Amends the Prevailing Wage Act. Provides a process for investigation into violations of the Prevailing Wage Act. Provides that the process starts with a complaint to be filed within 30 days of the alleged violation. Provides a $5,000 fine for knowingly filing a false complaint, or record or statement material to a false or fraudulent complaint. Provides a procedure for a response from a contractor or subcontractor. Provides a procedure for the Director of Labor in issuing a decision. Allows a party to request a hearing within 15 days of receiving notice of the Director's decision. Provides that a final order issued by the Director of Labor in relation to this investigation process is subject to judicial review under the Administrative Review Law. Effective immediately.

Amends the Corporate Accountability for Tax Expenditures Act. Provides that, for certain programs based on job creation or retention, beginning in 2007 and through 2011, a recipient shall be deemed in compliance with those job creation or job retention requirements by establishing that it has created or maintained the requisite number of jobs based on a 3-year average, including the current reporting year and the 2 immediately preceding reporting years. Effective immediately.
Amends the Attorney General Act. Requires that the Attorney General appoint a Special Assistant Attorney General to represent a State agency if: (i) the State agency requests that the Office of the Attorney General represent the State agency and (ii) the acceptance of the request for representation by the Office of the Attorney General creates a concurrent conflict of interest as to that matter. Provides that a Special Assistant Attorney General has the sole duty to represent the State agency in the matter in which he or she was appointed to serve as the Special Assistant Attorney General. Defines "State agency". Effective immediately.
Amends the State Finance Act. Repeals a Section of the Act that allows the Governor to reduce certain funds appropriated for statutory mandates for the purpose of accommodating budgetary limitations. Effective immediately.
Amends the Code of Criminal Procedure of 1963. Adds the State's Attorney's Investigative Subpoenas Article to the Code. Provides that at any time prior to the commencement of a prosecution and upon written application by the State's Attorney, the circuit court shall cause the clerk of the court to issue subpoenas ad testificandum or duces tecum directed to the sheriff or coroner of any county in the State for the purpose of obtaining the testimony of any person or any document or material relevant to a criminal matter being investigated by the State's Attorney. Establishes procedures under which the State's Attorney may apply for the issuance of such subpoenas. Provides that the State's Attorney shall promptly provide a complete transcript or electronic recording of all testimony taken pursuant to a subpoena issued under this Article to the court that issued the subpoena. Provides for disclosure of the existence of the subpoena issued or materials obtained pursuant to the Article to an attorney representing a person or other entity subpoenaed. Provides that the Attorney General, in cooperation with the Illinois State's Attorney Association, shall annually provide a course of training to the State's Attorneys, in the legal, ethical, and practical aspects of the provisions of the Article relating to investigation and prosecutorial functions. Effective immediately.

Amends the AIDS Confidentiality Act. Provides that the identity of any person upon whom an HIV test is performed, and the results of such a test in a manner which permits identification of the subject of the test may be disclosed to a court in accordance with the provisions of the statute concerning the offense of criminal transmission of HIV. Amends the Criminal Code of 1961 concerning criminal transmission of HIV. Requires the defendant to have the specific intent to commit the offense. Requires the defendant to know that he or she is infected with HIV. Changes an element of the offense from engaging in intimate contact with another to engaging in sexual activity with another without the use of a condom when the defendant knows that he or she is infected with HIV. Provides that a prosecuting entity may issue a subpoena duces tecum for the records of a person charged with the offense of criminal transmission of HIV or a subpoena for the attendance of a person with relevant knowledge thereof so long as the return of the records or attendance of the person pursuant to the subpoena is submitted initially to the court for an in camera inspection. Provides that only upon a finding by the court that the records or proffered testimony are relevant to the pending offense, the information sought by the subpoena shall be disclosed to the prosecuting entity and admissible if otherwise permitted by law. Effective immediately.
