LOCAL GOVT-COMPENSATION

Amends the Public Graveyards Act. Provides that cemetery trustees may be paid compensation, not to exceed $2,000 (instead of $500) per year. Amends the Township Code. Provides that members of a multi-township board may receive additional pay for their services in an amount not to exceed $50 per day or $2,000 per year (instead of $25 per day). Provides that the community building board of managers may be paid a salary not to exceed $50 (instead of $25) per day or $2,000 (instead of $500) per year. Provides that, if the cemetery trustees also act as the cemetery caretakers, then they may be paid compensation not to exceed $5,000 per year. Effective immediately.

CD CORR-GOOD CONDUCT-AGG BAT

Amends the Unified Code of Corrections. Eliminates good conduct credit for the offense of aggravated battery when the victim of the aggravated battery is an employee of a police or sheriff's department engaged in the performance of his or her official duties committed on or after the effective date of the amendatory Act.

CRIM PRO-BLOOD WITHDRAWL

Amends the Code of Criminal Procedure of 1963. Provides that a peace officer who, in the course of a lawful arrest or investigation of an alleged criminal offense, is exposed to the blood or other bodily fluids of an alleged offender or other suspect may require that the alleged offender or suspect submit a sample of his or her blood to the law enforcement agency for whom the peace officer is employed for testing and analysis of the blood to determine if the alleged offender or suspect has any sexually transmissible or communicable disease, including a test for infection with HIV or any other identified causative agent of AIDS. Provides that any such medical test shall be performed only by appropriately licensed medical practitioners and may include an analysis of any bodily fluids as well as an examination of the alleged offender or suspect's person. Provides that the costs of such testing and analysis shall be paid by the suspect or the alleged offender unless he or she is unable to pay for such testing and analysis in which case the testing and analysis shall be paid by the law enforcement agency for whom the peace officer who has been exposed to the blood or other bodily fluids is employed. Provides that the results of the testing shall be disclosed only to the peace officer who has been exposed to the alleged offender or suspect's blood or other bodily fluids.

DCEO-NAT GUARD HOME ASSIST

Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that, subject to appropriation, the Department shall establish and administer a guardsman and reservist homebuyer assistance program. Authorizes an eligible applicant of the program to apply to the Department for financial assistance for a portion of the down payment on the purchase of a house. Provides that the financial assistance shall not exceed 10% of the purchase price of the house and shall be in the form of a grant and that an eligible applicant may apply for financial assistance up to 3 years following the completion of active duty. Defines "eligible applicant". Authorizes the Department to adopt necessary rules for the program. Effective July 1, 2006

TOBACCO-POSSESSION-MINORS

Amends the Juvenile Court Act of 1987. Provides that, if a minor violates the provisions prohibiting minors from possessing any cigars, cigarettes, smokeless tobacco, or tobacco in any of its forms, the court may in its discretion, and upon recommendation by the State's Attorney, order the minor and his or her parents or legal guardian to attend a smoker's education or youth diversion program if that program is available in the jurisdiction where the offender resides. Provides that attendance at a smoker's education or youth diversion program shall be time-credited against any community service time imposed for a violation of the provision prohibiting tobacco possession by a minor. Imposes several penalties for a violation of the provision prohibiting tobacco possession by a minor. Amends the Sale of Tobacco to Minors Act. Changes the short title of the Act to the "Prevention of Tobacco Use by Minors Act". Prohibits minors under 18 years of age from possessing any cigar, cigarette, smokeless tobacco, or tobacco in any of its forms. Imposes several penalties for a violation of the provision prohibiting tobacco possession by a minor.

SCHOOL DISTRICT INCOME TAX ACT

Creates the School District Income Tax Act. Allows school districts to tax income after referendum approval of district residents and record owners of property in the district. Provides for additional levies, administration and distribution of the tax, and penalties for violations. Applies only to income earned following 120 days after certification of the results of the referendum. Creates a credit against the tax in an amount not to exceed $500 equal to 5% of the amounts spent by the taxpayer on monthly rent for the taxpayer's residence. Amends the Property Tax Code to provide for abatement of residential, farm, and small business property. Amends the School Code to require that school districts certify income tax levies and amounts realized for property tax abatement purposes and to coordinate the calculation of school aid with the income tax levies by adjusting the operating tax rate accordingly. Amends the State Finance Act to create the School District Income Tax Fund. Effective immediately.

PEN CD-IMRF-FELONY CONVICTION

Amends the IMRF Article of the Illinois Pension Code. Prohibits a person convicted of a felony relating to or arising out of or in connection with his or her service as an employee who is an employee of more than one employer that participates in the Fund from receiving benefits based on any of his or her service as an employee for all employers that participate in the Fund. Provides that, if, as a result of the felony, the employee is ordered by the court to pay restitution to the employer, then (i) the employer may apply for a refund of employee contributions on the employee's behalf and (ii) pursuant to appropriate documentation from the employer and the court, the Fund shall pay to the employer all or a portion of the refund in a sum sufficient to satisfy the court-ordered restitution. Effective immediately.

EMINENT DOMAIN-BLIGHT

Amends the Statute on Statutes. Prohibits all takings under the power of eminent domain by the State or a unit of local government for private development unless the property is within an area that is a "blighted area" and the condemning authority has entered into a written agreement with a private person or entity that agrees to undertake a development project within the blighted area that specifically details the reasons for which the property or rights in the property are necessary for the success of the development project. Defines "private development". Amends the Tax Increment Allocation Redevelopment Act in the Illinois Municipal Code. Provides that in all eminent domain actions in which a property owner is displaced, the displacing entity must pay certain costs related to the relocation and displacement of the property owner's residence, business, or farm operation. Amends the Eminent Domain Article in the Code of Civil Procedure. Provides that, in a condemnation proceeding in which the property has been designated by the condemning authority by ordinance as blighted, the condemning authority must demonstrate and prove by a preponderance of the evidence that the property is blighted property. Provides that the existence of an ordinance designating property as blighted is not prima facie evidence of blight. Provides that an ordinance designating property as "blighted property" shall not be presumed to be valid for purposes of the condemnation proceeding. Makes changes concerning the valuation of condemned property. Requires reimbursement of the property owner for certain relocation costs. Establishes guidelines for determining reasonable attorney's fees (i) if the court awards just compensation that exceeds the initial written offer of the condemning authority and (ii) if the court determines that the taking is not warranted. Preempts home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Makes other changes. Effective immediately.

DENTAL PRACTICE-SUNSET-LICENSE

Amends the Regulatory Sunset Act. Extends the repeal of the Illinois Dental Practice Act to January 1, 2016. Amends the Illinois Dental Practice Act. Defines "titration" and "dental emergency responder". Prohibits the titration of orally administered sedative agents that exceeds the maximum recommended dose. Provides that a dentist shall not be required to maintain a general license in addition to a specialty license. Provides that restricted faculty licenses shall be valid for a period of 3 years, rather than 2 years. Provides that each license issued under the Act shall be valid for 3 years, rather than being set by rule of the Department of Financial and Professional Regulation. Changes continuing education requirements for hours of study. Provides that a surviving spouse or certain other interested parties in an estate may employ, contract with, or otherwise make arrangements for a dentist or dentists to temporarily continue to operate a dental practice under the name of a deceased or incapacitated dentist under certain specified circumstances. Provides that dentists shall be entitled to reasonable reimbursement for the costs of reproducing patient dental records. Provides that a dentist or dental hygienist who is a dental emergency responder acts within the bounds of his or her license when he or she provides care during a declared local, State, or national emergency. Makes other changes. Effective immediately.
