FIREARM DISCHARGE REPORT

Amends the Criminal Code of 2012. Provides that if grants are available to the Department of State Police for this purpose, the Department shall develop and maintain a website and database containing certain information about firearm discharge incidents in public places derived from local incident reports submitted by the law enforcement agency to the Department of State Police on a secure website such as LEADS. Provides that the information in the database shall be available to public health researchers designated by the Director of State Police, in consultation with the Director of Public Health. Provides that the Department of State Police shall annually compile a report based on the information contained in the database reported by law enforcement agencies to the Department within the previous calendar year.

JUV CT&CRIM PRO-INTERROGATIONS

Amends the Juvenile Court Act of 1987 and the Code of Criminal Procedure of 1963. Provides that an oral, written, or sign language statement of an accused made as a result of a custodial interrogation at a police station or other place of detention shall be presumed to be inadmissible as evidence against the accused in any criminal or juvenile court proceeding in which the accused is charged with the commission of an offense that is a homicide or a Class 1 felony or a Class X felony (rather than a homicide offense or a DUI offense in which the DUI was the proximate cause of death) unless: (1) an electronic recording is made of the custodial interrogation; and (2) the recording is substantially accurate and not intentionally altered. Allows the admissibility of a statement given at a time when the interrogators are unaware that the offense could be charged as a homicide or as a Class 1 felony or Class X felony.

INCOME TAX RATES

Proposes to amend the Revenue Article of the Illinois Constitution. Removes a provision that provides that a tax on income shall be measured at a non-graduated rate. Provides that, for any income tax imposed upon corporations, the rate shall not exceed the weighted average rate imposed on individuals by more than a ratio of 8 to 5. Effective upon being declared adopted.

PENS CD-DWNST POLICE-BOARD

Amends the Downstate Police Article of the Illinois Pension Code. In the provision concerning the membership of the Board of Trustees of the Police Pension Fund, provides that if there are no beneficiaries available and willing to serve as the 5th member, then the 5th member may be elected from the active participants of the pension fund by the beneficiaries. Effective immediately.

MORTALITY REVIEW-MEMBERS

Amends the Department of Juvenile Justice Mortality Review Team Act. Provides that each mortality review team shall consist of at least one member who is a representative of a bar association, law school, or legal academic organization.

CLERKS OF COURTS-COMPENSATION

Amends the Clerks of Courts Act. Provides that certain reimbursements received by State correctional institutions for administrative assistance to perform services shall be appropriated each year by the General Assembly to the Department of Corrections, which shall distribute the awards in annual lump sum payments to the Clerks of the Circuit Court in the counties in which the additional staff is employed. Deletes language providing that the payments shall be payable monthly from the State Treasury to the county treasurer. Provides that the reimbursement shall be paid for all types of administrative assistance provided by the Clerk of the Circuit Court in connection with the State correctional institution and that nothing in the provisions may be construed as limiting the reimbursement to only certain types of cases. Provides that the same reimbursement provided in connection with the operation of State correctional institutions shall also be paid in connection with treatment and detention facilities established under the Sexually Violent Persons Commitment Act.

IJJC - JUVENILE EXPUNGMENT

Request that the Illinois Juvenile Justice Commission summarize available information research on the best practices within the State and across the nation with respect to juvenile record confidentiality, law enforcement recordkeeping, and expungement and make recommendations to the Governor and General Assembly regarding effective policy and practice concerning juvenile record confidentiality and expungement.

NO REPRESENTATN W/O POPULATION

Creates the No Representation Without Population Act. Provides that the Illinois Department of Corrections shall collect and maintain an electronic record of the legal residence, outside of the facility, and other demographic data, for any person entering its custody after January 1, 2014. Provides that the record shall contain, at a minimum, the last known complete street address prior to incarceration, the person's race, whether the person is of Hispanic or Latino origin, and whether the person is age 18 or older. Contains provisions concerning reports, federal facilities, the Data Collection and Reporting Advisory Council, and State and federal aid. Requires the Secretary of State to prepare redistricting population data to reflect incarcerated persons at their residential address. Provides that this data shall be the basis of the Legislative and Representative Districts created under the Illinois Constitution and all local governement districts that are based on population. Contains a severability clause.
