Amends the Elder Abuse and Neglect Act. Expands the list of persons and agencies that shall have access to all records generated as a result of a report of elder abuse, neglect, financial exploitation, or self-neglect to include a law enforcement agency, fire department agency, or fire protection district having proper jurisdiction pursuant to a written agreement between a provider agency and the law enforcement agency, fire department agency, or fire protection district under which the provider agency may furnish to the law enforcement agency, fire department agency, or fire protection district a list of all eligible adults who may be at imminent risk of elder abuse, neglect, financial exploitation, or self-neglect.
Amends the Illinois Vehicle Code. Provides that a person commits distracted driving when he or she violates provisions concerning obedience to traffic-control devices, speed restrictions, or lane usage while engaging in a distracting activity. Provides that the term "distracting activity" includes but is not limited to eating, applying cosmetics, and using a wireless telephone or other electronic communication device. Provides that a person who violates the new provisions is guilty of an offense against the regulations governing the movement of vehicles. Provides that a law enforcement officer may not stop, search, or inspect a motor vehicle, its contents, the driver, or a passenger solely because of a violation or suspected violation of the new provisions. Makes a corresponding change in the Code of Criminal Procedure of 1963.
Amends the Tobacco Accessories and Smoking Herbs Control Act. Makes a technical change in a Section concerning the short title.
Amends the Criminal Code of 1961. Redefines child abduction by luring. Provides that the offense consists of intentionally luring or attempting to lure a child: (1) under the age of 17 (rather than under the age of 16) or (2) while traveling to or from a primary or secondary school into a motor vehicle, building, housetrailer, or dwelling place without the consent of the child's parent or lawful custodian for other than a lawful purpose.
Amends the Unified Code of Corrections. Provides that a prisoner serving a sentence for attempt to commit predatory criminal sexual assault of a child, attempt to commit aggravated criminal sexual assault, attempt to commit criminal sexual assault, or attempt to commit aggravated kidnapping when any of those offenses are committed on or after the effective date of the amendatory Act shall receive no more than 4.5 days of good conduct credit for each month of his or her sentence of imprisonment.
Amends the Court of Claims Act. Provides that the amount of an unjust imprisonment award shall be $85,000 multiplied by the number of years served in prison, expressed as a fraction to reflect partial years, plus any child support arrearage of the claimant resulting from support obligations that arose while the claimant was in prison (instead of a amount at the discretion of the court subject to certain maximums on the award and attorney's fees). Provides that a person who receives such an award may not bring or proceed with any action involving the same subject matter including the person's arrest, conviction, or confinement against the State or other governmental entities or their employees. Provides that any compensation under the provisions concerning unjust imprisonment shall be reduced by any amount received by the person in an award or settlement from any other action brought prior to receiving an award. Provides that the changes made by the amendatory Act apply to claims pending on or filed after the effective date. Effective immediately.
Amends the Unified Code of Corrections. Provides that a parole agent or parole supervisor must receive training in the use of firearms initially at the Illinois Department of Corrections Parole Academy and be certified as having successfully completing the training by the Illinois Law Enforcement Training Standards Board upon graduation of parole training at the Academy. Thereafter, the parole agent or supervisor must successfully complete firearms training required for his or her position with the Department of Corrections. Eliminates provision that the training shall be taken while off-duty. Eliminates requirement that the agent or supervisor must register the firearm with the Department of State Police and with any other local law enforcement agency that requires registration. Effective immediately.
Amends the Illinois Income Tax Act and the Unemployment Insurance Act. Provides that employers with fewer than 25 employees are exempt from paying estimated taxes and may pay their unemployment insurance contributions and submit their wage and contribution reports on an annual basis (instead of quarterly). Effective immediately.
Amends the Illinois Public Labor Relations Act. In the case of peace officers, expands the scope of arbitration to include residency requirements in municipalities of 1,000,000 or more population. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
