USE/OCC TAX-MFG&ASSEMB EXEMPT

Amends the Use Tax Act. Extends the exemption for purchases of production related tangible personal property through June 30, 2017 (now, through June 30, 2008). Provides that the credit is awarded through a credit memorandum. Requires the Department of Revenue to report annually concerning the exemption. Imposes conditions on rulemaking. Amends the Retailers’ Occupation Tax Act. Eliminates language concerning credits for production related tangible personal property. Effective immediately.

CHILD SUPP-MILITARY DISABILITY

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that disability compensation received from the United States Department of Veterans Affairs or a grant or other compensation received under the Military Code of Illinois for service-related injuries shall be excluded from net income for purposes of determining child support. Effective immediately.

VEH CD-MILITARY SERIES PLATES

Amends the Illinois Vehicle Code. Provides that a person who is eligible to apply for special license plates in any military series, other than Gold Star license plates, may apply for those special license plates for not more than 2 different motor vehicles.

INS CD-ACCESS TO CONTRACTS

Amends the Illinois Insurance Code. Sets forth provisions concerning restrictions on payment and reimbursement. Provides that a contracting entity, insurer, or third-party administrator may not grant access to a provider's health care services and contractual discounts pursuant to a provider network contract or reimburse a physician or other provider on a discounted fee basis for covered services that are provided to an insured unless certain conditions are met. Provides that a party to a preferred provider contract may not sell, lease, or otherwise transfer information regarding the payment or reimbursement terms of the contract without notification to and the authority of the other contracting parties. Sets forth requirements for a contracting entity, insurer, or third-party administrator that grants access to a provider's health care services and contractual discounts pursuant to a provider network contract. Provides that the Department of Insurance shall enforce the provisions concerning restrictions on payment and reimbursement. Sets forth penalties for violations of the Act.

ORGANIZED CRIME

Creates the Organized Crime Control Act. Provides that a person who has received any proceeds with knowledge that they were derived, directly or indirectly, from a pattern of racketeering activity may not use or invest, whether directly or indirectly, any part of the proceeds or the proceeds derived from the investment or use thereof in the acquisition of any title to, or any right, interest, or equity in, real property or in the establishment or operation of any enterprise. Provides that a person, through a pattern of racketeering activity, may not acquire or maintain, directly or indirectly, any interest in or control of any enterprise or real property. Provides that a person employed by, or associated with, any enterprise may not conduct or participate, directly or indirectly, in the enterprise through a pattern of racketeering activity. Provides that any person convicted of engaging in racketeering activity is guilty of a Class 1 felony. Provides that any person who engages in a continuing criminal enterprise is guilty of a Class 1 felony. Requires the court to order forfeiture to the State of all real or personal property used in the course of, or intended for use in the course of, derived from, or realized through such criminal conduct. Provides for other civil remedies. Provides that the Attorney General and the State's Attorneys of this State have concurrent authority to institute criminal proceedings under the Act, except that a State's Attorney may institute proceedings only with the prior written approval of the Attorney General. Effective immediately.

CRIM PRO-UNFIT DEFENDANT

Amends the Code of Criminal Procedure of 1963. Provides that the treatment period for a defendant found unfit to stand trial to attain fitness shall be one year from the date of the finding of unfitness for a defendant charged with a felony and 6 months from that date for a defendant charged with a misdemeanor. Effective immediately.

PUB AID-AABD PILOT PROGRAM

Amends the Aid to the Aged, Blind, or Disabled Article of the Illinois Public Aid Code. Provides that the General Assembly is committed to a public participatory process in developing any pilot or demonstration program seeking to implement managed care or integrated care for Medicaid eligible adults who are aged, blind, or disabled, and that to assure such a process, the General Assembly and the Governor shall establish a task force to develop the core values of any such program, and to oversee its further development and implementation. Requires the task force to assess Illinois' readiness for developing such a pilot or demonstration program by analyzing lessons learned from other states that have attempted to implement similar programs, and to develop a comprehensive concept paper outlining the core values for the pilot or demonstration program or a comprehensive report outlining the explanations for why Illinois is not sufficiently prepared to develop a pilot or demonstration program. Provides that if the task force determines Illinois is sufficiently prepared to develop a pilot or demonstration program, then the task force shall work collaboratively with the Department of Healthcare and Family Services to plan, design, and implement the program. Contains provisions regarding the composition of the task force; the task force's duration; the frequency of task force meetings; and public hearings. Further provides that the Department on Aging, the Department of Healthcare and Family Services, and the Department of Human Services shall provide necessary staff support to operate the task force. Effective immediately.
