CRIM CD-OBSTRUCTING JUSTICE

Amends the Criminal Code of 1961. Provides that it is not a required element of obstructing justice that the conduct defining the offense actually or materially prevents the apprehension of, or actually or materially obstructs the prosecution or defense of, any person.

QUASI-CRIM&MISDEMEANOR BAIL

Amends the Quasi-criminal and Misdemeanor Bail Act. Provides that in any case which does not require a court appearance under Supreme Court Rule, upon a plea of guilty the amounts of fines, fees, costs, and penalties for the offense shall be in the amount mandated by statute or by local ordinance enacted pursuant to statute. Provides that no rule or order of the Supreme Court shall alter these amounts. Provides that any circuit clerk or deputy circuit clerk is authorized to receive written appearances, pleas of guilty, and waivers of trial and to accept payments in satisfaction of the judgment entered upon the plea.

PEN CD-CHI POLICE-ANNUAL INCR

Amends the Chicago Police Article of the Illinois Pension Code. Provides that, beginning on January 1, 2012, for certain policemen born on or after January 1, 1955, automatic annual increases in retirement annuity shall be 3% and such policemen shall not be subject to the 30% maximum increase. Also makes a technical change. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

CIV PRO-FORC ENTRY-TENANT INFO

Amends provisions of the Code of Civil Procedure setting forth the required contents of a forcible entry and detainer complaint. Adds language requiring a complaint filed in a county with a population of 3,000,000 or more to state, if known to the parties entitled to the possession of the premises: the name of each known occupant of the premises, along with each known occupant's date of birth and, if the actual date of birth is unknown, whether a known occupant is known to be younger than 18 years of age or 65 years of age or older; and whether a known occupant has a disability, as defined by the Disabilities Services Act of 2003, but only to the extent that the occupant has self-reported the disability to the person claiming possession. Provides that the failure to comply with the requirement to provide such information shall not affect the validity or the legal effect of any complaint or of any order or judgment entered in the action. Provides that the changes made by the amendatory Act do not apply to specified public housing programs. Effective immediately.

INDIGENT BURIAL PROTECTION

Amends the Missing Persons Identification Act. Provides that the coroner or medical examiner shall obtain a DNA sample from any individual's remains that are unclaimed or from any individual who is deemed indigent by the coroner or medical examiner and shall have the DNA sample forwarded to the Department of State Police for inclusion in the State and National DNA Databases. Amends the Cemetery Oversight Act. Provides that prior to the burial or interment of any indigent or unidentified individual, a cemetery authority must place inside the burial casket or crypt a metal tag that is stamped or inscribed with the indigent or unidentified individual's Unique Personal Identifier. Prohibits the stacking of caskets in one grave space to 3 caskets for indigent or unidentified individuals. Provides that a cemetery authority shall not bury human remains from multiple persons, identified or unidentified, in the same casket or gravespace, except in cases of a mass casualty event, either natural or man-made. Provides that the Department of Financial and Professional Regulation may enter into a written agreement with a local law enforcement agency or county sheriff's department for the purpose of enforcing provisions of this Act. Permits local law enforcement agencies or county sheriff's departments that have entered into an agreement with the Department shall have the authority to issue citations for the violations of this Act that may be adjudicated in a circuit court that has jurisdiction or by a hearing officer designated by the Secretary. Amends the Vital Records Act. Provides an additional $1 surcharge for each certified copy of a death certificate produced by a local registrar or county clerk to be deposited into the counties general fund for medical examiners and coroners to provide DNA samples of indigent or unidentified human remains. Effective immediately.

OIL & GAS ACT-SHALE-FRACKING

Amends the Illinois Oil and Gas Act. Provides that the Director of Natural Resources shall adopt rules that require, prior to such hydraulic fracturing, the owner or operator to perform a suitable mechanical integrity test of the casing or of the casing-tubing annulus or other mechanical integrity test methods using procedures that are established by administrative rule. Provides that each owner or operator that begins extracting natural gas from shale shall report to the Department specified information within 30 days after the completion of all stages of the hydraulic fracturing stimulation. Requires that the owner or operator shall post the chemical disclosure information on certain specified websites. Provides that the owner or operator shall provide information to the Director as to the amounts, handling, and, if necessary, disposal at an identified appropriate disposal facility, or reuse of the well stimulation fluid load recovered during flow back, swabbing, or recovery from production facility vessels. Provides that the storage of the well stimulation fluid load shall be protective of an underground source of drinking water by the use of either tanks or lined pits. Provides that nothing in the provision shall be construed to require or allow disclosure of trade secrets or commercial information that is exempt from inspection or copying when provided to the Department together with a claim made pursuant to the Freedom of Information Act that such information is proprietary, privileged, or confidential and that disclosure may cause competitive harm to the person or business. Provides that the provision only applies to the extraction of natural gas from shale.
