Clarifies meaning of "because of age" in employment discrimination law. Designates as unlawful employment practice for employer to seek age of applicant prior to completing initial interview or making conditional offer of employment and to include certain words or phrases in job application that suggest age preferences. Permits employer to seek age of applicant under certain circumstances. Removes provision that includes apprentices within scope of unlawful employment discrimination statute.

Prohibits, in specified areas of law, discrimination or harassment against persons based on caste. Authorizes enforcement of prohibition through civil action for actual and punitive damages. Authorizes attorney fees in civil proceedings for unlawful discrimination. Includes caste as protected class in bias crimes and incidents. Prohibits profiling by law enforcement agency or officer based on caste. Adds caste to real or perceived factors of motivation or basis for conduct addressed by standards for law enforcement officers. Requires law enforcement agencies to report statistics concerning crimes motivated by prejudice based on perceived caste. Adds caste to classes protected by community engagement plans for planning water projects. Adds caste to classes promoted by affirmative action by state boards, commissions and advisory boards and all branches of state government. Adds caste to types of persecution or well-founded fears of persecution that refugee children are defined to have experienced. Prohibits public charter schools from limiting student enrollment based on caste. Includes caste within cultural competence guidelines developed by System of Care Advisory Council. Prohibits person that sells guaranteed asset protection waiver in sale of motor vehicle from varying terms based on caste. Requires state agencies to eliminate discrimination based on caste. Requires state agencies to adopt any rules related to implementation of provisions of Act no later than January 1, 2024. Declares emergency, effective on passage.

Establishes youth advisory council. Prescribes membership and duties of youth advisory council. Directs Department of Education to establish work group to establish standards for selection process of members of youth advisory council. Sunsets work group on August 30, 2024. Declares emergency, effective July 1, 2023.

Directs Oregon Criminal Justice Commission to establish, in collaboration with Department of Corrections, Family Preservation Project pilot program at Coffee Creek Correctional Facility. Provides that program shall be administered by YWCA of Greater Portland. Specifies goals of program and services that may be provided. Requires commission to perform analysis of program and report results of analysis to Legislative Assembly beginning September 15, 2026, and every two years thereafter. Appropriates moneys to Oregon Criminal Justice Commission for distribution to YWCA of Greater Portland for purposes of program. Sunsets program on January 1, 2031. Declares emergency, effective on passage.

Provides that first full week in March is known as Classified School Employees Week.

Establishes Oregon Housing Needs Analysis in Oregon Department of Administrative Services. Requires cities outside Metro to plan for housing needs as allocated by analysis. Requires Metro to adopt similar methodology to allocate housing needs to cities within Metro. Requires Housing and Community Services Department to develop housing production dashboard and housing equity indicators. Allows Department of Land Conservation and Development to audit, and to enter into housing acceleration agreement with, certain cities that are not adopting or implementing housing production strategies or that are lowest performing as measured by dashboard and indicators. Allows department to seek, and Land Conservation and Development Commission to issue, specific enforcement orders for certain continued noncompliance by cities in addressing housing. Amends land use requirements for local governments related to urbanization, including by requiring cities to measure and plan for development-ready lands, requiring Metro to adopt housing coordination strategy and allowing cities outside of Metro to adopt rural reserves. Requires commission to adopt or amend implementing rules. Modifies emergency housing assistance program and state homeless assistance program to provide services and assistance to school-aged children experiencing or at risk of experiencing homelessness. Modifies eligibility requirements for applicants for grants from homeless youth services enhancement program and host home project program. Makes programs permanent. Requires Housing and Community Services Department to provide grants or loans for modular housing and components. Sunsets January 2, 2026. Requires Oregon Facilities Authority to provide financing for infrastructure and predevelopment costs for moderate income housing. Sunsets January 2, 2026. Requires residential landlords to extend notice periods for terminations of tenancy based on nonpayment of rent and to include additional notices. Requires landlords and clerk to also include notice with summons for nonpayment of rent. Postpones dates for first appearance and trial for evictions based on such termination notices. Requires landlord to attest to belief that tenant who is absent at first appearance remains in possession of premises before default eviction judgment. Requires public bodies and grantees to inform tenants and landlords regarding rental assistance applications. Requires courts to annually set aside and seal certain inoperative residential eviction judgments. Requires State Department of Agriculture to provide grants to improve certain existing agriculture workforce housing. Sunsets January 2, 2026. Allows certain moneys appropriated to Housing and Community Services Department for use in Oregon Balance of State Continuum of Care to be spent under emergency procurement authority. Appropriates moneys from General Fund to Housing and Community Services Department, Oregon Department of Administrative Services, Land Conservation and Development Commission, Oregon Facilities Authority and State Department of Agriculture for purposes of Act. Declares emergency, effective on passage.

