CRIM PRO-INVOLUNTARY MED

Amends the Code of Criminal Procedure of 1963. Provides that involuntary medication may be administered to an adult defendant without the informed consent of the defendant by order of the circuit court pursuant to specified procedures and standards. Provides that a defendant in the custody of the Department of Human Services may also be administered medication as provided in the Mental Health and Developmental Disabilities Code. Provides that a defendant in the custody of the Department of Corrections may also be administered medication as provided in the rules and regulations of the Department of Corrections. Effective immediately.

PROP TX- AUTOMATION FEES

Amends the Property Tax Code. Provides that the county collector may assess, to the purchaser of property for delinquent taxes, an automation fee of not more than $20 (now, $10) per parcel if automated bidding systems are employed at the tax sale. Effective immediately.

DRAINAGE CD-COMMISSIONERS

Amends the Illinois Drainage Code. Provides that the number of commissioners in certain drainage districts shall be increased from 3 to 5. Effective immediately.

KIDCARE-MEDICAID-MANAGED CARE

Amends the Children's Health Insurance Program Act and the Illinois Public Aid Code. Under the Children's Health Insurance Program, (i) provides for eligibility for children whose household income is at or below 300% (instead of 200%) of the federal poverty level and (ii) increases the income threshold in connection with eligibility under an approved waiver. Provides that on and after July 1, 2008, the Department of Healthcare and Family services shall implement a capitated managed care system for selected populations of persons persons under the Children's Health Insurance Program and the Medicaid program. Provides that under such a system, the State shall pay a fixed amount per individual per month to a third-party entity to manage the program of health care benefits and assume the risk associated with the payment of medical bills without regard to actual medical claims incurred. Provides that the Department shall implement the system in a manner that maximizes all available State and federal funds. Sets forth categories of Medicaid recipients who may withdraw from the managed care program and who may voluntarily opt to participate in the program, and provides that certain recipients are not eligible to participate in the managed care program. Provides for Medicaid eligibility for persons whose income is between zero and 100% of the federal poverty level. Provides that under the Medicaid program, the Department of Healthcare and Family Services shall provide health benefits coverage to eligible individuals by: (1) subsidizing the cost of privately sponsored health insurance, including employer-based health insurance, to assist individuals in taking advantage of available privately sponsored health insurance; and (2) purchasing or providing health care benefits for eligible individuals. Makes other changes.

EPA-CIVIL ACTIONS

Amends the Environmental Protection Act. Provides that all complaints and other actions brought by the Attorney General pursuant to a referral or request from the Environmental Protection Agency must include the Agency as a named party plaintiff or complainant in the action. Provides that this requirement does not apply to certain criminal actions and is not intended to alter or diminish the Attorney General's authority to act as the attorney for the Agency and the State. Effective immediately.

HOME BIRTH SAFETY ACT

Creates the Home Birth Safety Act. Provides for the licensure of midwives by the Department of Financial and Professional Regulation. Creates the Illinois Midwifery Board. Sets forth provisions concerning qualifications, grounds for disciplinary action, and administrative procedures. Amends the Regulatory Sunset Act to set a repeal date for the new Act of January 1, 2019. Amends the Medical Practice Act of 1987 and the Nurse Practice Act to make related changes. Effective immediately.

INS CD-REPORTING

Amends the Illinois Insurance Code. Provides that a company authorized to do business in the State or accredited by the State to issue policies of health insurance, self-insured plans, group health plans, service benefit plans, managed care organizations, pharmacy benefit managers, or other parties that are by statute, contract, or agreement legally responsible for payment of a claim for a health care item or service as a condition of doing business in the State must follow specified guidelines concerning (1) the reporting of information to the Department of Healthcare and Family Services; (2) the State's right of recovery for payment made under the medical programs of the Department; (3) the response to any inquiry by the Department regarding certain claims; and (4) an agreement not to deny a claim submitted to the Department that meet specified criteria. Effective immediately.
