CRIMINAL LAW-TECH

DORMANT MINERAL INTERESTS ACT

Creates the Dormant Mineral Interests Act. Provides a statement of public policy and definitions. Describes mineral interests to which the Act does not apply. Describes the process for and the limitations on the termination of a dormant mineral interest. Provides for the preservation of a mineral interest through a recorded notice process. Allows for late recording of a mineral interest by the mineral owner in specified circumstances. Describes the effect of a court termination of a mineral interest. Provides for the implementation of the Act, limitations on actions under the Act, and uniformity of application and construction of the Act. Contains a severability provision.

EXEC-ABOLISH COMPTROLLER

Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the Office of the Comptroller. Provides that the Treasurer shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. Effective upon being declared adopted, and applies upon conclusion of the terms of the Comptroller and Treasurer elected in 2010.

PEN CD-CHIC PARKS-SUBROGATION

Amends the Chicago Park District Article of the Illinois Pension Code. Provides that in those cases where the injury or death for which a disability or death benefit is payable was caused under circumstances creating a legal liability on the part of some person or entity to pay damages to the disabled employee, then legal proceedings may be taken against that other person or entity to recover damages, notwithstanding the fund's payment, of or liability to pay, disability or death benefits. Provides that the fund may intervene in any action brought by the disabled employee or his or her personal representative. Authorizes the fund to bring an action against the third party for the recovery of all damages on account of injuries caused to the employee if the employee has not brought such an action within a specified period of time.

PENCD-CHIC TCHR-HEALTH INS MAX

Amends the Chicago Teacher Article of the Illinois Pension Code. In provisions concerning the Board of Trustees of the Public School Teachers' Pension and Retirement Fund of Chicago's power to defray health insurance costs, increases the maximum total payments for that purpose to $75,000,000 (from $65,000,000) plus any amount authorized to be paid in the preceding year that was not actually paid by the Board, including interest earned thereon. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PEN CD-CHIC POLICE-COLA

Amends the Chicago Police Article of the Illinois Pension Code. Provides that, for policemen born on or after January 1, 1955, beginning on January 1, 2012, automatic annual increases shall be 3% and such policemen shall not be subject to the 30% maximum increase. Increases employee contributions by 1% in exchange for that benefit enhancement. Makes changes concerning annual increases to the monthly annuities of persons who first become a policeman on or after the effective date of the amendatory Act and deletes repetitive language concerning annual increases in survivor's annuities for new hires. Amends the State Mandates Act to require implementation without reimbursement.

PEN CD-COOK CO-DISABILITY

Amends the Cook County Article of the Illinois Pension Code. Provides that a county employee with 20 or more years of service, who first became a participant on or after January 1, 2011 and whose entire disability benefit credit period expires before attainment of age 62, may qualify for certain annuities. Effective immediately.

CD CORR-INITIATIVE PROBATION

Amends the Criminal Identification Act and the Unified Code of Corrections. Creates Offender Initiative Probation. Provides that whenever any person who has not previously been convicted of, or placed on probation or conditional discharge for, any felony offense, other than a violent offense, under the laws of this State, the laws of any other state, or the laws of the United States, pleads guilty to, or is found guilty of, a probationable felony offense of theft, retail theft, forgery, possession of a stolen motor vehicle, burglary, possession of burglary tools, possession of cannabis, possession of a controlled substance, or possession of methamphetamine, the court, with the consent of both the defendant and the State's Attorney, may, without entering a judgment, sentence the defendant to probation. Establishes the terms and conditions of the probation. Provides that upon fulfillment of the terms and conditions of probation, the court shall discharge the person and dismiss the proceedings against the person. Provides that upon violation of a term or condition of probation, the court may enter a judgment on its original finding of guilt and proceed as otherwise provided by law.
