Amends the Downstate Police Article of the Illinois Pension Code. In provisions concerning recovery from disability, provides that the police officer shall report to the chief of the department, who shall thereupon order immediate reinstatement into active service, and the municipality shall immediately return the police officer to its payroll, in the same rank or grade held at the date he or she was placed on disability pension. Provides that, if the police officer must file a civil action against the municipality to enforce his or her mandated return to payroll, then the police officer is entitled to recovery of reasonable court costs and attorney's fees. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the State Finance Act. Provides that, if a municipality or county prohibits video gaming pursuant to the Video Gaming Act, then (i) capital projects and the payment of debt service on bonds issued for capital projects within the municipality or county may not be funded from proceeds of video gaming that are deposited into the Capital Projects Fund and (ii) the proceeds of video gaming that are deposited into the Capital Projects Fund may not be used for the purpose of paying and discharging the principal and interest on bonded indebtedness for bonds issued for capital projects within the municipality or county. Effective immediately.
Urges the U.S. Congress to postpone the U.S. Environmental Protection Agency's effort to regulate greenhouse gas emissions from stationary sources under the authority of the Clean Air Act.
Amends the State Finance Act, State Property Control Act, Illinois Vehicle Code, Snowmobile Registration and Safety Act, and Boat Registration and Safety Act. Creates the Conservation Police Vehicle Fund as a special fund in the State treasury and provides that all moneys in the fund shall be used, subject to appropriation, by the Department of Natural Resources for the acquisition of new or replacement vehicles, watercraft, and snowmobiles for the Conservation Police. Provides for surcharges on violations issued by the Conservation Police ($20 for each violation), snowmobile registration ($2 per registration), and watercraft registration (ranging from $1 to $5 per registration) to be deposited into the Conservation Police Vehicle Fund.

Creates the Crossing of Railroad Right-of-way Act. Applies only to crossings of a railroad right-of-way that is owned by a land management company and not a registered rail carrier. Provides that public utilities that locate their facilities within the railroad right-of-way for a crossing shall pay the land management company a one-time standard crossing fee of $1,500 for each crossing. Provides special circumstances under which the standard crossing fee is not imposed. Provides that, if the parties cannot agree that special circumstances exist, the dispute shall be submitted to non-binding arbitration. Provides procedures for the non-binding arbitration and provides that, if the parties cannot resolve their dispute based on the arbitrator's recommendation within 30 days, either party may, upon the expiration of the 30-day period, give written notice to the other party of the commencement of a binding arbitration proceeding. Effective immediately.
Amends the Riverboat Gambling Act. Provides that, if the licensed owner of a riverboat in operation on January 1, 2009 has a capital project of at least $75,000,000 that is approved by the Illinois Gaming Board in calendar years 2006 through 2009, then no admissions tax is imposed on admissions to that riverboat. Provides that, if no admissions tax is imposed on admissions to a riverboat, then in addition to the current privilege tax, a privilege tax of 1% of adjusted gross receipts is imposed on that riverboat, the proceeds of which shall be paid monthly to the unit of local government that is designated as the home dock of the riverboat upon which those riverboat gambling operations are conducted. Effective immediately.
