Amends the Illinois Vehicle Code. Provides that an offender's eligibility for a restricted driving permit depends on whether denial of all driving privileges would cause undue hardship, as defined by rules adopted by the Secretary of State. Provides that a person convicted of 4 or more offenses of driving under the influence, leaving the scene of an accident involving death or personal injury, or reckless homicide, or a combination of those offenses, is not eligible for a restricted driving permit. Provides that the Secretary shall revoke the driving privileges of any person under the age of 21 convicted of an out-of-state offense similar to DUI. Provides that a second suspension of a person's driving privileges for an out-of-state offense similar to DUI, or a single suspension of that type, if coupled with a summary suspension under the Code or a DUI or reckless homicide conviction, shall result in the person's being prohibited from driving a vehicle that is not equipped with an ignition interlock device. Provides that a conviction of reckless homicide (as well as a conviction of DUI) increases the limitations that shall be imposed on a person's driving privileges.

Amends the Charter Schools Law of the School Code. Under specified circumstances, allows for a maximum of 5 additional charter schools exclusively for truants or dropouts in Chicago if the limit on the number of charter schools that may operate at any one time in the rest of the State has not been reached. Provides that if any of the additional charter schools are not used exclusively for truants or dropouts, then the State Board of Education shall withhold and the charter school shall forfeit all State funding designated for that school.
Amends the State Treasurer Act. Authorizes the State Treasurer to create the State Treasurer Financial Education and Savings Not-For-Profit Corporation for the purposes of promoting financial literacy and savings among the residents of the State of Illinois and to issue grants and scholarships. Sets forth requirements for the creation and operation of the corporation. Effective immediately.
Amends the Payday Loan Reform Act. Changes the definition of "payday loan" to include any loan with a finance charge exceeding an annual percentage rate of 36% (instead of with a finance charge exceeding an annual percentage rate of 36% and with a term that does not exceed 120 days). Provides that no lender may make a payday loan with periodic payments unless the periodic payments are substantially equal term payments and, if paid as scheduled, result in full payment of the principal and interest owed on the loan at the end of the loan term. Requires the licensee, as part of the information that he or she must collect and maintain, to include the total number of lawsuits filed by the licensee or its agent against consumers to collect on payday loans from consumers during the preceding calendar year. Prohibits a licensee or a person making payday loans from evading the requirements and prohibitions of the Act by use of a device or subterfuge including, but not limited to, (i) disguising a payday loan as a different type of transaction, or (ii) characterizing a required fee as a purchase of a good or service in connection with a payday loan. Authorizes the Department to develop rules to determine if any person or entity seeks to evade the applicability of this Act by any device, subterfuge, or pretense. Effective immediately.
Amends the Mercury Fever Thermometer Prohibition Act. Makes a technical change in a Section concerning the manufacture of mercury fever thermometers.
Amends the Credit Information in Personal Insurance Act. Provides that an insurer that uses credit information to underwrite risks shall not (i) take an adverse action against a consumer solely because he or she does not have a credit card account; (ii) take an adverse action against a consumer based on credit information, unless and until the insurer satisfies certain conditions, and (iii) use certain credit information as a negative factor in any insurance scoring methodology or in reviewing credit information for the purpose of underwriting or rating a policy of personal insurance. Provides that an insurer authorized to do business in this State may not take adverse action against a consumer who has tendered notice of an extraordinary life event unless and until the insurer has reviewed the consumer's notification and provided the consumer with a written explanation for its decision. Provides that if the insured has overpaid premium due to incorrect or incomplete credit information, the insurer shall refund to the insured the amount of overpayment calculated back to the shorter of either the last 12 months of coverage or the actual policy period. Provides that the insurer must provide the disclosure statement required under the provision each time the insurer obtains the consumer's credit report. Makes other changes. Effective immediately.
Creates the Handgun Dealer Licensing Act. Provides for the regulation of handgun dealers through licensure by the Department of State Police. Provides that no person may sell or otherwise transfer, expose for sale or transfer, or have in his or her possession with the intent to sell or transfer any concealable firearm without being licensed under the Act. Provides, however, that the prohibition does not apply to a person who makes occasional sales, exchanges, or purchases of concealable firearms for the enhancement of a personal collection or as a hobby, or who sells all or part of his or her personal collection of firearms. Sets forth provisions concerning application, fees, duration of licensure, license retention requirements, submissions to the Department, penalties, revocation, and suspension. Grants rulemaking authority to the Department and provides that for the purpose of determining compliance with the Act, the Act may be enforced by any municipality in which a licensee is located or, if a licensee is not located in a municipality, by the county in which a licensee is located.
Amends the Children and Family Services Act. Provides that the Department of Children and Family Services must establish and implement a program to monitor the minor children of incarcerated parents. Sets forth the objectives of the program.
Amends the Illinois Vehicle Code. Provides that any second division vehicle weighing not more than 8,000 pounds or first division vehicle manufactured on or after January 1, 2008 must be equipped with mirrors, sensors, a camera, or other device giving the driver an unobstructed view of the entire area immediately behind the vehicle. Provides that the new provision does not apply to any vehicle that is properly registered in another jurisdiction. Provides that the Secretary of State shall adopt rules for implementing the new provision.
Amends the Consumer Fraud and Deceptive Business Practices Act. Removes the exception allowing an electric service provider to divulge to credit bureaus personal information relating to a subscriber of the electric service provider without the written consent of the subscriber.
