PHARMACY PRAC-LABEL-DRUG EXP

Amends the Pharmacy Practice Act. Requires prescription drug, medicine, or poison labels to show the expiration date of the drug, medicine, or poison, as provided by the manufacturer.

UNEMPLOYMENT INS-RETIREMENT

Amends the Unemployment Insurance Act. Provides that none of the amount received by an individual as primary social security old age and disability retirement benefits shall constitute disqualifying income if the gross income of the household in which the individual resides does not exceed specified federal poverty guidelines.

INS CD - POLICY CANCELLATION

Amends the Illinois Insurance Code. Provides that no company may cancel, terminate, or refuse to renew any policy of property and casualty insurance during the pendency of a claim in which the primary residence of the policyholder is or comes to be uninhabitable, unoccupied, or under construction or has yet to be permanently repaired. Provides that any of the following acts by an insurer shall constitute improper claims practice: (1) paying an appraiser, contractor, or vendor involved in providing services or estimates for appraising the value of any loss for repairing a policyholder's home; (2) compelling a policyholder as to which appraiser, vendor, or contractor the policyholder must use for the repair; (3) failing to reimburse a policyholder within 30 days after receiving proof of reimbursable out-of-pocket expenses; or (4) denying a policyholder's request for reimbursement without a written explanation within 30 days after a policyholder's request. Eliminates the $60,000 limit on the part of the taxable costs a court may allow in any action by or against a company where there is in issue the liability of a company on a policy or policies of insurance or the amount of the loss payable thereunder or where there is an unreasonable delay in settling a claim, and it appears to the court that such action or delay is vexatious and unreasonable. Effective immediately.

HOSPITAL DISCRIMINATORY PRICIN

Creates the Hospital Discriminatory Pricing Act. Prohibits a hospital that has provided health care services to an uninsured patient from collecting more from the uninsured patient than the Medicare reimbursement rate. Requires each hospital bill, invoice, or other summary of charges to prominently state the listed information concerning the rates charged. Requires the Office of the Attorney General to provide copies of any complaints filed by patients under the Act to the Department of Public Health. Provides for civil remedies for violations of the Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make any violation of the Hospital Discriminatory Pricing Act an unlawful practice under the Act. Effective immediately.

PROP TX-WAIVE INTEREST PENALTY

Amends the Property Tax Code. Deletes the provision that the interest penalty for the delinquent payment of taxes for brownfield property may be waived only for any taxable year prior to the 2008 taxable year. Effective immediately.

INC TAX-CREDITS

Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.

SCH CD-CHARTER SCH LIMIT-CHI

Amends the Charter Schools Law of the School Code. Under specified circumstances, allows for a maximum of 5 additional charter schools exclusively for truants or dropouts in Chicago if the limit on the number of charter schools that may operate at any one time in the rest of the State has not been reached. Provides that if any of the additional charter schools are not used exclusively for truants or dropouts, then the State Board of Education shall withhold and the charter school shall forfeit all State funding designated for that school.

MEDICAID-HOSPITAL OUTPATIENT

Amends the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall adopt rules establishing criteria, standards, and procedures for payments to hospitals for services provided on an outpatient basis at settings that are on the hospital premises, adjacent to the hospital, or part of a complex of facilities owned and operated by the hospital or an affiliate of the hospital.

UTILITIES-ACES ACT

Creates the Affordable and Clean Energy Standards (ACES) Act. Provides the findings of the General Assembly. Provides that electric utilities shall utilize cost-effective energy efficiency and load management investment in their energy resource portfolios according to specified guidelines. Provides that the Capital Development Board shall adopt the 2006 International Energy Conservation Code, without amendment, as the statewide residential building code for new home construction and significant additions or remodels of existing homes. Includes a severability clause. Preempts home rule. Effective immediately.
