MUNI CD ANNEXATION RR UTILITY

Amends the Illinois Municipal Code. Provides that any unincorporated territory containing 60 acres or less may be annexed by any municipality by which it is bounded if it is wholly bounded by one or more municipalities in a county with a population of more than 800,000 inhabitants and less than 2,000,000 inhabitants and either (i) a utility right-of-way that is at least 100 feet wide or (ii) a railroad or operating property, as defined in the Property Tax Code, being immediately adjacent to, but exclusive of the property. Nothing in these provisions shall subject any railroad property to the zoning or jurisdiction of a municipality annexing the territory, nor shall the utility property be included for purposes of calculating the territory annexed. Effective immediately.

ST ATTY-AUTO RECORD FEE

Amends the Counties Code. Authorizes State's Attorneys to collect a $2 fee from defendants found guilty or granted supervision for violation of certain offenses. Provides for a special fund and use of the moneys for records automation.

FIREARM SALES-GUN SHOWS

Amends the Firearm Owners Identification Card Act. Provides that a person who is not a federally licensed firearm dealer and who desires to transfer or sell a firearm while that person is on the grounds of a gun show must, prior to the sale or transfer of the firearm, request the Department of State Police to conduct a background check on the prospective recipient of the firearm. Provides that if the receipt of a firearm does not violate federal or State law, the Department of State Police shall (1) assign a unique number to the transfer; (2) provide the licensee, gun show promoter, or gun show vendor with the number; and (3) destroy all records of the system with respect to the call, other than the identifying number and the date the number was assigned, and all records of the system relating to the person or the transfer within 24 hours. Provides that the Department of State Police may not retain, copy, or distribute any such information previously collected. Provides that if the transfer of a firearm is denied by the Department of State Police, the Department may keep the records of a denial until the denial is appealed and overturned, or as long as necessary for a criminal prosecution. Provides that approvals issued by the Department of State Police for the purchase of a firearm are valid for 30 days from the date of issue. Amends the Criminal Code of 1961. Provides that the waiting period for obtaining a firearm after its purchase does not apply to the sale of a firearm at a gun show. Effective immediately.

Provides that the Department of State Police may not retain, copy, or distribute any such information previously collected. Amends the Criminal Code of 1961. Provides that the waiting period for obtaining a firearm after its purchase does not apply to the sale of a firearm at a gun show. Effective immediately.

TOLL HWY-RTA SUBURBAN BUSES

Amends the Toll Highway Act. Provides that a vehicle owned or operated by the Suburban Bus Division of the Regional Transportation Authority is exempt from tolls for using the toll highways constructed under the Act if the vehicle is being used to transport passengers for hire. Effective immediately.

PUB LABOR-ARBITRATION

Amends the Illinois Public Labor Relations Act. In the case of peace officers, expands the scope of arbitration to include residency requirements in municipalities of 1,000,000 or more. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

CD CORR-SENTENCE CREDIT

Amends the Unified Code of Corrections. Provides that the amount of credit to be applied against a sentence of imprisonment or periodic imprisonment when the defendant served a term or partial term of periodic imprisonment shall be calculated upon the basis of the actual days spent in confinement rather than the duration of the term.

MUNI CD-CHIEF OF POLICE

Amends the Illinois Municipal Code. Provides that the term of office for the chief of police may exceed that of the mayor or president of the municipality. Provides that the chief of police and the chief of the fire department may be removed or discharged from office only for just cause. Requires any candidate for the position of chief of police to be certified as a police officer by the Illinois Law Enforcement Training and Standards Board or hold a valid waiver issued by that Board.

FIREARMS-WAITING PERIOD

Amends the Criminal Code of 1961. Provides that the required waiting period of 24 hours for rifles, shotguns, or other long guns and 72 hours for concealable firearms before delivering a firearm after application for its purchase has been made does not apply to the sale of a firearm to a person known by the seller to be a law enforcement officer (rather than the sale of a firearm to a law enforcement officer). Effective immediately.

CRIM CD-CRIM SEX ASSAULT

Amends the Criminal Code of 1961. Provides that criminal sexual assault also occurs when a person commits an act of sexual penetration with a victim who is under 19 years of age and is still attending high school when the act was committed and the accused was 17 years of age or older and held a position of trust, authority, or supervision at the same high school. Provides that a violation is a Class 1 felony for a first offense and a Class X felony for a second or subsequent offense.
