SEX OFFENDER-INTERNET IDENTITY

Amends the Sex Offender Registration Act. Provides that when a sex offender registers with the appropriate law enforcement agency, he or she shall provide the law enforcement agency with all e-mail addresses, instant messaging identities, chat room identities, and other Internet communications identities that the sex offender uses or plans to use, all Uniform Resource Locators (URLs) registered or used by the sex offender, and all blogs and other Internet sites maintained by the sex offender or to which the sex offender has uploaded any content or posted any messages or information. Amends the Sex Offender Community Notification Law. Provides for disclosure of such information to the public. Effective immediately.

CRIM CD-CONTACT-GANG MEMBER

Amends the Criminal Code of 1961. Provides that a person commits the offense of unlawful contact with streetgang members when he or she knowingly has direct or indirect contact with a streetgang member after having been ordered by a judge in any non-criminal proceeding to refrain from direct or indirect contact with a streetgang member or members or after having been released from the Illinois Department of Corrections on a condition of parole or mandatory supervised release that he or she refrain from direct or indirect contact with a streetgang member or members.

INTRASTATE MUTUAL AID ACT

Creates the Intrastate Mutual Aid Act. Establishes the Intrastate Mutual Aid System in order to facilitate (i) the prevention of, response to, and recovery from disasters and (ii) disaster-related exercises, testing, and other training activities among participating political subdivisions. Provides that each political subdivision of the State, including each home rule unit, is a participant in the System unless it opts out of the System. Establishes the Intrastate Mutual Aid Committee to coordinate the System. Establishes the responsibilities, limitations, and reimbursement procedures of participants. Authorizes a participant requesting assistance to deem certain licenses, certificates, and permits valid for the duration of a declared state of emergency. Provides that employees of a participant are entitled to certain benefits. Provides that all activities performed under the Act are deemed governmental functions and no participant or its employee shall be deemed civilly liable for damages under the Act. Denies immunity, rights, or privileges to any individual whose response was not requested or authorized by a participant. Limits the concurrent excercise of home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

FINANCIAL INSTITUTIONS-FEES

Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.

CD CORR-GANG CRIMES

Amends the Unified Code of Corrections. Provides that when a defendant, over the age of 21 years, is convicted of a gang-related felony, after having twice been convicted in any state or federal court of an offense that contains the same elements as an offense now classified in Illinois as a Class 2 or greater Class felony and such charges are separately brought and tried and arise out of different series of acts, such defendant shall be sentenced as a Class X offender.

ALT FUELS-WEB INFORMATION

Creates the Promote Illinois Ethanol and Biodiesel Act. Requires that the internet websites of State agencies must include hypertext links to websites containing information on ethanol and biodiesel fuels. Provides that the required links shall include any website maintained and operated by a State agency that posts information concerning E85 fuel or biodiesel fuel and may include private websites including, but not limited to, websites maintained and operated by the National Ethanol Vehicle Coalition and the National Biodiesel Board. Provides that "State agency" means any department, office, commission, board, or authority within the Executive Department, and includes State-supported universities and colleges and the Illinois Building Authority. Effective immediately.

INC TAX-DEDUCT MEDICAL EXPENSE

Amends the Illinois Income Tax Act. Provides that, for taxable years ending on or after December 31, 2005, an individual taxpayer may deduct from adjusted gross income an amount equal to the medical, dental, and other expenses allowed as a deduction under Section 213 of the Internal Revenue Code to the extent allowed as a deduction from adjusted gross income in computing federal income taxes. Provides that to obtain this subtraction modification the taxpayer must submit to the Department, along with his or her tax return, a copy of the Schedule A form or any successor form completed and submitted for federal income tax purposes. Excepts the deduction from the sunset requirements. Effective immediately.

VIOLENT OFFENDER REGISTRATION

Creates the Violent Offender Registration Law. Provides for the registration of a person who committed a violent crime as defined in the Rights of Crime Victims and Witnesses Act and who is not required to register under the Sex Offender Registration Act, the Arsonist Registration Act, or the Child Murderer and Violent Offender Against Youth Registration Act. Creates the Violent Offender Registration Fund in the State treasury. Provides that the Fund shall receive deposits of registration fees from violent offenders. Establishes various requirements for registration and provides penalties for those persons who violate registration requirements. Creates the Violent Offender Community Notification Law. Provides that the name, address, date of birth, and offense or adjudication for violent offenders required to register under the Violent Offender Registration Law shall be open to inspection by the public. Provides that the Department of State Police and any law enforcement agency may, in the Department's or agency's discretion, place this identifying information about violent offenders on the Internet or in other media. Amends various Acts to make conforming changes.
