BD HIGH ED-APPROVE NEW PROG

Amends the Board of Higher Education Act. In provisions requiring the Board of Higher Education's approval of new units of instruction, research, or public service, provides that the approval of the Board is required even if the new unit of instruction, research, or public service is required by State law. Effective immediately.

SERVICEMEMBER EMPLOY-VIOLATION

Amends the Service Member's Employment Tenure Act. Provides that the Attorney General shall establish and maintain a statewide toll-free hotline to provide information and referrals to employees or other individuals concerning their rights under the Act; the hotline shall include the capability of accepting complaints of an employer's violation of the Act. Provides that the Attorney General shall establish and maintain a statewide list of employers who have been convicted of violating the Act; the Attorney General shall make the information in the list available to the public on its official web site and by any other means the Attorney General deems appropriate. Effective immediately.

DIRECT LENDING BY UNIVERSITIES

Amends the Higher Education Student Assistance Act. Provides that the Illinois Student Assistance Commission shall have the power to allow for direct lending by institutions of higher learning. Effective immediately.

INC TAX-STUDENT DEBT

Amends the Illinois Income Tax Act. Authorizes a credit to taxpayers for expenditures by the taxpayer during the taxable year for the purpose of paying accrued higher education debt incurred by a person employed by the taxpayer during at least 10 months of the taxable year. The amount of the credit is up to 20% of the employee's accrued higher education debt during the first year, 30% during the second year, and 50% during the third year, but not to exceed an aggregate of $10,000 per employee. Provides that the credit may not reduce the taxpayer's liability to less than zero and may not be carried back, but may be carried forward and applied to the tax liability of the 3 taxable years following the excess credit year. Exempt from the Act's sunset provisions. Effective immediately.

PUB LABOR-CONFIDENTIAL EMPLOYE

Amends the Illinois Public Labor Relations Act. Requires a rebuttable presumption that a managerial assistant is a confidential employee. Defines a managerial assistant as a secretary, assistant, aide, or person in a similar position to a labor supervisor. Effective immediately.

EPA-LIVESTOCK-NUISANCE

Amends the Environmental Protection Act. Prohibits any person from bringing a civil suit based on potential nuisance with respect to a proposed livestock facility until all federal, State, and local permits and approvals required for the proposed facility have been granted. Provides that a prevailing defendant in any action in which a proposed livestock management facility is alleged to be a nuisance shall recover certain costs and fees. Defines "prevailing defendant". Effective immediately.

VEH CD-NON-HWY VEH-FARMING

Amends the Illinois Vehicle Code. Provides that it shall not be unlawful for any person to drive or operate any non-highway vehicle upon any county roadway or township roadway for the purpose of conducting farming operations to and from the home, farm, farm buildings, and any adjacent or nearby farm land. Effective January 1, 2010.

RECYCLE-ELECTRONICS-LANDFILLS

Amends the Electronic Products Recycling and Reuse Act. Accelerates by one year (from January 1, 2012 to January 1, 2011) the date upon which certain prohibitions regarding the disposal of electronic products take effect. Makes corresponding changes to the period during which county governments and action agencies may petition the Illinois Pollution Control Board for a temporary waiver from these prohibitions and during which the holders of waivers are exempted from enforcement proceedings. Effective immediately.

PROP TX-UTILITY EASEMENTS

Amends the Property Tax Code. Provides that a Section imposing a real estate transfer tax does not apply to the transfer of an easement to a public utility, an affiliate of a public utility, or a telecommunications carrier.

SCH CD-REIMBURSE ROE-BORROWING

Amends the School Code. Requires the State Board of Education to reimburse regional offices of education, from appropriations from State general revenue funds, for all interest paid from borrowing or establishing a line of credit for the purpose of maintaining operations and services. Provides that payments are subject to appropriation of moneys for this purpose from the General Revenue Fund and must be distributed to regional offices of education upon certification by the State Superintendent of Education of the amount of interest paid by the regional superintendent of schools as a result of borrowing or establishing a line of credit due to delayed State payments. Effective immediately.
