STATE GOVERNMENT-TECH

Amends the State Budget Law of the Civil Administrative Code of Illinois. Makes a technical change concerning submission of the State budget.

PROHIBIT INTERNET PRESCRIBING

Creates the Internet Prescribing Prohibition Act. Provides that licensed prescribers may not knowingly prescribe medications for a patient via the Internet, World Wide Web, telephone, facsimile, or any other electronic means unless (1) the patient has been physically examined by the prescriber or has been given a documented patient evaluation, including health history and a physical examination, to establish the diagnosis for which any legend drug is prescribed; (2) the prescriber and the patient have discussed treatment options and the risks and benefits of treatment; and (3) the prescriber has maintained the patient's medical records. Provides that these provisions shall not be construed to prohibit patient care in certain circumstances or to prevent the electronic distribution of a prescription to a pharmacy. Provides that a person convicted of violating these provisions is guilty of a business offense and shall be fined not less than $1,000 for the first violation and not less than $2,000 for a second or subsequent violation. Requires a person convicted of violating the Act to be reported to the Division of Professional Regulation of the Department of Financial and Professional Regulation for appropriate licensing board review. Amends the Illinois Dental Practice Act, Medical Practice Act of 1987, Nurse Practice Act, Illinois Optometric Practice Act of 1987, Physician Assistant Practice Act of 1987, Podiatric Medical Practice Act of 1987, and Veterinary Medicine and Surgery Practice Act of 2004 to provide that a violation of the Internet Prescribing Prohibition Act constitutes grounds for disciplinary action under those Acts.

JUV CT-DELINQUENCY AGE

Amends the Juvenile Court Act of 1987 and the Unified Code of Corrections. Provides that persons under 18 years of age (rather than under 17 years of age) who commit offenses are subject to the proceedings under the Juvenile Court Act of 1987 for delinquent minors. Effective January 1, 2010.

REAL PROP-SOLAR ENERGY RESTRIC

Creates the Homeowners' Solar Energy Act. Provides that no bylaw or action of a homeowners' association, property owners' association, or a condominium unit owners' association shall prohibit or be interpreted to prohibit a solar energy system or other energy device based on a renewable resource. Provides that no deed restrictions, covenants, or similar binding agreements running with the land shall prohibit or have the effect of prohibiting a solar energy system or other renewable resource energy device from being installed on residential dwelling property that does not exceed 3 stories. Provides that an owners' association may determine the location of a solar energy system. Provides that solar energy systems shall be certified by the Solar Rating and Certification Corporation (SRCC) or another nationally recognized certification entity. Provides that an application for the installation of a solar energy system shall be processed and approved as an application for architectural modification and shall not be willfully avoided or delayed. Provides that any entity, other than a public entity, that willfully violates this Act shall be liable to the applicant or other party adversely affected for actual damages. Provides that in any litigation under this Act, the prevailing party is entitled to reasonable attorney's fees. Provides that the legislative purpose of this Act is to protect the public health, safety, and welfare by encouraging the use of renewable resource energy systems to conserve and protect land and resources and prevent measures which will drive the cost of owning residential property beyond the capacity of private owners.

AUTISM SPECTRUM DISORDERS

Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, the Voluntary Health Services Plans Act, and the Illinois Public Aid Code to provide coverage for autism spectrum disorders to the extent that the diagnosis and treatment of autism spectrum disorders are not already covered by the policy or plan. Provides that this coverage shall be subject to a maximum benefit of $36,000 per year, but shall not be subject to any limits on the number of visits to an autism service provider. Makes other changes. Effective immediately.

EPA-WHITE GOODS RECYCLING

Amends the Environmental Protection Act and the State Finance Act. Provides that white goods may not be disposed in a landfill unless the white goods components and recyclable components have been removed. Creates the White Goods Disposal Fund and the White Goods Recycling Fund as special funds in the State treasury, and provides that moneys in the Funds may be used for certain administrative purposes and for grants to certain manufacturers of products composed of recycled material. Requires retailers of white goods to collect a fee of $8 from the consumer for the purchase of white goods, and requires the retailer to pay all or a portion of that fee to the Department of Revenue for deposit into the White Goods Disposal Fund and the White Goods Recycling Fund. Sets forth provisions for the fee collections and returns by retailers. Provides that the amendatory Act does not authorize rulemaking. Effective immediately.

SEX OFFENDER REG-JUVENILE

Amends the Sex Offender Registration Act and the Sex Offender Community Notification Law. Provides that upon release of a person from a juvenile detention facility, a facility of the Department of Juvenile Justice, or a hospital or other treatment facility, the court shall make a determination as to whether a person who is defined as a sex offender as a result of being adjudicated a juvenile delinquent as the result of committing or attempting to commit an act which, if committed by an adult, would constitute a sex offense shall register as a sex offender. Provides that if the court makes such a determination, the person shall register as a sex offender either upon attaining 17 years of age or upon release from a juvenile detention facility, a facility of the Department of Juvenile Justice, or a hospital or other treatment facility, whichever occurs later.

RENEWABLE ENERGY SOURCES ACT

Creates the Illinois Renewable Energy Sources Act. Contains provisions concerning the requirement that an electric utility connect an eligible electric generator to the utility's distribution systems between 30 and 60 days after a request by the eligible electric generator. Provides that the Illinois Commerce Commission shall establish standards for the interconnection of eligible electric generators with the distribution systems of electric utilities. Provides that electric utilities shall enter into power purchase agreements for a term of not less than 20 years to purchase all electricity from eligible electric generators in the State at specified rates set by the Commission for the following methods of generation: (1) hydroelectric power; (2) landfill gas or sewage treatment gas; (3) biomass or biogas; (4) geothermal energy plants; (5) wind-powered plants; and (6) solar-powered plants. Provides that the Commission shall, after notice and hearing, annually approve a renewable energy factor that shall be a nonbypassable surcharge payable by every customer of an alternative electric supplier, cooperative electric utility, electric utility, or municipal utility. Provides that the Commission shall approve a standard contract to be used in all power purchase agreements under the Act. Provides that the Commission shall review the specified rates every 2 years and adjust those rates as necessary to account for specified factors. Provides that in each of the first 2 years and every 4 years thereafter, the Commission shall file a report with the Governor and General Assembly that shall include specified requirements. Provides that eligible electric generators shall, upon request, provide to the Commission any information that may be relevant to the Commission performing its duties under the Act. Effective immediately.
