Amends the Harassing and Obscene Communications Act. Increases from a Class 4 felony to a Class 3 felony any violation of the Act if, in the course of the offense, the offender threatened to kill the victim or any member of the victim's family or household.
Amends the Illinois Vehicle Code. Provides that whenever a driver of the motor vehicle is involved in a motor vehicle accident resulting in personal injury to a pedestrian with 500 feet of the entrance to a school, place of worship, child care institution, or hospital, and the driver is guilty of any offense against laws and ordinances regulating the movement of traffic for the same conduct, the minimum fine for the first offense is $250. Provides that for a second or subsequent violation, the minimum fine is $750, and the Secretary of State may suspend the a operator's driver's license for 90 days. Effective January 1, 2010.
Amends the State Finance Act. Provides that no appropriations from the Road Fund may be made to any State agency (other than the Secretary of State, Department of State Police, and Department of Transportation) or the Court of Claims in FY10 or thereafter. Provides that no further transfers may be made from the Road Fund or the State Construction Account Fund to the General Revenue Fund. Effective immediately.
Amends the Illinois Vehicle Code. Defines "populated area" as all territory inside the boundaries and all territory that is 5 miles outside the boundaries, in any direction, of a city, village, or incorporated town with a population of 50,000 or more, and defines "non-populated area" as territory not included in a populated area. Provides that, in a non-populated area, unless some other speed restriction has been established under the Code, the maximum speed limit outside an urban district for any vehicle weighing over 8,000 pounds is 65 miles per hour (instead of 55 mph). Provides that the maximum speed limit for busses outside an urban area is 55 mph in a populated area and 65 mph in a non-populated area (instead of various speed restrictions from 55-65 mph based on whether the highway was under the jurisdiction of the Illinois Toll Authority). Provides that language providing that the Department of Transportation may not alter the speed limits on an access-controlled highway to exceed 55 miles per hour for vehicles of the second division weighing 8,001 pounds or more applies only in a populated area. Effective January 1, 2010.
Amends the Code of Civil Procedure. Deletes language providing that an action may be commenced in any county if all defendants are nonresidents of the State, and replaces it with language providing that if no defendants that are joined in good faith and with probable cause for the purpose of obtaining a judgment against them are residents of the State, an action may be commenced only in the county in which the transaction or some part thereof occurred out of which the cause of action arose. Makes various changes in provisions defining the residence of certain corporations, voluntary unincorporated associations, and partnerships. Deletes language providing that actions against an insurance company incorporated under the laws of this State or doing business in this State may be brought in any county in which the plaintiff or one of the plaintiffs resides. Provides that if no defendants are residents of this State, and the transaction, or some part thereof, out of which the cause of action arose did not occur in this State, the action must be dismissed for lack of proper venue. Makes changes in relation to motions claiming improper venue. Provides that the changes made by the amendatory Act apply to actions filed on or after its effective date. Effective immediately.
Amends the Covering ALL KIDS Health Insurance Act. In the provision concerning eligibility, adds the requirement that a person must be a child who has a household income equal to or less than 300% of the federal poverty guidelines. Provides that a child who is determined to be eligible shall remain eligible for 12 months, provided that the child has not gained access to affordable employer-sponsored dependent health insurance. Provides that the parent, guardian, or legal custodian of an enrolled child shall report promptly those changes in income and other circumstances that affect eligibility within 30 days after the occurrence of the change. Provides that the eligibility of a child may be redetermined based on the information reported or may be terminated based on the failure to report or failure to report accurately.
Amends the Higher Education Student Assistance Act. Provides that in order to increase the number of nurses who work or specialize in the area of women's health care graduating from approved institutions, requires the Illinois Student Assistance Commission to establish and administer a tuition assistance program for students accepted for enrollment at approved institutions or for advanced training in the nursing profession in the field of women's health at approved institutions. Requires applicants to have an immediate financial need for the tuition assistance and to be full-time students. Provides that it shall be lawful to condition the tuition assistance upon the recipient's executing an agreement with the Commission to commit at least 5 years of his or her professional career to working in the area of women's health care. Effective immediately.
Amends the Code of Civil Procedure. Provides that, if none of the parties joined in good faith as defendants in a civil case are residents of this State, an action against those defendants may be commenced in the State only in the county in which the transaction out of which the cause of action arose, or some part of that transaction, occurred. Provides that a corporation organized under the laws of or authorized to do business in this State is a resident only of any county in which it has its registered office or other office (rather than being a resident of any county in which it does business). Makes similar changes regarding partnerships and voluntary unincorporated associations. Deletes language providing that an insurance company incorporated under the laws of, or doing business in this State may be sued in any county in which the plaintiff or one of the plaintiffs reside. Provides that, if none of the defendants in a civil action are residents of this State, and no part of the transaction out of which the action arose occurred in this State, the action must be dismissed for lack of proper venue. Makes other changes. Provides that the changes apply to causes of action filed on or after the effective date of the Act. Effective immediately.

Creates the Ultrasound Opportunity Act. Provides that a facility that performs abortions may not perform an abortion on a woman without first offering the woman an opportunity to receive and view an active ultrasound of her unborn child at the facility or at a facility listed in a listing of local ultrasound providers provided by the facility. Sets forth requirements for the ultrasound image. Requires that the woman's response to the offer be documented. Requires the Department of Public Health to prepare an annual reporting form for facilities that perform abortions, and sets forth information that must be collected. Provides that the requirements under this Act shall not apply when, in the medical judgment of the physician performing or inducing the abortion based on the particular facts of the case before him or her, there exists a medical emergency.
