Creates the Affordable Health Care Act and amends the Medical Practice Act of 1987. Provides that the Affordable Health Care Act applies to and governs all health care agreements between a patient and a health care provider that (A) voluntarily limit economic damages or non-economic damages arising out of (i) injuries alleged to have been received by a person as the result of medical negligence, or (ii) the death of a person, due to alleged medical negligence of a health care provider or (B) contractually obligate the plaintiff in a medical negligence lawsuit to pay the defendants' reasonable legal fees, including costs and expenses, if the lawsuit fails to establish liability on the part of the defendants. Sets forth conditions to which health care agreements are subject, and requires that such agreements contain a notice to patients. Provides for the termination of health care agreements. Provides that no patient with an emergency medical condition shall be asked to enter into a health care agreement until after stabilization of the patient's condition. Prohibits certain types of threats to health care providers, and makes a violation of those provisions a Class A misdemeanor. Provides that a health care agreement that complies with the Affordable Health Care Act does not violate the provisions of the Medical Practice Act of 1987 concerning certain prohibited contracts or agreements and is not void or against the public policy of the State of Illinois.

Amends the General Obligation Bond Act and Build Illinois Bond Act. Removes provisions authorizing the sale of bonds by negotiated sale. Eliminates certain provisions relating to compliance with the competitive request for proposal process set forth in the Illinois Procurement Code. Effective immediately.
Amends the State Employees Group Insurance Act of 1971. Permits an employee to switch to a different health insurance program after the annual benefits choice period if a health care provider with whom the employee has a long-term relationship transfers from one program to another program after the Director of Central Management Services has submitted the final program contracts before the benefits choice period. Effective immediately.
Amends the Illinois Pension Code. Requires the General Assembly Retirement System, the State Employees' Retirement System of Illinois, the State Universities Retirement System, the Teachers' Retirement System of the State of Illinois, and the Judges Retirement System of Illinois to allow employees to elect to participate in a self-managed program of retirement benefits instead of the program of retirement benefits currently offered. Provides that a self-managed plan shall authorize a participating employee to accumulate assets for retirement through a combination of employer and employee contributions that may be invested at the employee's direction in mutual funds, collective investment funds, or other investment products and used to purchase annuity contracts. Provides that, to the extent that the changes made by the amendatory Act are determined to be a new benefit increase, the changes are exempt from the 5-year expiration provision. Effective immediately.
Amends the School Code. Provides that after June 1, 2010 persons may not be nominated for General Assembly scholarships and that General Assembly scholarships may not be awarded after that date unless the nomination is made prior to that date. Prevents both second nominations for any lapsed General Assembly scholarship and nominating persons to the unused or unexpired parts of any vacated General Assembly scholarship after June 1, 2010. Effective immediately.
Amends the State Officials and Employees Ethics Act. Requires that summary reports of investigations be delivered to the Executive Ethics Commission. With respect to all reports of the Office of an Executive Inspector General, removes the requirements that they are confidential, are exempt from disclosure under the Freedom of Information Act, and may not be divulged except to certain persons and agencies (now, these requirements apply to reports other than quarterly reports). Specifies that personal information must be redacted from investigatory reports, including summary reports of investigations, and quarterly reports before the reports are disclosed under the Freedom of Information Act. Effective immediately.
Proposes to amend the Legislature Article of the Illinois Constitution. Prohibits a Representative from serving more than 5 consecutive terms from the same Representative District. Prohibits a Senator from serving more than 3 consecutive terms from the same Legislative District. Prohibits a person who has served the maximum number of consecutive terms from serving another term in the same office from the same district until after the expiration of at least the next 2 terms. Effective upon being declared adopted, and applies to terms beginning on or after the second Wednesday in January 2011.
Amends the Right to Privacy in the Workplace Act. Repeals provisions restricting the use of Employment Eligibility Verification Systems which were added by Public Act 95-138. Effective immediately.
Creates the Stopgap Health Insurance Act. Contains the short title provision only.
Urges the President of the United States, the President of the Senate and the Speaker of the House of Representatives of the United States, and the legislative leaders of each State's legislature in the United States to cease and desist, effective immediately, any and all mandates that are beyond the scope of their constitutionally delegated power.
