Amends the Criminal Code of 1961. Provides that a public contractor, employee of a public contractor, or a person seeking a public contract also commits the offense of public contractor misconduct when he or she knowingly or intentionally seeks or receives compensation or reimbursement for goods and services he or she purported to deliver or render, but failed to do so pursuant to the terms of the contract, to the unit of State or local government or school district. Provides that any person convicted of the offense or a similar offense in any state of the United States which contains the same elements of public contractor misconduct shall be barred for 10 years from the date of conviction from contracting with, employment by, or holding public office with the State or any unit of local government or school district. Provides that the Attorney General or the State's Attorney in the county where the principal office of the unit of local government or school district is located may bring a civil action on behalf of any unit of State or local government to recover a civil penalty from any person who knowingly engages in conduct which violates the statute in treble the amount of the monetary cost to the unit of State or local government or school district involved in the violation. Effective immediately.

Amends the Freedom of Information Act. Makes changes with respect to the exemptions from disclosure for personal information of public employees and officials, for the investigation, settlement, and adjudication of public employee grievances or disciplinary cases, and for administrative enforcement and law enforcement records. Permits (now, requires) a court to award reasonable attorney fees and court costs to a person who prevails in a proceeding to enforce disclosure of records. Effective January 1, 2011.
Creates the Crane Operator License Act. Contains only a short title provision.
Amends the State Finance Act to create the Fraternal Order of Police Fund. Amends the Illinois Vehicle Code. Provides for the issuance of Illinois Fraternal Order of Police license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and at renewal. Provides that $10 of the additional original issuance fee and $23 of the renewal fee shall be deposited into the Fraternal Order of Police Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation, the moneys in the Fraternal Order of Police Fund shall be paid as grants to the Illinois Fraternal Order of Police to increase the efficiency and professionalism of law enforcement officers in Illinois, to educate the public about law enforcement issues, to more firmly establish the public confidence in law enforcement, to create partnerships with the public, and to honor the service of law enforcement officers dedicated to the protection of life and property. Effective immediately.
Amends the Criminal Code of 1961. Provides that recording or listening with the aid of any device to incoming telephone calls of phone lines publicly listed or advertised as telephone answering services and utilized by business or professional organizations for such purposes is exempt from an eavesdropping violation. Provides that if such recordings contain information relevant to a criminal investigation, they must be turned over to local law enforcement authorities within 24 hours from the time of such recording or as soon as practicable and shall not be otherwise disseminated. Provides that failure on the part of the individual or business operating any such recording or listening device to comply with these requirements shall eliminate any civil or criminal immunity conferred upon that individual or business by the operation of the eavesdropping exemption provisions. Effective immediately.
Amends the Criminal Code of 1961. Provides that parties to an electronic communication intercepted contrary to the Eavesdropping Article of the Code are entitled to the civil remedies prescribed in that Article.
Amends the Illinois Highway Code and the Illinois Underground Utility Facilities Damage Prevention Act. Provides that after the effective date all fiber-optic network conduit installed as new or replacement underground fiber-optic network conduit pursuant to specified provisions of the Illinois Highway Code must be marked with detectable underground warning tape that is able to be traced by inductive locating. Requires that the marking shall be a minimum of 6 inches and be buried as close to the ground surface as possible, or between 4 and 6 inches deep. Provides that the warning tape shall be American Public Works Association color-coded to match the type of utility line it is protecting.
Amends the School Code. Provides that no district is obligated to comply with any statutory or regulatory mandate or requirement unless a separate appropriation has been enacted into law providing funding for the school year during which such mandate is required. Contains provisions concerning discontinuing or modifying an activity to meet specified requirements. Provides that specified provisions do not apply to special education, transportation, or lunch programs, or coursework required for high school graduation. Effective immediately.
Amends the Criminal Identification Act. With respect to the expungement and sealing of criminal records, makes changes relating to local ordinances, cases involving multiple charges, indexes issued by the circuit court clerk, and cases involving pardons. Effective immediately.
Amends the Public Utilities Act. Provides that all third-party sales representatives engaged in the marketing of retail electricity supply, including exclusive and non-exclusive agents, must, prior to the customer signing a contract, disclose in writing that they are not employed by the electric utility operating in the applicable service territory and, if applicable, that they are compensated in whole or part on a commission basis. Provides that for telephonic solicitations, the disclosure may initially be made verbally prior to the customer signing a contract, with a follow-up written disclosure required prior to any customer contract being finalized. Includes the Illinois Power Agency and its employees from being exempt as being licensed agents, brokers, and consultants engaged in the procurement or sale of retail electricity supply for third parties and changes the requirements of parties already subject to licensure. Provides that any person or entity required to be licensed under specified provisions must, among other requirements, disclose in plain language in writing to all customers, prior to the customer signing a contract, the total anticipated remuneration to be paid to it by any third party over the period of the proposed underlying customer contract. Removes provisions requiring agents, brokers, and consultants to file copies of their verified financial statements with the Commission on an annual basis. Makes changes concerning disciplinary actions against agents, brokers, and consultants. Effective immediately.
