RES REAL PROP-NEW CONSTRUCT

Amends the Residential Real Property Disclosure Act. Provides that the seller or agent of newly constructed residential real property must disclose in writing to any prospective buyer prior to closing whether the property is in a flood plain or, if known, in an area prone to flooding.

HEALTH INS RESERVE FUND

Amends the State Finance Act. Provides that the Local Government Health Insurance Reserve Fund is exempt from a provision of the Act that allows the transfer of money from certain special funds into the General Revenue Fund.

VEH CD-FINES AND PENALTIES

Amends the Illinois Vehicle Code. In provisions concerning payment and disposition of fines and penalties recovered under Chapters 11 through 16 of the Code, provides instead that those provisions apply to payment and disposition of fines and penalties recovered under Chapters 3 through 18d of the Code. Provides that if a violation is prosecuted by the authorities of the county, any fines or penalties recovered shall be disbursed pursuant to Supreme Court Rule 529 (instead of paid to the county treasurer). Provides that if a violator was arrested by the State Police, the State Police's portion of the fine shall be deposited into the State Police Vehicle Fund, except as otherwise specified.

CRIM CD-DISARM PEACE OFFICER

Amends the Criminal Code of 1961 and the Unified Code of Corrections. Provides that disarming a peace officer or correctional institution employee is a non-probationable Class 1 felony. Provides that an attempt to disarm a peace officer or correction institution employee is a Class 2 felony. Effective immediately.

HIGHWAY BRIDGE ADVERTISING

Amends the Highway Advertising Control Act of 1971. Provides that signs advertising or displaying any material permitted by specified provisions of the Act may be incorporated into the concrete of highway bridges for purposes of advertising or providing information. Provides that the Department of Transportation of the State of Illinois shall only permit the sign if it is incorporated into the highway bridge using the concrete as a substrate. Provides that the sign shall not consist of a separate structure that is affixed to the highway bridge by mechanical means. Provides that the Department shall also require that any sign created under specified provisions is able to be removed from the concrete and that the concrete be able to be restored to its original condition. Effective July 1, 2008.

PRIVATE SEWAGE-OFF LOT SYSTEMS

Amends the Private Sewage Disposal Licensing Act. Defines "off-lot discharging private sewage disposal system". Provides that every owner of an off-lot discharging private sewage disposal system must file a "Notice of Intent" with the Department of Public Health to allow coverage of the system under the blanket National Pollutant Discharge Elimination System (NPDES) permit of the State. Effective immediately.

PROCUREMENT-CONSTRUCTION BID

Creates the Local Government Construction Contract Act. Requires that if a unit of local government or school district imposes responsible bidder requirements similar to those of the Illinois Procurement Code when procuring construction, the unit or district must provide notice of and a public hearing on the adoption of any guidelines implementing required participation in certain apprenticeship and training programs. Amends the Illinois Procurement Code. With respect to the requirement that a responsible construction contract bidder and the bidder's subcontractors must participate in applicable apprenticeship and training programs, permits participation in training by an organization approved by the National Center for Construction Education and Research (now, only apprenticeship and training programs approved by the federal government). Includes safety training within "training". Defines participation as (i) the bidder's and subcontractor's affiliation with or membership in a trade union or organization that provides the applicable apprenticeship and training programs and (ii) the bidder's and subcontractor's enrollment of apprentices or workers in the applicable programs for the contract work to be performed. Requires that State construction agencies adopt implementing rules.

PEN CD-TRANSFER POLICE CREDS

Amends the Illinois Pension Code. Provides that an active member of the State Employees' Retirement System who is a State policeman, an investigator for the Secretary of State, or a conservation police officer may transfer to that System up to 5 years of his or her creditable service accumulated for service in a police capacity under certain other Articles of the Code. Requires payment of the difference in contributions, plus interest. Authorizes reinstatement of certain credits previously terminated by acceptance of a refund, upon repayment of the refund, plus interest. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
