Amends the Recreational Use of Land and Water Areas Act. Limits the liability of landowners to persons engaging in fishing, hiking, camping, birdwatching, or prairie seed collecting under specified circumstances. Effective immediately.

Amends the Illinois Income Tax Act. Creates a $20,000 tax credit for each motor fuel retailer who installs one or more new fuel tanks and dispensing pumps that are used solely to dispense biodiesel blend that contains more than 5% biodiesel at his or her motor fuel retail store in Illinois during the taxable year. Provides that the credit applies to taxable years ending on or after December 31, 2006 and on or before December 30, 2011. Limits the credit to one year. Provides that the credit may not be carried forward or back and may not reduce the taxpayer's liability to less than zero. Effective immediately.
Amends the Department of State Police Law. Provides that the Department of State Police may make grants to units of local government to defray the costs incurred by those units of local government in: (1) securing and cleaning up sites in which methamphetamine was illegally manufactured; (2) employing full or part-time police officers assigned to drug task forces or Metropolitan Enforcement Groups and for overtime pay for these officers; and (3) providing medical and dental care for methamphetamine addicts incarcerated in county jails. Effective July 1, 2005.
Amends the Counties Code. Provides that when a county board member enters into active military service of the United States and is unable to continue to discharge the member's powers and duties, there shall be a temporary vacancy declared. The county board shall appoint a temporary replacement county board member to serve until the member delivers a written notice to the chairperson that he or she is no longer unable to serve as a member due to his or her active military service or the term of office to which the member was elected ends. When the county board member returns, he or she shall resume the position of county board member for the balance of the term of office to which he or she was elected. Effective immediately.
Amends the Illinois Vehicle Code. Deletes language requiring a person to stop the engine before leaving a vehicle unattended.
Amends the Gas Use Tax Law. Provides that, on or after July 1, 2005, no tax shall be imposed or collected under the Act. Amends the Gas Revenue Tax Act. Reinstates, beginning July 1, 2005, an exemption from the definition of "gross receipts" any charge for gas or gas services to a customer who acquired contractual rights for the direct purchase of certain gas or gas services originating from an out-of-state supplier or source on or before March 1, 1995. Ends the tax exemption for transactions with customers who incur a tax liability under the Gas Use Tax Law for bills issued to customers on or after July 1, 2005. Effective immediately.
Amends the Code of Civil Procedure. Adds aggravated criminal sexual abuse to the list of crimes for which a person may be subject to an emergency eviction.

Creates a $500 tax credit for each taxpayer who purchases 1,000 gallons or more of motor fuel that contains more than 10% but not more than 30% ethanol and creates a $500 tax credit for each taxpayer who purchases 1,000 gallons or more of biodiesel blend that contains more than 5% biodiesel. Creates a $20,000 tax credit for each motor fuel retailer who installs one or more new fuel tanks and dispensing pumps that are used solely to dispense motor fuel that contains more than 10% but not more than 30% ethanol at his or her motor fuel retail store in Illinois during the taxable year. Creates a $20,000 tax credit for each motor fuel retailer who installs one or more new fuel tanks and dispensing pumps that are used solely to dispense biodiesel blend that contains more than 5% biodiesel at his or her motor fuel retail store in Illinois during the taxable year. Provides that each of the credits applies to taxable years ending on or after December 31, 2005 and on or before December 30, 2010. Limits each of the credits to one year. Provides that the credits may not be carried forward or back and may not reduce the taxpayer's liability to less than zero. Effective January 1, 2006.
Amends the School Construction Law. Defines "project labor agreement". Provides that the State Board of Education and the Capital Development Board shall not require a project labor agreement for any school construction project grant or debt service grant provided under the Law.
Amends the State Parks Act. Authorizes the Department of Natural Resources to cut and remove timber and other forest products as necessary and appropriate for the preservation of geologic or topographic formations, including canyons, gorges, caves, dunes, beaches, moraines, or palisades that have unusual aesthetic, historic, or cultural value.
