Amends "An Act concerning appropriations", Public Act 95-731. Restores appropriations to the Department of Natural Resources that were reduced or vetoed by the Governor. Effective immediately.
Creates the Identity Protection Act. Prohibits a State or local government agency from using an individual's social security number in certain ways, subject to various exceptions. Requires each State or local government agency to develop and implement an identity protection plan. Provides that any employee of a State or local government agency who intentionally violates the provisions of the Act is guilty of a Class B misdemeanor. Preempts the concurrent exercise of home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.
Declares May 12, 2008 as Fibromyalgia Awareness Day in the State of Illinois.
Amends the Smoke Free Illinois Act. Provides that smoking is allowed in Veterans' halls and clubs. Effective immediately.
Amends the Illinois Procurement Code. Provides that State officers and employees prohibited from obtaining State contracts may not receive legal, banking, consulting, or other fees related to State government bond issuances. Prohibits waivers from the prohibition. Prohibits State contractors with contracts with an annual aggregate value of more than $25,000 from making political contributions to the executive branch constitutional officers responsible for awarding the contracts. Establishes penalties for violations. Requires that each State contract bid or offer in excess of $10,000 annual value must be accompanied by a disclosure of the bidder's or offeror's political contributions to the executive branch constitutional officer responsible for awarding the contract. Authorizes the State Comptroller to refuse payments under contracts for which those disclosures were not made. Makes other changes.
Amends the Environmental Protection Act. Provides that, at least twice per calendar year, and more frequently if determined necessary by the Environmental Protection Agency, the operator of a filling station or motor-vehicle repair shop must wash or cleanse all vehicular-use areas of the facility to remove any and all residue, stains, or other matter remaining from oil spills and other spilled materials. Requires the operator to provide a positive mechanism to prevent the wash water or waste water from leaving the facility or discharging into any sewer system. Requires the operator to maintain records concerning the washing. Effective immediately.
Amends the Children and Family Services Act. Provides that if (i) a child is found to be an abused minor under the Juvenile Court Act of 1987, (ii) the perpetrator of the abuse was the child's parent, (iii) the parent was convicted of aggravated participation in methamphetamine manufacturing, and (iv) the child who has been found to be an abused minor was the child who resided or was present at the place where the methamphetamine was manufactured or was endangered by the manufacture of the methamphetamine, then the Department of Children and Family Services shall cause to be filed a petition seeking termination of the parent's parental rights. Amends the Juvenile Court Act of 1987 to provide that conviction of a person of aggravated participation in methamphetamine manufacturing under similar circumstances is an aggravating circumstance under which it may be appropriate to expedite termination of the person's parental rights. Amends the Adoption Act add similar provisions with respect to depravity as a ground of unfitness and with respect to the definition of "abused child".
Amends the Children's Mental Health Act of 2003. Makes a technical change in a Section concerning a children's mental health plan.
Amends the Railroad Police Act. Requires allegations of abuse of authority or misconduct by members of a railroad police force to be investigated by the Illinois State Police. Amends the Illinois Vehicle Code. Exempts elected representatives of rail employers from the restrictions concerning trespassing on railroad property. Provides that the listed persons shall be exempt from the restrictions while performing required duties in accordance with reasonable rail carrier company guidelines, engaging in safety inspections, or exercising a right under the federal Railway Labor Act (instead of only while performing required duties in accordance with reasonable rail carrier company guidelines).
Amends the School Code. With respect to the Early Childhood Education Block Grant, provides that not less than 11% (instead of exactly 11%) of the grant shall be used to fund programs for children ages 0-3. Provides that this percentage shall increase to at least 20% by Fiscal Year 2014, except that if, in a given fiscal year, the amount appropriated for the Early Childhood Education Block Grant is insufficient to increase the percentage of the grant to fund programs for children ages 0-3 without reducing the amount of the grant for existing providers of preschool education programs, then the percentage of the grant to fund programs for children ages 0-3 may be held steady instead of increased. Effective July 1, 2008.
