FIREARM LIABILITY ACT

Creates the Firearm Liability Act. Provides that a firearm transferor is strictly liable in a civil action for death, injury, or property damage resulting from the use of a firearm that was unlawfully sold, transferred, or caused to be sold or transferred. Provides that the plaintiff may recover punitive damages in addition to all other lawful damages, court costs, and attorney's fees. Provides that a defendant found strictly liable under this Act must pay $10,000 in a civil penalty to the Department of State Police if the defendant sold, transferred, or caused to be sold or transferred a firearm in violation of certain provisions of the Firearm Owners Identification Card Act or the Criminal Code of 1961. Provides that an action under this Act must be commenced within 5 years after the cause of action accrued.

COMP REVIEW-SEPARATE REPORT

Amends the Compensation Review Act. Requires the Compensation Review Board to vote separately on compensation for judges and to file separate reports for (i) judges and (ii) all other positions. Requires that the General Assembly may disapprove a report only by a resolution and vote separate from a resolution and vote, if any, disapproving the other report.

NURSING HOME-ORDER OF PROTECTN

Amends the Nursing Home Care Act. Provides that a nursing home administrator may seek an order of protection in the name of a resident to protect that resident from abuse, neglect, or financial exploitation pursuant to the Illinois Domestic Violence Act of 1986. Provides that a facility shall take appropriate steps to secure the enforcement of every order of protection entered on behalf of a resident or staff member of which the facility has reasonable knowledge. Provides that such steps include, but are not limited to, reporting violations to an appropriate law enforcement agency. Provides that a facility taking steps to secure the enforcement of a valid order of protection shall be held harmless from sanctions under the Nursing Home Care Act. Provides that a facility reporting a violation of an order of protection shall be held harmless from any sanctions under the Nursing Home Care Act if the facility shows a good faith effort to secure the enforcement of the order of protection. Effective immediately.

INS CD - HEARING AID COVERAGE

Amends the Illinois Insurance Code, the Health Maintenance Organization Act, and the Voluntary Health Services Plans Act to require coverage for hearing instruments and related services for all individuals when a hearing care professional prescribes a hearing instrument. Provides that an insurer shall provide coverage for up to $2,500 per hearing aid per insured's hearing impaired ear subject to certain restrictions. Provides that an insurer shall not be required to pay a claim if the insured filed the claim 36 months prior to the date of filing the claim with the insurer and the claim was paid by any insurer. Contains a nonacceleration clause. Effective immediately.

UTIL-THIRD-PARTY SALES REPS

Amends the Public Utilities Act. Provides that all third-party sales representatives engaged in the marketing of retail electricity supply, including exclusive and non-exclusive agents, must, prior to the customer signing a contract, disclose in writing that they are not employed by the electric utility operating in the applicable service territory and, if applicable, that they are compensated in whole or part on a commission basis. Provides that for telephonic solicitations, the disclosure may initially be made verbally prior to the customer signing a contract, with a follow-up written disclosure required prior to any customer contract being finalized. Excludes the Illinois Power Agency and its employees from the definition of "agents, brokers, and consultants engaged in the procurement or sale of retail electricity supply for third parties" and changes the requirements of parties already subject to licensure. Provides that any person or entity required to be licensed under specified provisions must, among other requirements, disclose in plain language in writing to all customers, prior to the customer signing a contract, the total anticipated remuneration to be paid to it by any third party over the period of the proposed underlying customer contract. Removes provisions requiring agents, brokers, and consultants to file copies of their verified financial statements with the Commission on an annual basis. Makes changes concerning disciplinary actions against agents, brokers, and consultants. Effective immediately.

TOBACCO-MINORS-PENALTIES

Amends the Sale of Tobacco to Minors Act. Provides that a person who sells a cigar, cigarette, smokeless tobacco, or tobacco in any of its forms to a minor under 18 years of age commits a petty offense for which a fine of $1,000 shall be imposed. Provides that if 3 violations occur in a 12-month period at a retail mercantile establishment, an order may be entered prohibiting the sale, distribution, or furnishing of tobacco products to any person at that retail mercantile establishment for a period of 20 days. Provides that if 4 or more violations occur in a 12-month period at a retail mercantile establishment, an order may be entered prohibiting the sale, distribution, or furnishing of tobacco products to any person at that retail mercantile establishment for a period of 5 years. Provides that an action in case of such violations may be brought against the owner of the retail mercantile establishment by either the county in which the retail mercantile establishment is located or the municipality in which the retail mercantile establishment is located. Effective immediately.
