$DHS-MNTL HLTH-DEVEL DISABILTY

Appropriates $86,680,000 from the General Revenue Fund (GRF) to the Department of Human Services (DHS) for (i) a 5% cost-of-doing-business increase in rates paid to private sector agencies serving individuals with developmental disabilities and (ii) a benefit package for direct support staff in such private sector agencies. Appropriates $43,320,000 from GRF to DHS for similar purposes in connection with private sector agencies serving individuals with mental illness. Appropriates additional amounts from GRF to DHS to restore grant funding reserved by the Department during fiscal year 2009, and for other purposes. Effective July 1, 2009.

CONDOS-VOTING-GARAGE-STORAGE

Amends the Condominium Property Act. In a provision that states that when 30% or fewer units, by number, possess over 50% of the votes in the association, any percentage vote of members specified in the Act or in the condominium instruments shall require the specified percentage by number of units rather than by percentage of interest in the common elements allocated to units, provides that after that determination is made, a unit shall not include a garage unit or a storage unit and a vote in the association shall not include a garage unit or storage unit when calculating a vote or any part of a vote (instead of whether 30% or fewer units, by number, possess over 50% of the votes in the association, a unit shall not include a garage unit or a storage unit). Effective immediately.

ADOPTION-CONSENT-SURRENDER

Amends the Adoption Act. Provides 2 new adoption forms: final and irrevocable designated surrender for purposes of adoption; and final and irrevocable consent to adoption by a specified person or persons in a non-DCFS case. Effective immediately.

HOMEOWNERS SOLAR RIGHTS ACT

Creates the Homeowners' Solar Rights Act. Provides that each homeowners' association and condominium unit owners' association shall adopt an energy policy statement concerning the location, design, and architectural requirements of solar energy systems or other energy devices. Provides that any entity that complies with the Act is not liable to any other resident or third party for such compliance. Provides that the Act does not apply to a building more than 30 feet in height. Includes other provisions.

INNOVATION ZONES

Creates the Illinois Innovation Zone Act. Specifies the criteria for an area to qualify as an Innovation Zone. Contains provisions concerning the creation of Zones by a municipality or county. Contains provisions concerning the application of a county or municipality to the Department of Commerce and Economic Opportunity for certification of a Zone. Contains provisions concerning the amendment and decertification of Zones. Contains provisions concerning the adoption of tax increment financing. Specifies the powers and duties of the Department. Contains provisions concerning State incentives regarding public services and physical infrastructure. Contains provisions concerning Zone administration. Contains provisions concerning (1) income tax deductions, and (2) State and local regulatory alternatives. Contains provisions concerning loans made under specified provisions of the Act. Amends the State Finance Act to create the Innovation Zone Loan Fund as a special fund in the State treasury and specifies the purpose of the Fund. Contains provisions concerning (1) the construction of specified provisions of the Act, (2) the confidentiality of specified materials, (3) the annual report from the Department to specified parties, and (4) the use of federal moneys. Creates the Illinois Innovation Council and specifies its responsibilities, powers, and duties. Amends the Illinois Income Tax Act and the Economic Development for a Growing Economy Tax Credit Act to add provisions concerning tax credits for businesses located in a Zone. Amends the Use Tax Act, Service Use Tax Act, Service Occupation Tax Act, and Retailers' Occupation Tax Act to add specified exemptions concerning Zones.

WAGE PAYMENT-PENALTIES

Amends the Code of Criminal Procedure of 1963. Provides that 2 or more acts or transactions in violation of certain provisions of the Illinois Wage Payment and Collection Act may be joined in a single count of an indictment, information, or complaint. Amends the Illinois Wage Payment and Collection Act. Subject to appropriation, provides that the Department of Labor shall establish an administrative procedure to adjudicate claims or specific categories of claims. Establishes procedures for an employee who has not been paid the wage the employee is entitled by the Act to recover by filing a claim with the Department or in a civil action, but not both.
