Rep. John Cabello

Amends the Township Code, the Park District Code, the Illinois Municipal Code, the School Code, and the Public Community College Act. Provides that if a township, park district, municipality, school district, or community college has been issued a credit card, then, each month, the governing authority of the township, park district, municipality, school district, or community college shall vote to verify the validity of an itemized statement of all purchases made using the credit card in the preceding month. Provides that the itemized statement must include all purchases made using the credit card in the preceding month and may not be redacted. Provides that the vote shall solely be for the approval of the itemized statement of all purchases made using the credit card and shall not include any other expense approval. Provides that, if a township, park district, municipality, school district, or community college has a website maintained by a full-time staff, then the township, park district, municipality, school district, or community college shall publish each itemized statement on its website.

Amends the Illinois Vehicle Code. Removes the requirements that a non-highway vehicle is required to have a red reflectorized warning device in the front and a slow moving emblem on the rear. Effective immediately.

Amends the Illinois Emergency Management Agency Act. Updates definitions and terminology. Expands Agency powers and responsibilities for emergency management and homeland security. Creates the Statewide Interoperability Coordinator within the Agency and specifies duties. Makes related changes concerning planning, coordination, and mutual aid. Effective immediately.

Amends the Code of Civil Procedure. Provides that each of the following is void and unenforceable if it allows the application of Shari'a or any foreign law, legal code, or system that denies the parties the fundamental liberties, rights, and privileges guaranteed under the United States Constitution or the Illinois Constitution: (1) a ruling or decision of any state court, arbitration panel, tribunal, or administrative agency that is based, in whole or in part, on Shari'a or any foreign law, legal code, or system; (2) a contract, or contractual provision if severable, that provides for the choice of Shari'a or any foreign law, legal code, or system; or (3) a contract, or contractual provision if severable, that grants jurisdiction to a foreign tribunal if a ruling, decision, or provision allows the application of Shari'a or any foreign law, legal code, or system that denies the parties the fundamental liberties, rights, and privileges guaranteed under the United States Constitution or the Illinois Constitution. Sets forth exceptions. Prohibits a court, arbitration panel, tribunal, or administrative agency from transferring any civil action if the transfer would result in the application of Shari'a or any foreign law, legal code, or system that would violate or likely violate the fundamental liberties, rights, and privileges of the parties guaranteed under the United States Constitution or the Illinois Constitution.

Amends the Illinois Vehicle Hijacking and Motor Vehicle Theft Prevention and Insurance Verification Act. Provides that each self-insured commercial vehicle rental company may collect and shall pay into the Vehicle Hijacking and Motor Vehicle Theft Prevention and Insurance Verification Trust Fund an amount equal to $1.00, or a lesser amount determined by the Illinois Vehicle Hijacking and Motor Vehicle Theft Prevention and Insurance Verification Council, multiplied by each car rental contract providing physical damage insurance coverage written by it in the State during the preceding calendar year. Effective January 1, 2027.

Amends the Illinois Vehicle Code. Changes the model year and registration date requirements for a Special Hauling Vehicle with regard to its allowable combined weight and axle weight to the model year of 2034 (rather than 2024) and registration date of January 1, 2035 (rather than January 1, 2025). Changes the criteria regarding weight limitations for tow trucks and vehicle combinations during towing operations. Provides that specified criteria regarding weight limitations do not apply to a covered heavy duty tow and recovery vehicle. Provides that clearing a vehicle does not include towing the vehicle from the scene of disablement. Provides that any person, firm, or corporation that violates a provision regarding restricted rights to use highways shall be fined $150 (rather than $75) per every 500 pounds or fraction thereof for any excessive weight. Provides that any excess size or weight movement conducted under a person that does not meet certain requirements shall be void and the movement unpermitted. Makes other changes.

Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that the amendatory Act may be referred to as the Pension Equity Act. Provides that, beginning on January 1, 2027, for all purposes under the Code (including, without limitation, the calculation of benefits and employee contributions), the annual earnings of a Tier 2 sheriff's law enforcement employee shall not include overtime and shall not exceed $145,649.97 (instead of $108,600, as adjusted annually beginning in 2011) plus the lesser of (i) 3% of that amount or (ii) the annual unadjusted percentage increase (instead of one-half the annual unadjusted percentage increase) in the consumer price index-u for the 12 months ending with September 2026. Provides that, beginning on January 1, 2028, that amount shall annually thereafter be increased by the lesser of (i) 3% of that amount, including all previous adjustments, or (ii) the annual unadjusted percentage increase (instead of one-half the annual percentage increase) in the consumer price index-u for the 12 months ending with the September preceding each November 1, including all previous adjustments. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Provides that the changes shall not result in any retroactive adjustment of any employee contributions. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the Video Gaming Act. Prohibits a home rule unit of local government with a population of over 1,000,000 from enforcing any local ordinance passed prior to the effective date of the amendatory Act prohibiting the operation of video gaming terminals within the corporate limits of the municipality. Prohibits a home rule unit of government with a population of over 1,000,000 from imposing any fee for the operation of a video gaming terminal in excess of $250 per year.

Amends the Garden Act. Provides that a person may save the seeds grown in a vegetable garden for personal consumption or non-commercial sharing. Provides that a unit of local government may not adopt a regulation or ordinance that precludes saving seeds grown in vegetable gardens.
