UTIL-UNREG SALES OF NAT GAS

Amends the Public Utilities Act. Provides that a gas utility offering unregulated sales of natural gas to an end-use customer within or outside its service area shall be subject to specified provisions of the Act with respect to such sales. Provides that a gas utility offering unregulated sales of natural gas to an end-use customer within or outside its service area shall not subsidize such sales through the utility's regulated business. Provides that a gas utility offering unregulated sales of natural gas to an end-use customer within or outside its service area shall not discriminate in the provision of regulated gas service based upon the existence or terms of an unregulated sale of natural gas. Provides that the Commission may require a gas utility to file reports regarding its unregulated sales of natural gas in the State and shall have access to, for the purpose of review, a gas utility's contracts for unregulated sales of natural gas. Effective immediately.

GENETIC COUNSELOR LIC ACT

Creates the Genetic Counselor Licensing Act. Regulates the practice of genetic counseling through licensure requirements. Provides for administration of the Act by the Department of Professional Regulation. Provides enforcement provisions. Preempts home rule. Amends the Regulatory Sunset Act to repeal the Genetic Counselor Licensing Act on January 1, 2015. Effective immediately.

COMPREHENSIVE-OLDER ADULTS ACT

Creates the Comprehensive Housing, Health, and Supportive Services for Older Adults Act and amends the Illinois Health Facilities Planning Act, the State Finance Act, and the Nursing Home Care Act. Requires the Director of Public Health, in coordination with the Director of Aging and the Director of Public Aid, to monitor and analyze the distribution of housing and services for older adults in the different geographic areas of the State and implement corrective action plans by July 1, 2005. Provides for a program for conversion of nursing homes to assisted living or shared housing establishments; makes such conversions exempt from the requirements of the Illinois Health Facilities Planning Act, and provides for transition planning grants to nursing homes making such conversions. Creates special funds in the State treasury for use in implementing the Comprehensive Housing, Health, and Supportive Services for Older Adults Act. Provides for transfers from the Long Term Care Monitor/Receiver Fund to the new Nursing Home Conversion Fund and the new Nursing Home Transition Planning Grant Fund. Makes other changes. Effective immediately.

CRIMINAL LAW-TECH

Amends the Unified Code of Corrections. Makes a technical change in a Section requiring the Department of Corrections to designate those institutions and facilities that are maintained for persons assigned as adults and as juveniles.

IDPH-CERVICAL CANCR TASK FORCE

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Creates the Task Force on Cervical Cancer Elimination within the Department of Public Health. Requires the task force to examine the prevalence and burden of cervical cancer, raise public awareness concerning the causes and nature of cervical cancer, identify prevention and control strategies and technologies, and perform other functions. Requires the task force to develop a statewide comprehensive cervical cancer prevention plan and to make annual reports. Provides for expiration of the task force on April 1, 2009 or upon the task force's submission of its final report, whichever is earlier. Effective immediately.

DOMESTC VIOLENCE-ORDER PROTECT

Amends the Code of Criminal Procedure and the Illinois Domestic Violence Act. Requires that, in an emergency order of protection and an interim or plenary order of protection, specified language be stated.

PROPERTY & MOBILE HOME TAXES

Amends the Property Tax Code. Provides that notice of application for judgment and sale of property may, in the alternative, be mailed to the current owner of record (or, as now, to the person shown by the current collector's warrant book to be the party in whose name the taxes were last assessed). Provides that if a personal or corporate check for the payment of taxes is returned unpaid for any reason prior to judgment, the mailed notice of application for judgment and sale may be sent at any time prior to judgment. Amends the Mobile Home Local Services Tax Act. Sets forth acceptable forms of payment of the tax imposed by the Act. Amends the Mobile Home Local Services Tax Enforcement Act. Makes changes similar to the changes in the Property Tax Code concerning tax sales of mobile homes. Effective immediately.

CNTY CD-YOUTH DIVERSION FEES

Amends the Counties Code. Provides that, in each county in which a teen court, peer court, peer jury, youth court, or other youth diversion program has been created, a county may adopt a mandatory fee of up to $5 to be assessed as provided and deposited into an account specifically for the operation and administration of a teen court, peer court, peer jury, youth court, or other youth diversion program. Provides that the fee must be paid (1) by the defendant on a judgment of guilty or grant of supervision for violation of the Illinois Vehicle Code or violations of similar provisions in county or municipal ordinances committed in the county and (2) by the defendant on a judgment of guilty or grant of supervision under Section 5-9-1 of the Unified Code of Corrections for a felony; for a Class A, Class B, or Class C misdemeanor; for a petty offense; and for a business offense. Provides that the fees assessed must be deposited monthly by the circuit clerk into an account specifically for the operation and administration of youth diversion programs, less 5%, which is to be retained as fee income to the office of the clerk of the circuit court.
