Newborn Screening Saves Lives Reauthorization Act of 2021 This bill reauthorizes through FY2026 and revises several programs and activities relating to newborn screening for certain conditions and genetic, endocrine, and metabolic diseases. Among its changes, the bill reauthorizes and makes mandatory the Hunter Kelly Research Program at the National Institutes of Health, and national surveillance activities conducted by the Centers for Disease Control and Prevention. The bill also aligns statutory requirements for research on non-identified newborn blood spots with federal regulations governing research on human subjects. These blood spots are collected as part of newborn screening programs, and some states make them available for biomedical and public health research. Under current regulations, research on non-identified bio-specimens such as blood spots is not considered to be research on human subjects, to which additional protections apply.

Making Obligations Right by Enlarging Payments In Lieu of Taxes Act or the MORE PILT Act This bill directs the Department of the Interior to develop a modeling tool that calculates the approximate market value of land covered by the payments in lieu of taxes (PILT) program and the approximate amount of local tax revenue the land would generate if privately owned. The PILT program compensates local governments for tax revenue lost due to tax-exempt federal lands within their boundaries. Interior must annually report on the value of land covered by the PILT program, the tax revenue the land would generate if privately owned, and how PILT payments could more accurately reflect that tax revenue.

Outdoor Restoration Partnership Act of 2021 This bill establishes and provides funding for the Restoration and Resilience Grant Program and the Restoration and Resilience Partnership Program. The bill establishes a Restoration Fund Advisory Council to provide advice to the Department of Agriculture (USDA) respecting the grant program. The grant program shall provide grants to eligible entities (e.g., a state agency, a unit of local government, or a tribal government) for purposes such as (1) increasing the capacity for planning, coordinating, and monitoring restoration and resilience projects on federal land and nonfederal land; or (2) restoration and resilience projects on nonfederal land. Under the Restoration and Resilience Partnership Program, USDA shall carry out restoration and resilience projects that reduce wildfire potential, improve community resilience in the wildland-urban interface, or restore wildlife habitat.

Aluminum Pricing Examination Act or the APEX Act This bill extends the jurisdiction of the Commodity Futures Trading Commission (CFTC) to include the markets for aluminum premiums. Specifically, the CFTC has jurisdiction over (1) the process and manner in which reference prices for such premiums are set or reported, and (2) whether the mechanism for setting such reference prices is fair and transparent. Additionally, the CFTC must consult with the Department of Justice regarding relevant information, including allegations of anticompetitive conduct.

Trillion Trees Act This bills establishes a variety of requirements and incentives to plant trees and conduct other land management practices for the purposes of capturing and storing carbon in domestic and international trees and forests. Additionally, the bill provides incentives to research or develop other carbon sequestration tools. Specifically, the bill directs the Department of Agriculture (USDA) to set targets to increase forest carbon stock through January 1, 2100, for the purposes of sequestering and storing carbon in U.S. forests. It also establishes and provides funding for the Trillion Trees Challenge Fund to provide grants to nonfederal entities for activities related to reforestation efforts on public or private lands. In addition, it raises the cap on the Reforestation Trust Fund to enhance forest health in the National Forest System and requires the USDA to establish a Tree City USA Grant Program. The bill also allows the U.S. Agency for International Development to enter into an agreement with a nonprofit organization to establish an International Forest Foundation to promote reforestation and prevent deforestation. Additionally, it establishes requirements and incentives to address seedling shortages and support nurseries. Finally, the bill provides market incentives to research or develop other carbon sequestration tools relating to biochar, sustainable building practices, biochemical and bioplastic products, and biomass energy.

Flexible Financing for Rural America Act This bill allows rural utility service providers to submit to the Department of Agriculture (USDA) a request to adjust the interest rate or modify the terms of certain loans. The request shall include a report summarizing how the adjustment or modification will assist the borrower in providing critical utility services to a rural community. Specifically, on receipt of a request, USDA or the Department of the Treasury (in the case of a loan owned by the Federal Financing Bank) must adjust the interest rate on the loan to match certain interest rates for obligations of comparable maturity to the term remaining on the loan (or a higher rate requested by the borrower), and make modifications to the loan terms as necessary to address changes in the financial position of the borrower due to the COVID-19 public health emergency and to promote the financial sustainability of the borrower. In carrying out the adjustments or modifications, USDA or Treasury shall not impose or collect any fee from, or impose any penalty on, a borrower. The bill also provides funding to implement the adjustments and modifications and for the liquidation of residual intragovernmental amounts owed by the Federal Financing Bank in connection with certain loans.

Forest Technology Enhancements for Conservation and Habitat Improvement Act or the Forest TECH Improvement Act This bill directs the Department of Agriculture (USDA) to either establish a research and development pilot program or expand an applicable existing program to assess new technologies, including unmanned aircraft system, geospatial, or remote sensing technologies, across all reforestation activities; accelerate the deployment and integration of such technologies into the operations of USDA and the Department of the Interior; collaborate and cooperate with state, tribal, and private geospatial information system organizations with respect to such technologies. USDA and Interior shall enter into an agreement to develop consistent protocols and plans for the use of unmanned aircraft system technologies for reforestation activities. Any unmanned aircraft system technology or component of such technology that is used pursuant to this bill shall be made and manufactured in the United States.

Medical Nutrition Equity Act of 2021 This bill expands coverage under Medicare, Medicaid, other specified federal health care programs, and private health insurance to include foods, vitamins, and individual amino acids that are medically necessary for the management of certain digestive and metabolic disorders and conditions.

Accessing America's Critical Minerals Act of 2021 This bill establishes deadlines to complete the environmental review of critical mineral projects on federal land and sets forth related requirements to expedite the review of such projects under the National Environmental Policy Act of 1969 (NEPA). If an environmental assessment or environmental impact statement is required for such project, then all necessary federal review and permit considerations must be completed within 18 or 24 months, respectively. However, the review may exceed the time limit if the project sponsor agrees. The lead agency of the environmental review of such project must allow a state or local government, an Indian tribe, a project sponsor, or another appropriate entity to assume certain federal responsibilities regarding the environmental review of the project upon the request of such entity. Further, the bill authorizes a lead agency to determine that the requirements of NEPA have been satisfied if a state or federal agency acting under state or federal law has addressed specified factors, such as the environmental impact of the action to be conducted under the permit. If the lead agency does not make such a determination, then the agency must enter into an agreement with the project sponsor to set time limits for each part of the permitting process.

Secure Rural Schools Reauthorization Act of 2021 This bill extends through FY2023 payments made to states and eligible counties containing certain federal land under the Secure Rural Schools and Community Self-Determination Act of 2000. The Department of the Interior and the Department of Agriculture shall carry out a pilot program to allow the Chief of the Forest Service or the Director of the Bureau of Land Management to nominate members of resource advisory committees. County funds may be used to provide or expand access to (1) broadband telecommunications services at local schools, or (2) the technology and connectivity necessary for students to use a digital learning tool at or outside of a local school campus. Any county funds that were obligated by a county before October 1, 2017, but are unspent on October 1, 2020, may be used by the county for any authorized use and shall be available for projects initiated after October 1, 2020. No county funds may be used for lobbying activity, regardless of the purpose for which the funds are obligated on or before the enactment of this bill.
