Amends the Community Mental Health Act. Replaces the definition of "person with a developmental disability" with a definition of "developmental disability", and defines that term to mean a disability attributable to mental retardation, cerebral palsy, epilepsy, or autism or to any other condition that results in impairment similar to that caused by mental retardation and that requires services similar to those required by mentally retarded persons, not inconsistent with federal or State definitions. Adds a definition of "direct recipient services". Adds a definition of "mental illness". Removes the definition of "substance abuse" and adds a definition of "substance use disorder", encompassing substance abuse, dependence, and addiction, not inconsistent with federal or State definitions. Makes several changes to the powers of a community mental health board. Provides that a board shall authorize the disbursement of money from the community mental health fund for payment for the ordinary and contingent expenses of the board. Changes the time allowed for the board to publish its annual budget and report from 60 to 120 days after the end of the fiscal year and requires publication in a newspaper distributed within the jurisdiction of the board (instead of a newspaper "published" within the jurisdiction of the board). Provides that the board has the power to establish compensation and set policies for its personnel and may enter into multiple-year joint agreements with federal, State, and local governments. Changes references to "substance abuse" and "substance abuser" to "substance use disorder" and "person with a substance use disorder". Makes other changes. Effective immediately.
Amends the Department of Veterans Affairs Act. Creates the Illinois Discharged Servicemember Task Force. Provides that the Task Force shall investigate re-entry into civilian life for service members who have been engaged in an active theater. Sets forth the membership of the Task Force. Provides that the Task Force shall prepare an annual report for the Governor, the Attorney General, the General Assembly, and the United States Department of Veterans Affairs. Effective immediately.
Amends the School Code. Provides that a board of education may enter into a contract with a third party for non-instructional services currently performed by an employee or bargaining unit member or lay off those educational support personnel employees upon 90 (instead of 30) days written notice. Adds conditions on the entering of such a contract, including providing that: (1) a contract must not be entered into during the term of a collective bargaining agreement; (2) any third party that submits a bid to perform the services shall provide comparable liability insurance, a comparable benefits package, a list of the number of employees who will provide the services and the wages the third party will pay those employees, a minimum 3-year cost projection, and information about the criminal and disciplinary records of the employees; (3) a contract must not be entered into unless the school board provides a cost comparison; (4) a minimum of 2 public hearings to discuss the school board's proposal to contract with a third party must be held; (5) a contract shall contain provisions requiring the contractor to offer available employee positions pursuant to the contract to qualified school district employees whose employment is terminated because of the contract; and (6) a contract shall contain provisions requiring the contractor to comply with a policy of nondiscrimination and equal employment opportunity. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Illinois Public Aid Code. In provisions concerning child care for TANF recipients, provides that in determining income eligibility for child care benefits, the Department of Human Services shall specify an income threshold of no less than 55% (instead of 50%) of the then-current State median income for each family size. Provides that a co-payment for child care services may not exceed 7% of a family's income.
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that the Department may establish and administer a green cities grant program and a smart cities grant program.
Creates the Illinois Food, Farms, and Jobs Act and the Illinois Local and Organic Food and Farm Task Force. Sets out the composition of the Task Force. Provides that the Task Force shall develop a plan for expanding and supporting a State local and organic food system and for assessing and overcoming obstacles to an increase in locally grown food and local organic food production. Sets out the contents of the plan. Amends the State Finance Act to create the Illinois Local Organic Food and Farm Fund. Effective immediately.
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning usury.
Amends the Personnel Code. Grants a State employee subject to the Code who is a veteran 4 days of leave per year (in addition to any currently available sick leave) to visit a veterans hospital for examination of a military service-connected disability (now, 2 days per year).
Creates the Employee Classification Act. Provides that an individual performing services for a contractor is deemed to be an employee of the employer. Provides that an individual performing services for a contractor is deemed to be an employee of the contractor unless it is shown that: (1) the individual has been and will continue to be free from control or direction over the performance of the service for the contractor, both under the individual's contract of service and in fact; (2) the service performed by the individual is outside the usual course of services performed by the contractor; and (3) the individual is engaged in an independently established trade, occupation, profession or business; or (4) the individual is deemed a legitimate sole proprietor or partnership. Provides that subcontractors or lower tiered contractors are subject to all provisions of the Act. Provides that he Department of Labor shall post a summary of the requirements of this Act in English, Spanish, and Polish on its official web site and on bulletin boards in each of its offices. Provides that it is a violation of the Act for an employer or entity not to designate an individual as an employee under the Act unless the employer or entity satisfies the provisions of the Act. Provides for civil remedies and civil penalties. Amends various Acts to make conforming changes. Effective January 1, 2008.
