TELECOMM-CONSUMER RIGHTS

Amends the Universal Telephone Service Protection Law of 1985 in the Public Utilities Act. Requires a wireless telecommunications carrier to comply with specified criteria with respect to consumer rights, protections, billing and billing dispute resolution procedures, and termination of service. Provides that a wireless telecommunications carrier that violates the Section violates the Consumer Fraud and Deceptive Business Practices Act.

UNIFORM ACT-ADULT GUARDIANSHIP

Creates the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act. Contains provisions concerning jurisdiction over adult guardianships, conservatorships, and other protective proceedings. Sets forth guidelines to specify which court has jurisdiction to appoint a guardian or conservator for an incapacitated adult, by prioritizing the states which might claim jurisdiction. Provides for designation of a "home state" and a "significant-connection state". Provides for communication and cooperation between courts. Contains provisions concerning transfer of guardianship or conservatorship to another state. Provides for registration and recognition of guardianship or protective orders from other states.

CIGARETTE RETAIL LICENSE

Creates the Cigarette Delivery Sales Reporting Act. Imposes reporting requirements on persons who sell cigarettes for delivery by mail or a delivery service. Includes civil penalties for noncompliance. Amends the Cigarette Tax Act and the Tobacco Products Tax Act of 1995. Requires a retailer of cigarettes or tobacco products to obtain a retailer's license from the Department of Revenue; specifies qualifications, fees, and penalties for noncompliance; provides for mandatory suspension or revocation of a retailer's license for repeated violations of the Sale of Tobacco to Minors Act. Also makes changes in definitions, reporting requirements, and civil and criminal penalties. Amends the Illinois Lottery Law, the Department of Revenue Law of the Civil Administrative Code of Illinois, Cigarette Use Tax Act, the Liquor Control Act of 1934, and the Sale of Tobacco to Minors Act to make corresponding changes.

CRIM CD-SCLERAL TATTOOING

Amends the Criminal Code of 1961. Provides that it is a Class A misdemeanor to perform or offer to perform scleral tattooing upon a person. Exempts from a violation of this provision an act of a physician licensed to practice medicine in all its branches performed in the course of practice of the physician according to the customs and standards of the practice of medicine. Defines "scleral tattooing".

CRIM CD-INMATES COMMUNICATIONS

Amends the Criminal Code of 1961. Provides for enhanced penalties if the defendant at the time of the commission of the offense is a pre-trial detainee at a penal institution or is serving a sentence at a penal institution.

CRIM CD-RECKLESS HOMICIDE

Amends the Criminal Code of 1961. Provides that a person who causes a fatal accident by operating a motor vehicle, all-terrain vehicle, snowmobile, or watercraft while he or she is aware of being fatigued is guilty of reckless homicide. Provides that a person is fatigued if he or she has been without sleep for 24 consecutive hours. Provides that proof that the defendant fell asleep while driving or was driving after having been without sleep for a period in excess of 24 consecutive hours may give rise to an inference that the defendant was driving recklessly. Provides that, if a person commits reckless homicide and is determined to have been knowingly fatigued as an element of the offense, he or she is guilty of a Class 2 felony. Provides that the offender, if sentenced to imprisonment, shall be sentenced to a term of not less than 3 years and not more than 14 years if the offense resulted in the death of one person or not less than 6 years and not more than 28 years if the offense resulted in the deaths of 2 or more persons.

PUBLIC GUARDIAN-CERTF-FEES

Amends the Probate Act of 1975. Provides that the Governor may appoint one person to serve as public guardian and public administrator in one or more counties (instead of one in each county). Provides that each public guardian must be certified by the Center for Guardianship Certification and that the Guardianship and Advocacy Commission shall provide professional training. Provides for fees and expenses for a public guardian and his or her temporary guardianship duties and establishes guidelines for fees. Makes other changes.

IDPH-NURSING HOME-FINANCIAL

Amends the Nursing Home Care Act. Provides that an initial application for licensure under the Act must be accompanied by verification of financial responsibility. Effective immediately.

PROP TAX-DISABLED-TAX SALE

Amends the Property Tax Code. Provides that no tax deed shall be issued for property in which a person with a disability has any ownership interest so long as an objection is raised by or on behalf of that person prior to the issuance of the tax deed or pursuant to certain provisions of the Code of Civil Procedure. Provides that any tax deed issued for property in which a person with a disability has an ownership interest shall be vacated upon petition by or on behalf of the person with a disability. Provides that, if the court refuses to enter an order directing the county clerk to execute and deliver the tax deed or if the court vacates the issuance of a tax deed, then, upon application of the owner of the certificate of purchase, the court shall declare the sale to be a sale in error. Effective immediately.

VEH CD-SEAT BELTS-SCHOOL BUS

Amends the Illinois Vehicle Code. Provides that, beginning July 1, 2011, each school bus that is purchased new shall be equipped with seat safety belts for each passenger. Provides that the State Board of Education shall adopt rules to ensure that school districts require all passengers on those buses to wear seat safety belts. Provides that, except for willful or wanton misconduct, a school bus driver may not be held personally liable for the failure of passengers to wear seat safety belts. Pre-empts the exercise of home rule powers. Makes a corresponding change in the Illinois Municipal Code. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.
