Amends the Unified Code of Corrections. Provides that if a facility of the Department of Corrections maintains a commissary or commissaries serving employees of the Department, the selling price for all goods shall be sufficient to cover the costs of the goods and an additional charge of from 3% to 10%. Effective immediately.

Amends the Counties Code. Provides that a county board may charge a fee to a party requiring the use of or causing the use of a technical rescue team to recover personnel, expendables, and equipment costs.
Creates the Wooded Land Assessment Task Force concerning the assessment of wooded land and property under forestry management programs. Urges the Department of Revenue to accept the reduced valuation of certain wooded land for the 2006 and 2007 taxable years.
Amends the State Finance Act. Makes a technical change in a Section concerning the State Pensions Fund.
Amends the School Code. Provides that for elementary school students who are in a State-approved transitional bilingual education program or transitional program of instruction, the time allotted to take State tests may be extended as determined by the State Board of Education by rule.
Amends the Illinois Governmental Ethics Act. Eliminates the requirement the county clerk must notify a person when his or her statement of economic interests is examined. Effective immediately.
Amends the Statute on Statutes. Defines the terms "person", "human being", "child", and "individual" to include every infant member of the species homo sapiens who is born alive at any stage of development. Defines "born alive" to mean the complete expulsion or extraction from the mother of an infant, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut and regardless of whether the expulsion or extraction occurs as a result of natural or induced labor, cesarean section, or induced abortion. Provides that nothing in these definitions shall be construed to affirm, deny, expand, or contract any legal status or legal right applicable to any member of the species homo sapiens at any point prior to being born alive.
Amends the School Code. In provisions concerning the compilation of average daily attendance under the State aid formula, makes changes concerning the days when the Prairie State Achievement Examination is administered. Effective July 1, 2005.
Creates the Health Care Setting Violence Prevention Act. Requires health care settings, including hospitals, mental health evaluation and treatment facilities, community mental health programs, home health agencies, and hospice programs, by July 1, 2006, to adopt and implement a plan to reasonably prevent and protect employees from violence at the setting. Requires a health care setting to file copies of its plan, and copies of changes to the plan, with the Department of Labor and the Department of Human Services. Requires a review of the plan at least once every 3 years. Requires health care settings to provide violence prevention training to employees by July 1, 2007. Requires health care settings to keep records of violent acts against an employee, a patient, or a visitor and to forward copies of such records to the Department of Labor and the Department of Human Services. Provides for enforcement of the Act by the Department of Labor, and authorizes the Director of Labor to issue an order for correction to a health care setting fixing a time for abatement of a violation. Amends the Illinois State Auditing Act. Requires that the Auditor General's audits of certain mental health and developmental disabilities facilities under the jurisdiction of the Department of Human Services include their records concerning reports of suspected abuse of facility staff by facility residents or patients. Effective immediately.
Amends the Illinois Educational Labor Relations Act. Provides that, if a collective bargaining agreement that includes a fair share clause expires or continues in effect beyond its scheduled expiration date pending the negotiation of a successor agreement, then the employer shall continue to honor and abide by the fair share clause until a new agreement that includes a fair share clause is reached. Provides that failure to honor and abide by the fair share clause for the benefit of any exclusive representative shall be a violation of the duty to bargain and an unfair labor practice. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
