Amends the Code of Criminal Procedure of 1963. Adds the State's Attorney's Investigative Subpoenas Article to the Code. Provides that at any time prior to the commencement of a prosecution and upon written application by the State's Attorney, the circuit court shall cause the clerk of the court to issue subpoenas ad testificandum or duces tecum directed to the sheriff or coroner of any county in the State for the purpose of obtaining the testimony of any person or any document or material relevant to a criminal matter being investigated by the State's Attorney. Establishes procedures under which the State's Attorney may apply for the issuance of such subpoenas. Provides that any person appearing before an issuing court in response to a State's Attorney's investigative subpoena shall have the right to be accompanied by counsel. Provides that any proceeding related to the issuance or enforceability of the subpoena, or to the disclosure of information obtained from such subpoena, shall take place in camera and in the presence of the State's Attorney, and at the party's request, the party subpoenaed and his or her counsel, and a court reporter who shall transcribe the proceedings. Provides that except for the State's Attorney's copy, such transcripts shall be sealed and in the event a prosecution is commenced, the transcript shall be disclosed to the accused as provided by law. Provides that the Attorney General, in cooperation with the Illinois State's Attorney Association, shall annually provide a course of training to the State's Attorneys, in the legal, ethical, and practical aspects of the provisions of the Article relating to investigation and prosecutorial functions. Effective immediately.
Amends the Election Code. Limits a candidate for public office to one political committee, with certain exceptions. Limits annual campaign contributions to any one candidate for public office from an individual, corporation, labor union, association, or other group to an aggregate of $5,000, adjusted annually for inflation.
Amends the Mental Health and Developmental Disabilities Code. Changes the definition of the term "dangerous conduct" to mean threatening behavior or conduct that places another individual in reasonable expectation of being physically harmed (rather than harmed), or conduct evincing a person's inability to provide, without the assistance of family or outside help, for his or her basic physical needs so as to guard himself or herself from serious harm (rather than, or a person's inability to provide, without the assistance of family or outside help, for his or her basic physical needs so as to guard himself or herself from serious harm). Effective immediately.
Proposes to amend the Legislature Article of the Illinois Constitution. Provides that the Senate by resolution (instead of the General Assembly by law) shall divide the Legislative Districts into 3 groups for the election of Senators. Provides that Legislative and Representative Districts shall maximize majority-minority districts and minimize districts that cross county or municipal boundaries (as well as be compact, contiguous, and substantially equal in population). Provides that Representative Districts need not be entirely within Legislative Districts. Provides that, on the third Tuesday in February in the year following each Federal decennial census year, a Temporary Redistricting Advisory Committee shall be appointed by the legislative leaders, with a fifth member elected by the appointed members. Sets qualifications. Provides for the Committee to redistrict the Representative, Legislative, and Congressional Districts in consultation with a Redistricting Consulting Firm procured by the Committee. Sets up a time table for submission of plans and adoption by resolution supported by two-thirds of the members. Provides for second and third plans if a plan is not adopted, with the Supreme Court, by a two-thirds majority, making a final decision if necessary. Makes other changes. Effective upon being declared adopted.
Amends the Election Code, the General Assembly Compensation Act, and the Legislative Commission Reorganization Act of 1984. Changes the date of the general primary election from the first Tuesday in February of even-numbered years to the last Tuesday in May of even-numbered years. Makes conforming changes with respect to (i) filing of declarations of judicial retention and (ii) printing and mailing of legislators' newsletters and brochures.
Amends the Department of Healthcare and Family Services Law of the Civil Administrative Code of Illinois. Provides that any additional federal moneys received by the State under an economic stimulus plan for purposes of implementing the medical assistance program under the Illinois Public Aid Code, whether those moneys are received in the form of a direct cash grant or in the form of an enhanced federal match rate, shall be used to pay for obligations already incurred by the State under the medical assistance program, except to the extent that such use may be prohibited by the terms of the additional federal funding. Effective immediately.
Amends the State Budget Law of the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the Governor's submission of the State budget.
