule for long term care employees. Requires board to submit annual report to Bureau of Labor and Industries. Allows Commissioner of Bureau of Labor and Industries to consider recommended schedule in establishing compensation rates for long term care employees. Takes effect on 91st day following adjournment sine die.
