Amends the Consumer Fraud and Deceptive Business Practices Act concerning product and services charges billed on telephone bills. Provides that a third-party vendor shall not bill a consumer for goods or services that will appear as a charge on a consumer's telephone bill. Effective immediately.
Amends the School Code. Provides that after June 1, 2012 persons may not be nominated for General Assembly scholarships and that General Assembly scholarships may not be awarded after that date unless the nomination is made prior to that date. Prevents both second nominations for any lapsed General Assembly scholarship and nominating persons to the unused or unexpired parts of any vacated General Assembly scholarship after June 1, 2012. Effective immediately.
Amends the State Employees Group Insurance Act of 1971. Requires, beginning on the effective date of the amendatory Act, retired employees, annuitants, and survivors to pay premiums in order to obtain coverage for themselves and any dependents under the program of group health benefits. Requires the Director to determine the amount of the premium to be paid by each retired employee, annuitant, and survivor, based upon a system that takes into account (i) points, which are calculated by summing the retiree's age when benefits commenced and his or her total years of service, and (ii) annual State pension income. Specifies that, with respect to any annuitant, retired employee, or survivor covered by a collective bargaining agreement in effect on the effective date of the amendatory Act and until that collective bargaining agreement terminates, the obligation of each retired employee, annuitant, and survivor to pay the required premium applies only to the extent that the obligation is consistent with any contractual obligations existing in any collective bargaining agreement in effect on the effective date of the amendatory Act. Allows the Director, upon the expiration of any collective bargaining agreement in effect on the effective date of the amendatory Act, to alter the schedule of premium contributions to ensure that 49% of the costs associated with the basic program of group health benefits are covered by participating retired employees, annuitants, and survivors. Defines "State pension income". Effective July 1, 2012.
Proposes to amend the Bill of Rights Article of the Illinois Constitution concerning crime victim's rights. Provides that in addition to other rights provided in the Constitutional provision, a crime victim has the right to: (1) be free from harassment, intimidation, and abuse; (2) refuse to disclose information that is privileged or confidential by law; (3) timely notification of post-trial proceedings; (4) be heard in person or in any other reasonable manner the victim chooses at any proceeding involving a post-arraignment release decision, plea, sentencing, post-conviction or post-adjudication release decision, or any proceeding in which a right of the victim is at issue; (5) receive a report prepared for sentencing, reduction in sentence, parole, early release, or clemency, when available to the accused; and (6) have the safety of the victim and the victim's family considered in denying or fixing the amount of bail, determining whether to release the defendant, and setting conditions of release after arrest and conviction. Provides that nothing in this Constitutional provision creates any cause of action for compensation or damages against the State, any political subdivision of the State, any officer, employee, or agent of the State or of any of its political subdivisions, or any officer or employee of the court. Effective upon being declared adopted.
Amends the Local Government Prompt Payment Act. Makes a technical change in a Section concerning the short title.
Amends the Newborn Metabolic Screening Act. Provides that the Department of Public Health shall provide newborns with expanded screening tests for the presence of Mucopolysaccharidosis I (Hurler disease), Mucopolysaccharidosis II (Hunters disease), and Severe Combined Immunodeficiency Syndrome (SCIDS). Provides that if the Department is unable to provide expanded screening for SCIDS using the State Laboratory within 180 days after the effective date of the amendatory Act, then the Department shall temporarily provide the screening through an accredited laboratory selected by the Department until the Department has the capacity to provide screening through the State Laboratory. Permits the Department to substitute the fee charged by the accredited laboratory, plus a 5% surcharge for documentation and handling for the fee authorized if expanded screening is provided on a temporary basis through an accredited laboratory. Effective immediately.
Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services may by rule provide for reimbursement of the dispensing of a 90-day supply of a generic or brand name (rather than generic), non-narcotic maintenance medication in circumstances where it is cost effective.
Amends the Illinois Insurance Code. Provides that accident and health insurance policies that provide coverage for prescribed orally-administered cancer medications and intravenously administered or injected cancer medications shall ensure that the applicable financial requirements and treatment limitations are no more restrictive than the financial requirements and treatment limitations applied to intravenously administered or injected cancer medications that are covered by the policy. Provides that an insurer cannot achieve compliance with the coverage mandate by increasing financial requirements or imposing more restrictive treatment limitations on prescribed orally-administered cancer medications or intravenously administered or injected cancer medications covered under the policy. Effective immediately.
Amends the Firearm Owners Identification Card Act. Provides that the regulation of the acquisition, possession, transportation, storage, purchase, selling, and dealing in rifles and shotguns legally purchased or possessed under federal and State law and their ammunition, components, accessories, and accoutrements is an exclusive State power and function and may not be exercised by units of local government, including home rule units. Provides that the regulation by units of local government, including home rule units, of gun shows and firearm sales to gun club members is limited to imposing licensing fees and occupation and use taxes that are the same for other sporting goods businesses.
