USE/OCC-ELECTRONIC DEVICE

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, the Retailers' Occupation Tax Act. Provides that a person who knowingly sells, purchases, installs, transfers, possesses, uses, or accesses any automated sales device, zapper, or phantom-ware for use in an electronic cash register or other point-of-sale system in this State is guilty of a Class 3 felony.

SENIOR TAX DEFERRAL-INTEREST

Amends the Senior Citizens Real Estate Tax Deferral Act. Provides that interest charged for taxes deferred under the Act shall be at the rate of 3% per year (instead of 6% per year) beginning in taxable year 2011. Effective immediately.

PEN CD-SALARY-STATE SYS + IMRF

Amends the General Assembly, Illinois Municipal Retirement Fund, State Employees, State Universities, Downstate Teachers, and Judges Articles of the Illinois Pension Code. Caps the highest salary for annuity purposes, final rate of earnings, final average compensation, and final average salary for current members, participants, and participating employees of the affected systems at $106,800, but authorizes that amount to be annually increased by the lesser of 3% or one-half of the annual percentage increase in the consumer price index-u for the 12 months ending with the September preceding each November 1. Requires employee contributions to also be based on these capped amounts. Effective July 1, 2011.

SALES TAX HOLIDAY-PERMANENT

Amends the Use Tax Act and the Retailers' Occupation Tax Act. Provides that the sales tax holiday on school supplies created by Public Act 96-1012 applies from August 6th through August 15th of each year beginning in 2010. Amends the State Finance Act to make conforming changes. Effective immediately.

INS CD-FIRE PROTECT DIST FEES

Amends the Illinois Insurance Code. Provides that all policies of automobile insurance must provide coverage for any fees for emergency response services provided by a fire protection district to an insured that arise out of a claim against such policy.

PROP TX-SPECIAL SERVICE AREAS

Amends the Property Tax Code. In a Section concerning a public hearing held prior to the establishment of a special service area, provides that a list of the names and addresses of the individuals and entities to whom notice of the public hearing was sent by mail shall be made available at the public hearing. Provides that a special service area district may not be created or enlarged, a tax may not be levied or imposed nor the rate increased, nor may bonds be issued unless that action is authorized by a petition that is signed by at least 51% of the electors residing within the special service area and by at least 51% of the owners of record of the land included within the boundaries of the special service area (currently, the action may be taken unless a petition objecting to the action is filed). Provides that, if a person who is registered to vote has died or has permanently moved from the special service area, and if certified documentation is submitted along with the authorization petition, then that person shall not be counted as an elector for purposes of the authorization petition.
