Amends the Criminal Code of 1961. Provides that in cases of involuntary manslaughter when the victim was 12 years of age or younger, the penalty is a Class 2 felony for which the defendant may be sentenced to a term of imprisonment of not less than 3 years and not more than 14 years.

Amends the Ticket Scalping Act. Provides that any term or condition of the original sale of a ticket to any theater, circus, baseball park, or place of public entertainment or amusement where tickets of admission are sold that purports to limit the terms or conditions of resale of the ticket (including but not limited to the resale price of the ticket) shall be unenforceable, null, and void, if the resale transaction is carried out under certain specified conditions. Provides that the Act does not apply to the sale of tickets of admission to a sporting event, theater, musical performance, or place of public entertainment or amusement of any kind for a price in excess of the printed box office ticket price by a seller engaged in interstate or intrastate commerce on an Internet Auction Listing Service duly registered with the Illinois Office of Banks and Real Estate under the Auction License Act. Provides that the Act does not apply to the sale of tickets of admission to a sporting event, theater, musical performance, or place of public entertainment or amusement of any kind for a price in excess of the printed box office ticket price conducted at an auction solely by or for a not-for-profit organization for charitable purposes.
Amends the Illinois Municipal Code. Provides that when a police officer of a municipality with a population greater than 500,000 inhabitants requests aid or assistance from or provides aid or assistance to a police officer of another jurisdiction, the unit of local government on whose behalf the request is made shall hold harmless, indemnify, and defend the police officer against all claims, demands, liability, losses, and suits in law or equity made by a third party unless otherwise agreed. Provides that the unit of local government requesting assistance shall waive all claims against the police officer or his or her employer arising out of the aid or assistance that is provided, other than claims resulting from willful and wanton misconduct. Provides that the new provisions do not relieve any unit of local government from liability. Amends the Code of Criminal Procedure of 1963. Provides that a peace officer may conduct temporary questioning and make arrests in any jurisdiction within this State if the officer, while on duty as a peace officer, is requested by an appropriate State or local law enforcement official to render aid or assistance to the requesting law enforcement agency that is outside the officer's primary jurisdiction.
Amends the Unified Code of Corrections. Provides that a person found not guilty by reason of insanity for certain specified sex offenses or for a violation of the Hypodermic Syringes and Needles Act must undergo medical testing to determine whether the defendant has any sexually transmissible disease, including a test for infection with HIV or or any other identified causative agent of AIDS. Present law requires the mandatory medical testing only for persons who have been convicted of any of these offenses.
Amends the Criminal Code of 1961. Extends the statute of limitations for an offense based upon misconduct in office by a public officer or employee to no more than 6 (rather than 3) years beyond the expiration of the period otherwise applicable. Excludes from the period of limitations any period in which the defendant is a public employee and the offense charged is theft of public funds while in public employment.
Amends the Illinois Vehicle Code. Makes a technical change in a provision concerning special plates for retired members of the General Assembly.
Amends the Unified Code of Corrections. Includes in the requirements of submission of blood, saliva, and tissue samples for analysis and inclusion in the genetic marker grouping analysis database maintained by the Department of State Police a person found not guilty by reason of insanity for certain qualifying offenses or inchoate offenses. Includes in the definition of "qualifying offense" any offense or inchoate offense that is a felony.
Amends the Illinois Public Aid Code. Provides that the Department of Public Aid may not establish any formulary limits on, or restrict by any prior authorization requirement, any insulin prescription drug as prescribed and determined to be medically necessary for the treatment of diabetes. Effective July 1, 2004.
Creates the Comprehensive Housing, Health, and Supportive Services for Older Adults Act and amends the Illinois Health Facilities Planning Act, the State Finance Act, and the Nursing Home Care Act. Requires the Director of Public Health, in coordination with the Director of Aging and the Director of Public Aid, to monitor and analyze the distribution of housing and services for older adults in the different geographic areas of the State and implement corrective action plans by July 1, 2005. Provides for a program for conversion of nursing homes to assisted living or shared housing establishments; makes such conversions exempt from the requirements of the Illinois Health Facilities Planning Act, and provides for transition planning grants to nursing homes making such conversions. Creates special funds in the State treasury for use in implementing the Comprehensive Housing, Health, and Supportive Services for Older Adults Act. Provides for transfers from the Long Term Care Monitor/Receiver Fund to the new Nursing Home Conversion Fund and the new Nursing Home Transition Planning Grant Fund. Makes other changes. Effective immediately.
Amends the Sale of Tobacco to Minors Act. Prohibits the sale of tobacco over the Internet.