Prohibits employers from permitting or requiring agricultural workers to work in excess of maximum allowable hours unless workers are compensated for overtime hours worked. Specifies exemptions to overtime compensation requirements. Requires Employment Department, in consultation with Bureau of Labor and Industries, Department of Revenue and State Department of Agriculture, to submit report to interim committees of Legislative Assembly related to agriculture on identified economic impacts of overtime compensation requirements under Act. Requires division of Oregon Department of Administrative Services that serves as office of economic analysis to include in economic forecast for biennium any available relevant economic and wage data related to agricultural economy as impacted by overtime compensation requirements. Requires State Department of Agriculture and Oregon Business Development Department to make recommendations for legislation to regular or interim committee of Legislative Assembly related to agriculture on available options for establishing grant, loan or other lending program to provide financial assistance to employers to mitigate costs associated with compliance with overtime compensation requirements. Creates refundable income or corporate excise tax credit allowed to employer for excess amount of wages paid as overtime pay to agricultural workers. Provides for administration of credit by Department of Revenue. Directs department to issue notice to taxpayers that meet application requirements and indicate maximum amount of credit allowed. Provides for Legislative Assembly to use reports submitted by agencies to adjust tax credit provisions and revise rates if deemed appropriate. Applies to tax years beginning on or after January 1, 2023 , and before January 1, 2029 ]. Takes effect on 91st day following adjournment sine die.

Modifies composition and duties of Oregon Broadband Advisory Council. Provides for establishment of grant application review committees. Directs Oregon Broadband Office to develop Broadband Action Plan and Digital Equity Plan that address requirements in Infrastructure Investment and Jobs Act. Directs Oregon Broadband Office to collect geospatial data information related to broadband service in Oregon to assist state to determine eligibility for grants and loans and confirm allocation of federal funds. Exempts from public disclosure proprietary information subject to nondisclosure agreement provided to office. Establishes Connecting Oregon Libraries Fund. Continuously appropriates moneys in fund to State Library for purpose of providing matching funds for federal moneys received by certain libraries for providing broadband access. Requires State Library Board to adopt certain rules before distributing moneys in fund. Directs Public Utility Commission, in consultation with certain other state agencies, to investigate and make recommendations on feasibility of expanding Oregon Telephone Assistance Program and applying residential service surcharge to support access to broadband Internet access service or other telecommunications services. Requires commission to submit report to appropriate regular or interim committee of Legislative Assembly and Oregon Broadband Office no later than June 1, 2023. Removes requirement that Public Utility Commission serve notice of all filings of applications for certificates of authority to provide intrastate telecommunications services. Removes requirement that commission provide annual competitive provider report to Legislative Assembly. Declares emergency, effective on passage.

Requires Oregon Health Authority, guided by advisory committee to be convened by authority, to provide grants to operate two culturally and linguistically specific mobile health units, as pilot program, to improve health outcomes of Oregonians impacted by racism. Specifies membership of advisory committee. Requires authority to study feasibility of expanding mobile health units statewide and to provide interim report on findings to Legislative Assembly by December 31, 2025, and final report by June 30, 2026. Specifies criteria for study. Sunsets January 2, 2027. Requires authority, based on recommendations from task forces convened by Oregon Advocacy Commissions Office, to develop recommendations on how to fund robust culturally and linguistically specific intervention programs designed to prevent or intervene in health conditions that result in inequitable and negative outcomes for individuals who are Black or indigenous, people of color and members of tribes. Requires office to report recommendations to Legislative Assembly by November 1, 2023. Requires authority, no later than November 30, 2023, to report to Legislative Assembly on development of recommendations for funding robust culturally and linguistically specific intervention programs and to report final recommendations by November 1, 2024. Sunsets January 2, 2025. Declares emergency, effective on passage.

Amends provisions of workers' compensation law related to payments of benefits, notice to workers, recovery of overpayments and errors in claims processing ] authorization of temporary disability, claim closure and overpayments of compensation .
