SCHOOLS-DAY CARE-RADON TESTING

Amends the School Code and the Child Care Act of 1969. Provides that each school board shall require that all schools annually test for the presence of radon. Requires a licensed day care center to annually test for the presence of radon.

DHS-DRUG OVERDOSE PREVENTION

Amends the Alcoholism and Other Drug Abuse and Dependency Act. Provides that the Director of the Division of Alcoholism and Substance Abuse within the Department of Human Services may publish an annual report on statewide drug overdose trends, may establish a program to provide for the publication of drug overdose prevention, recognition, and response literature, may provide advice to State and local officials concerning drug overdose problems, and may award grants to create or support local drug overdose prevention, recognition, and response projects. Requires a health care professional prescribing an opioid antidote to a patient to ensure that the patient receives certain patient information; provides for immunity from disciplinary or other adverse administrative action; and provides for administration of an opioid antidote in an emergency. Requires the Director of the Division of Alcoholism and Substance Abuse, in consultation with statewide organizations, to develop and disseminate to health care professionals, community-based organizations, substance abuse programs, and other organizations training materials in video, electronic, or other formats to facilitate the provision of the required patient information. Effective January 1, 2010.

PROP TX-NOTICE/APPEALS

Amends the Property Tax Code. For counties under 3,000,000 inhabitants, sets forth specific items that must be included in the notice sent to taxpayers whose assessment has changed. Requires disclosure of information concerning access to databases containing the physical characteristics of the property. Requires the board of review in those counties to make its rules and procedures publicly available, and requires the chief county assessment officer to provide a plain-English explanation of equalization factors. Effective January 1, 2010.

INC TX-TUITION SAVINGS REFUND

Amends the Illinois Income Tax Act. Requires an addition modification to base income of an amount equal to the contribution component of any nonqualified withdrawal or refund from a tuition savings program that was previously deducted from base income and that did not result from the death or disability of the beneficiary. Effective immediately.

PROCUREMENT DISABLED VETERANS

Amends the Illinois Procurement Code. Requires that a preference equal to 10% of the contract amount be granted to an otherwise qualified State contract bidder that is a qualified disabled veteran. Defines a qualified disabled veteran as a business entity 51% or more owned by one or more disabled veterans. Sets as a goal that each fiscal year the State award at least 3% of the value of its total contracts to qualified disabled veterans. Requires that the Department of Central Management Services report annually to the General Assembly on the attainment of the percentage goal, based on information reported by chief procurement officers. Requires chief procurement officers to make recommendations on the percentage goal, with input from statewide veterans' service organizations and the business community. Requires the Governor to recommend to the General Assembly changes in programs to assist qualified disabled veterans.

CD CORR-MILITARY VETERANS

Amends the Unified Code of Corrections. Provides that before the sentencing hearing and as part of the presentence investigation, the court shall inquire of the defendant whether the defendant is currently serving in or is a veteran of the Armed Forces of the United States. Provides that if the defendant is currently serving in the Armed Forces of the United States or is a veteran of the Armed Forces of the United States and has been diagnosed as having a mental illness by a qualified psychiatrist or clinical psychologist or physician, the court may: (1) order that the officer preparing the presentence report consult with the United States Department of Veterans Affairs, Illinois Department of Veterans' Affairs, or another agency or person with suitable knowledge or experience for the purpose of providing the court with information regarding treatment options available to the defendant, including federal, State, and local programming; and (2) consider the treatment recommendations of any diagnosing or treating mental health professionals together with the treatment options available to the defendant in imposing sentence.

VEH CD-DISABLED PARKING

Amends the Illinois Vehicle Code. Provides that a special parking decal or device for a person with disabilities may be used by the authorized holder, rather than the special parking decal or device being the property of the person with disabilities. Removes language concerning the revocation or suspension of a person's driving privileges and revocation of disability license plates or parking decals or devices for violation of provisions concerning the unauthorized use of parking places reserved for persons with disabilities because similar language appears elsewhere in those provisions. Provides that a police officer may seize the parking decal or device from any person who commits a violation of the unauthorized use of parking places reserved for persons with disabilities provision, may request that the Secretary of State revoke the parking decal or device or the disability license plate of any person who commits a violation of that provision, and may seize the disability license plate upon authorization from the Secretary of State.

VEH CD-SCHOOL ZONES-SURCHARGES

Amends provisions of the Illinois Vehicle Code setting forth the school safety purposes for which surcharges imposed for certain violations of the special school zone speed limit may be used by school districts. Provides that those purposes include the Safe Routes to School Program and safety programs within the School Safety and Educational Improvement Block Grant Program (in addition to the existing purposes of school zone safety education and the purchase, installation, and maintenance of caution lights mounted on school speed zone signs). Effective immediately.
